This is ridiculous. How would and could such a construct stand in court ?
However seeing what happened to mnta vs amphastar, I wouldn't nowadays dare to bet on any side.
I don't know but it looks like Abbvie is in someway desperate. What I mean is what business does Abbvie have if Gilead overpaid or not for Pharmasset.
Even if indeed Gilead overpaid for Pharmasset and it has to set Sovaldi price sky high to recoup its cost, wouldn't that open up certain strategic pricing options for its own combo ? Unless it believes somehow Sovaldi superiority is unbeatable that it has to resort to such lowly underhand legal tactics ?

AbbVie shot back in its own lawsuit that Gilead was slandering its integrity. It also accused Gilead of focusing on profits to recover the "inflated" $11 billion price it paid to acquire Pharmasset in 2011.>
