Judge Sweeney's Order

There will be 2 or more waves of jurisdictional discovery.

1. The initial first wave includes documents created on or before August 12, 2012. Subsequent waves are to be decided later.

2. Judge Sweeney will settle in depth the issues raised by the Defendant's protective order motion in a protective order Judge Sweeney will write at a later date.

3. Before writing that jurisdictional discovery order, Judge Sweeney requests that the Plaintiff and Defendants submit separately:

a . proposed date ranges to be used to fulfill each of the 19 documents requests made by the Plaintiffs for the period (April 1, 2008 to August 12, 2012)

b. with the reasoning applied for those date ranges for particular documents or sets of documents in each request.

c. These proposals are due no later than Monday, June 23, 2014 at 12:00 p.m.

4. Along with the date range proposals for the 19 document requests made by Plaintiffs, Judge Sweeney orders the parties to submit a joint protective order no later than Tuesday, June 24, 2014 at 5:00 p.m.

Judge Sweeney will consider these date range proposals, the reasonings applied to them and the proposed joint protective order when writing her order for the parties to comply with.

5. Judge Sweeney's order allows the parties one last chance to settle their discovery differences before judge Sweeney settles all issues in her written order to come later.

6. There will be no status conference on Wednesday, July 2, 2014. It is cancelled.

7. The next status conference, if one is needed, shall be held on Wednesday, July 16, 2014.

Judge Sweeney's order is case management only, Nothing has been decided beyond court housekeeping.
