Amenable to Settlement Talks in Federal Appellate Mediation Program

(collectively, "MMR"), today announced that in their respective Docketing Statements filed with the Court of Appeals for the Federal Circuit, MMR, WebMD and Quest Diagnostics confirmed that they would participate in an Appellate Mediation Program at the United States Court of Appeals for the Federal Circuit. On February 5, 2015, WebMD and Quest Diagnostics filed their respective Docketing Statements that they were amenable to mediation by the Appellate Mediation Program. In the filings, WebMD and Quest Diagnostics acknowledged that past settlement negotiations with MMR had occurred following the orders which are the subject of the appeal, and both agreed that mediation may assist in the efficient resolution of the matters. Although assignment to mediation is at the discretion of the Circuit Executive, once selected, participation in the mediation program is mandatory. The assignment to mediation is not confidential, however, the substance of any settlement talks or mediation is confidential and may not be disclosed by any participant.
The Company also announced that it plans to report significantly higher revenue from retailers in its fourth quarter ended December 31, 2014, exceeding total fourth quarter revenues from all sources in the prior year. MMR also announced that it is in talks to sell more than 2,000 patient samples and data from its FavId? vaccine trials to treat lymphoma patients with two major biotech companies that could use the samples for research and development or in connection with drug approval. This second MMR U.S. biotech patent relates to methods of treatment using the anti-CD20 monoclonal antibodies and will be issued under the title, "Antibodies and Methods For Making and Using Them."
The Company has continued to enforce MMR's IP and monetize it by entering into license agreements which have already generated millions of dollars in revenue to the Company. (OTCQB: MMRF) ("MMR") today announced that the Company will report retailer-driven revenue in the fourth quarter 2014 from Patent Agreements, in addition to the previously disclosed licensing agreements with the nation's largest pharmacy retailer, which substantially increases MMR's previously disclosed retail distribution channel that includes access to more than 15,000 U.S. retail locations, 2,000 international locations, and 50 million monthly online visitors. MMR has already received initial revenues from the signing of the agreements related to the increased distribution network during the period ended December 31, 2014. MMRGlobal also announced 2014 was the highest revenue year in the Company's history and that MMR continues to actively pursue strategic opportunities with partners who have the financial resources to make large investments in MMR's technology products, services and Intellectual Property. (collectively, "MMR"), today announced that following the California Court of Appeal's finding that the trial court erred in granting Surgery Center Management, LLC's ("SCM") motion for summary adjudication, the trial court vacated its order, thereby paving the way for MMR to have the opportunity to proceed with its $30,000,000 patent licensing case against SCM. This ruling represents the second time in this lawsuit that the Court of Appeal interceded with rulings favorable to MMR, highlighting the critical role of appellate courts in ensuring the correct application of law and that justice is ultimately accomplished.
MMR also announced that on January 15, 2015, it filed three notices of appeal to begin the process of challenging recent decisions in the district court pertaining to MyMedicalRecord, Inc.'s patent infringement claims against Allscripts Healthcare Solutions, Inc. and WebMD Health Corp. & WebMD Health Services Group, Inc., amongst others. The appeals will be heard in the United States Court of Appeals for the Federal Circuit ("Federal Circuit").
The federal appeals focus on the district court's recent decisions pertaining to claims 8 through 12 of MMR's U.S. Patent No. 8,301,466 ("'466 patent") and claims 1 through 3 of MMR's U.S. Patent No. 8,498,883 ("'883 patent"). The'466 patent contains 15 claims of which only five of those claims are involved in the appeal. The '883 patent contains a total of 28 claims of which only three are involved in the appeal. MMR is committed to pursuing all avenues of review of the lower court decisions. The Federal Circuit is the only appellate-level court with jurisdiction to hear patent case appeals.
MMR's health information technology patent portfolio which, dating back to filings in 2005, currently includes 13 U.S. patents (with over 300 issued claims), 17 additional pending U.S. patent applications (with over 300 claims), nine foreign patents, including two in Australia, two in Mexico, with others in New Zealand, Singapore, Japan, South Korea, and Canada, and 25 other pending patent applications in foreign countries. (collectively, "MMR"), today announced that on Friday, December 5, 2014, the California Court of Appeal issued an Alternative Writ of Mandate, finding the trial court "erred in granting [Surgery Center Management, LLC's ("SCM")] motion for summary adjudication". The Company believes that the Court of Appeal's Alternative Order shall soon clear the way for MMR to continue pursuing its claim for as much as $30 million against SCM. It would be the second time the Court of Appeal ruled in favor of MMR in this matter. The full case would then be remanded back to the Los Angeles County Superior Court, where MMR will continue to pursue its claim for breach of contract.
The case stems from a December 9, 2011 Non-Exclusive Settlement and Patent License Agreement. SCM contracted to pay MMR an initial payment of $5 million, payable on December 23, 2011, and additional payments of $5 million per year for five consecutive years, to license certain of MMR's health IT and Personal Health Record patents covering uses of its personal and professional health IT products and services. On January 19, 2012, MyMedicalRecords, Inc. filed a lawsuit in the Superior Court of the State of California for the County of Los Angeles for breach of contract.

MMRGlobal Announces Claim Construction Order Adopts Six of Eight Plaintiff Proposed Claim Terms

(collectively, "MMR"), today announced that on September 3, 2014, a Claim Construction Order was issued in the consolidated patent infringement suits between plaintiff MyMedicalRecords, Inc., and defendant(s) Quest Diagnostics, Inc., Empty Jar, LLC f/k/a Jardogs, LLC, Allscripts Healthcare Solutions, Inc., and WebMD Health Corp. and WebMD Health Services Group. MMR now looks forward to proceeding with discovery and preparing for trial.
At issue were claim constructions for eight different terms found in either U.S. Patent No. 8,301,466 ("the '466 patent"), U.S. Patent No. 8,498,883 ("the '883 patent"), or both. Of the eight claim terms in dispute, the Court ruled that the plain and ordinary meaning should be applied to six of the terms. In its order, the Court also adopted constructions favorable to MMR for key terms in dispute with respect to the '466 patent by affording the terms of their plain and ordinary meaning. The Company believes that the Court Order affirms the relevance of the '466 patent and the Company's intellectual property portfolio.
MMR also believes the Claim Construction Order helps identify additional licensing opportunities for its 13 issued U.S. health information technology patents including its recently received Clinical Trials patent as well as in continuing its prosecution of 17 pending applications in the U.S. and 34 issued and pending health IT patents in countries of commercial interest around the world.
The order follows a consolidated Markman Hearing held in the United States District Court for the Central District of California on August 19, 2014. I bought this stock as FVRL back in the day, looking for a life changer.....it's been a long haul, but I believe it will happen.....keep the faith my friend.

Happy hour yay! Trax, I lurk this board everyday. I own an older version of this printer (i9900), the cartridges are very small and don't last very long but it does perform beautifully. If you get one, be prepared to spend quite a bit on inks, especially if you print the 13x19 paper....that's a lot of real estate to cover.
