Two things catch my eye: If Furth were involved in a DIP offer, it would necessarily have to been a "prepackaged" deal, right?

You seem to be confusing BP's generic appeal for submissions with any given company's being able to say they were contacted by BP, or otherwise have a business relationship in the works.

Insurance companies scam people alla time. Usually the state regulator steps in and conducts an investigation. If warranted, refunds to customers are ordered. Sometimes criminal charges get filed, with attendant results: some guilty, some not.
In the SEC's case, the agency also has a procedure of due process. For instance, it can no longer issue serial suspensions. You'd really be howling if the SEC simply issued a subsequent suspension each time the preceding one ended.
As far as "shutting it down" goes, the SEC can revoke the registration of stock for reporting companies (ie, with registered shares), if the company goes too long without filing required reports.

Not putting words in anybody's mouth. The company reportedly is supplying the SEC with information. If that's true, it indicates an ongoing investigation.

It's not an assumption. I've posted before that the SEC would not be directly involved in a 15c2-11 process. Therefore, there's neither reason nor mechanism for the company to be "dealing with the SEC" or "responding to the SEC" as some have reported after speaking with company officers or agents--UNLESS an investigation is ongoing.
Nothing can be shown to uphold a motion to set aside the default judgment.
The only thing that I truly know to be the absolute truth at this point is that my shares were valued at a nice price before the SEC protected me and after this so called protection my shares are not worth CRAP. Anything else that anyone says is simply an opinion since we have NO information to go on. Thanks for protecting me to death SEC.
How odd that you blame the SEC for the company's behavior.
The following is neither opinion nor advice: Following sheer logic, one can assume that the company has a significant problem in addressing its grey status--otherwise, either shareholders (and the trading public, at large) would have been updated by now.
But, no--only one middly-piddly PR, which addresses *nothing* about the elephant in the room.

RPH created the perfect setup, and now has them cornered. I trust RPH, just don't trust the system.

My son would enjoy that. About as hot as I care for is a hot jalapeno (as you know, some can be rather mild). I use chili anchos in chile, and habaneros on cabrito, along with anchos and serranos. But the "dope" evens things out and results in a cascade of flavor, without being "too hot."

I've been shocked and awed by these lil fruit trees. I grew up with gardening parents, so typical veggies on good soil is nothing new.
I'm smack dab in the upper arc of the learning curve re: amending clay soil for veggies, and am confident of further success. But these trees have got me hoping this is not some anomaly.
I'll post 'em. There's one peach tree remaining with fruit on...I forget the cultivar. But will post those, too, when the time comes. I'm happy that my "jam plam" is working--each of the three varieties are ripening at significantly different intervals: the first one had only fruit, but it was pretty large and juicy good, judging from the faces of my daughter and her boyfriend.
Of nine new trees, two plums have fruited, these peaches, and one pear tree has three on--they're late summer/early fall.

I don't *think* I really care about individual IDs. But accurate, net totals would be nice, as opposed to the confusatron we have now. (*Note* the SEC and SROs should be able to see individual IDs, at a the click of a mouse...)
Took 20 peaches off my aptly named "Harvester" this afternoon. Remember, this is one of nine first-year fruit trees. Shoot, I'm taller than the tree--without fruit it looks like something Charlie Brown would have.
