The one year term for law clerks is up next week.
Unless clerks get rehired ...and I know nothing about that aspect of things, I'd say there is an excellent chance we get our decision next week.
As Nuke points out, we are looking for the words "Reversed and Remanded".
And I sure hope we get them.
CAFC Open today???
I hadn't even realized until yesterday that Apple has never had an acquisition of over $1,000,0000.00
Perhaps we are better off with Steve stepping aside.
I wonder who the Key figure in the Nortel patent was, Cook or Jobs?
In any event, even though Apple has the cash, a 5 billion purchase of IDCC is a huge deal for them
Only 5 trading days left until ........... further speculation.
This is true ...........
but I'd rather the stock be trickling UP rather than DOWN while we wait this thing out!
Do all bidders get to SEE what others are bidding?
I am assuming the first round gets announced to all the bidders.
Will they be aware of who bid what?
It would certainly influence 2nd round bids if they see an opening bid from a "friend" or a "foe".
I mean 15 Billion???
You make NUKE sound ultra conservative!
I would have expected that the stock would have have been ratcheting higher and higher if that was where this was heading.
Certainly an 'experienced' company like Evercore would be carefully leaking that sort of info to get this thing moving.. NO???
Here's hoping you are right...
I have a completely different take.
If the story is accurate, the price is already TOO high.
We are at 65.00 bucks or 3 Billion market Cap.
The present price is certainly not too high.
So what's TOO high? (I know its a hell of a lot higher than where we are now)
Samsung didn't have a legitimate shot anyway.
I think its going to be Apple again.
And I think GOOG is just as keen as ever.
$100 in 11 trading days. That's my goal.
"the price is too high"
What's price?
That's the billion dollar question.
We'll know soon enough.

He is must be talking about the PATENT posrtion of the MMI deal.
Not the CASH (3.5 Billion) or the handset business.
Seems all of these writers are just pulling figures from thin air.
Didn't he also say that the IDCC patents were 4 % more valuable than Nortel??
What does that mean and where on earth is getting that figure from?
We will know what IDCC is worth when someone buys them.
I recently traded my car in and told the guy it was worth much more than that ...he said "so go sell it to that person and bring me back the check, I'll put it towards the new car!"
I would be happy with a $100.00 bid just after labor day.
Doesn't seem like anyone from 'the street' has a clue.
They are putting a ridiculously low value on IDCC and downplaying there being any interest in IDCC whatsoever.
We will know in a few short weeks.
These hacks are clueless. I'm clueless but I still don't see how ek and idcc continuously get mentioned in the same context.
Thankfully, in a few short weeks, the uninformed will change their tune. (hopefully).
and a negative decision would pop our balloon.
"They could always pay the $2.5B out clause to Motorola and walk away with IDCC patents, still paying the same price of 12.5Billion?"
Interesting theory....
AND The S & P could reinstate its buy recomendation, reinstate its target and speak favorable about this deal which is more in line with what Goog NEEDS anyway.
Perhaps Icahn smelled such a scam and insisted on the huge break up clause.
Us pikers are always oblivious to how these things really go.
I agree with that.
They didn't want to risk getting totally shut out.
I'd say their interest is as keen as ever but the hedged with MMI.
I don't know diddlysquwatt ....... but I don't see how MMI's outdated patent portfolio AND fall from the top ten list of pertinent patent holders makes MMI's patents even close to the value of IDCC's.
The analysts on tv sound idiotic.
How much?
Does Evercore make on this deal and how are they paid????
I added....on the spike. Perhaps the pushbak til after labor day is to let the Cafc rule (clerk leaves in august).
My $.02 is that he was under so much pressure on Monday that he felt he had to say something.
I wonder if he would be on the hot seat if he did appear on CNBC?
I get that because New Jersey wants their piece as well...and you have to pay your quarterly taxes the following year based on the previous years 'income'...
The idea of having a huge ONE TIME short term gain, and then paying estimated taxes the following year as if you are going to have those same gains every year ...sickens me.
its a scam.
<Not a happy day for all of us who held IDCC share and did not let them go in the $70+ per share as we could have.>
Not true. My basis is 40 (ish).
As a newbie with no losses to use against the gain, I would be clobbered by selling so soon.
Lets say I sold at 70.00.
That 30 gain becomes a net 15 after taxes.
I am much better off with the company at 55.00 then selling and paying that tax and losing the ability to use the account as I see fit.
Perhaps GOOG would like to conserve the CASH now and give us a STOCK deal.
Exactly.
I hate to use the words "buying opportunity" but it truly is.
idcc down 10.00 pre market
Its either GOOD or BAD.
Its bad that I didn't buy MMI ...but was going to do so.
Its good because you see what sort of valuations they are putting on IP companies.
The premium was pretty darn good.
Lets see how it plays out.
Bad = It may look like IDCC will be left at the alter.
(but only temporarily)
Judges are less inclined to issue the injunctions unless the victim actually manufacturers the product.
We saw this with Rambus. Rambus clearly met the requirements (I don't know them off hand) of the three pronged test, yet the Judge in the infringement trial allowed Hynix to cry poverty and put up an abandoned manufacturing plant as collateral to post a bond.
It was ...and remains a travesty of justice.
<I think the IDCC patents in the Nokia ITC case might be a victim of #1>
Perhaps .. but I don't think it would take the CAFC all this time just to say that.
Plus ...IDCC went back and the patents passed scrutiny with the USPTO when they amended their claims ... NO?
SO ...No Cafc YET?
Please let it be a stock deal. Pretty please!
Although the possibility that Google will partner with some of its Android partners is real, wouldn't they be better off going it alone and having more control over their newly acquired IP?
I'll take a lower price in a stock deal. When I say lower .... I'd rather take 150 in stock than 200 in cash.
As a newbie, I would face a screwing in short term taxes ......even setting that money aside, next years quarterly estimated tax payments would also be torture.
That said .... my preference is an Apple stock deal
1 share of Apple for 2 shares of IDCC.
Wishful thinking ...but not too much of a stretch.
Apple already has Samsung by the balls......imagine what they can do with this new arsenal of IDCC IP?
You probably have "near the money" option selected in the drop down menu.
That happens to me sometimes at Ameritrade.
That being said......every day at 11 am. I have had my finger on a either call options button or put options depending on what the cafc rules regarding the nok patent dispute.
If negative, I suspect it will be short lived and really have no bearing on the value of ....what I see is a 100% buy out.
I do think we have weathered yesterday's storm and the previous weeks shitty market conditions rather well......
My new plan is to simply buy a maximum amount of shares ...win or lose upon the cafc decision.
I'll get more or less....depending how that goes.
I haven't seen too many comments here about how anyone is trading that decision.....
Any comments?
Agreed. I have been flunk king the very same....that they were preparing their shareholders...not ours.
Good idea. I suppose that sort of a consortium gets us a cash deal instead of stock.
It may go so low that people will be jumping for joy when an offer is accepted at $80.00!!!
Was it you that referenced ascend communications? Do you remember how the deal was going to be valued at 83.00 per share ....... But ascend starting plunging (as did Lu). And when the deal eventually closed it was worth about 64.00 bucks a share. and people were jumping for joy!!!!!!
I think the compression patents are KEY for google.
Smartphone (or whatever you want to call it) video is still spotty, still takes forever, still incompatible with different devices....
I am not sure what IDCC has in this area ...but if they have a working solution that can handle the the problems of tomorrow (and today for that matter), I think Google would be foolish to pass them up.
I am not concerned by this weeks 'breather'. The talking heads do seem to be missing some key parts of the puzzle when trying to come up with a price.
I still don't see it going for less than Nortel.
I am of the belief that both Appl and Google are going much "all time HIGHER' with or without a deal for IDCC.
I want a stock deal ...and I don't care if its APPl or Google.
yes.
I wonder if management considers Cap gains when they are trying to come up with the 'best' deal for their shareholders????
Capital Gains .........
This better be a stock deal.
I'm don't even want to think of the check I would have to write to cover the taxes on this one.
As 'newbie' ...I'd be paying 35% to my dear Uncle Sam ..right???
Please let it be a stock deal ...that I can continue to watch.
Covered Call Strategy ...........
Is anyone considering selling Covered Calls on this baby?
