Judges are less inclined to issue the injunctions unless the victim actually manufacturers the product.

We saw this with Rambus. Rambus clearly met the requirements (I don't know them off hand) of the three pronged test, yet the Judge in the infringement trial allowed Hynix to cry poverty and put up an abandoned manufacturing plant as collateral to post a bond.

It was ...and remains a travesty of justice.
