Dude,
I personally dont know any the details of this case....
I can say with 100percent certainty that this case doesnt need or belong in us district court. That fact does not take away from the power of a judge in state court.
Not everything has to go to a federal judge to make life hell for us...in fact we might have to appeal a descision made in the current circut to a higher court and then to the federal level.
It would be foolish to discount the power of a public company with something on the line...
It would also be foolish to think that CCEL doesnt know what they are doing in court. Theyve been there enough times.
now that makes sense.
A tax write off for airfare for medical expenses. Not an insurance company paying for airfare for a non emergency.
Insurance companies dont even pay for bandaids.
you guys are nuts you never answer a question with a direct answer.
Its not in my 5-10 year plan to see insurance paying for airfare to get you anywhere for a non emergency.
thank you for your lengthy reply though.
Thank all of you for your replies as well.
the bah humbug kind that wouldnt dare challange anyone outside of a message board.
Maybe youre a big mouth woman. Idk
That sounds great.
It doesnt mean insurace covers airfare and hotels with non emergencies.
And i just want to say that all the posters that think we are in small claims court are in lala land. We are in civil court where things get expensive and long winded.
Is that a fair statement?
I only know of medical insurance paying for emergency transportation accompanied by emergency medical personnel.
Do you know of examples where insurance pays for commercial flights and hotels to visit a hospital for non emergencies?
by emergengy I mean risk of losing life, limb, or eyesight.
Thats not a good thing for new investors to read.
I love your thinking ...I only have one small comment to add to tom's point of view.
Why sell your stem cells once they're already paid for. Why not hold them "long" for life as insurance for yourself?
well ccels lawyer is from out of town and not licenced to practice in Florida. Im sure they're good and were prepared because they filed that suit awfully quickly....they were ready. Dont be fooled.
It doesnt have legs you say...I suppose we shall see.
we know that by that pro hac vice filing fee. Its to allow an outside attny to be involved in florida court.
Did you read the complaint document?
Tell me locks what exactly is the complaint and why does it not have legs?
I dont remember if you were one of the posters saying "its only circut court"
"there isnt any jurisdiction"
Well looks like there was plenty of jurisdiction seeing that there is a date to appear in court.
Civil court is dangerous and youre not an attny. I dont think you're qualified to determine if the case has legs. You havent seen the case yet.
Here for those that think circut court is a joke. This says they can try civil matter exceeding 15k dollars. We can easily end up in a higher court. Im telling you. Were talking about big companies...this isnt a domestic over common law marriage...this is court and were scheduled to appear.
Dont take it lightly
This is from the Pinellas Court page
http://www.jud6.org/GeneralPublic/AboutTheCircuit.html
The circuit court is Florida's trial court of general jurisdiction. Each of the state's 20 judicial circuits incorporates one or more counties. Circuit courts have exclusive original jurisdiction in all of the following: actions in which the matter in controversy exceeds $15,000, exclusive of interest and costs; proceedings relating to the settlement of estates; guardianship; involuntary hospitalization; determination of incapacity; and other matters concerning court of probate; in all cases in equity including all cases relating to juveniles except traffic offenses. In criminal matters, the circuit courts have original jurisdiction in all felonies and in all misdemeanors arising out of the same circumstances as a felony that is concurrently charged. Also, circuit courts preside over all cases involving the legality of tax assessment, in the actions of ejectment, in all actions involving the titles or boundaries or rights of possession of real property, and in other actions not heard by county court. Family cases such as dissolution of marriage, child custody, visitation, domestic violence, and juvenile dependency cases are all heard in the Circuit Court.
The circuit court handles appeals from the county court except those appeals that may be taken to the district court of appeal. Thirty-three circuit judges are assigned in Pinellas County and twelve circuit judges are assigned in Pasco County.
thats not true at all.
There is civil court and there is small claims court. The two are very different and in civil court yes we can get tied up.
Were throwing around small claims court but the documents I read say civil/small claims....one is a division of the other.
Im pretty sure were not in small claims court. In that court, no, they would not pass any judgement agaisnt us that would stop the deal or refer to a higher court,
However, if its in CIVIL court like I think it is...yes all those bad things are possible.
and not for nothing but mercedes could have seen this coming.
Maybe not even seen cbai coming but planned on someone coming and has a corporate attack plan for all her competitors.
In the event of an emergengy, sue. Tie up the resources immediately.
It then becomes a two front war. Ask the Germans how that worked out.
We are the Russians. Uncle Sam better hurry....we may not be running out of soldiers like in WW2, but we're running out of bullets, beans, and boots.
Corcell is or was a "florida corporation" on the sec forms.
I dont know what county, but remember CCELL has been in court a couple times. They might know a judge and thats why they went after corcell. SO they can losely tie the transaction together and get a halt on the transaction.
Im telling you....it could happen easily.
Just a possible scenario
Im not sure either. That's why im worried its going to be referred to superior court.
Time, money, focus, heartache, negative image.....
Think about what some women do to their cheating husbands. They're never done with them.
Its civil court. Whether or not its small claims court...isnt obvious to me. Small claims is a sub of the civil court system.
Cases have to start somewhere. It could always be referred to a higher court for a more powerful decision.
Im not writing off the case till I know what the case is about and where it could go...and personally I dont feel like funding attny fees over the next year.
A suit is never not a big deal. It takes focus, effort, time, money, and the overall image of being involved in a suit is negative.
Furthermore, a judge can and will stop the transaction if the court sees fit. Its pretty probable actually that a judge will allow CCEL to protect itself by suspending the transaction until both sides are heard.
Im not counting the suit out. That would be a mistake.
Last and certainly not least....enjoy your holiday feast.
i got some 47's im afraid of not getting in at all.
They are bouncing from 47 -49
The MM are trading to make the cup and handle pattern.
Today could be the pullback for the handle. Next week could shoot up more.
How do you know if anyone has givin up on cbai and moved on?
here's a question for everyone...
Is CBAI going to pop 2 bits without the mexico deal?
It seems we were on our way to the annual pop either way.
The stock finally has found a range. That is reflected by the solid support at .004 and the charts showing a change in momentum is occuring.
We can see it as losing its pulse or winding up for an explosion. Im still not sure how high this can go.
On the latest interview, matt says an extremely conservative estimate of the company with the 100k contract deal is 75-150 million. The high end ...he said has seen contracts sell for 2300 a piece which would make us worth 220m
.012 is pretty certain. Youll have a chance to cash out if you like.
I think with the deal closing without a cap structure change we can see 3-4 pennies and with continual improving Q's maybe hold it.
SunFunMoney says:
"Your bashing an American company on a chat board?? make me understand and I really want to understand ... your bashing MODS. Bashing Matt and telling the board what Matt should do to pay him self? Are you kidding me!!! "
I dont want to comment on the overall...mishap....of your above comment but I have 2 posts left and this is worth 50% to me....
Without being a smartypants.....
What are you infering when you say im doing these things to an American company on a chat board?
Deseng,
Thank you very much. I apprecite hearing that.
Its easy to forget all the people that dont post often but read regularly.
While its foolish to only consider one perspective, I would not call that person a fool. I could only encourage them to first start thinking in opposing views then start thinking in new directions.
My mark on the world is certainly not tax advice but I dont know that if you cannot blow through the bottom of the next tax bracket, there are situations where it would be more comfortable to make less in salary.
I dont know too many adults that dont understand that concept. I guess my critera for making that armchair play call was being..well....an adult.
Thank you for your support. I will continue to call it like I see it for everyone's sake.
SunFunMoney says:

Sun i think you totally missed the point. Let me explain it over less jibberish, I agree you've taken the point off track.
I like the company so much that I have 16k invested in it.
Locks said matt should get a raise.
I said he is being paid a fair salary.
Now, in saying fair salary, I mean that his salary is fair. In this situation...I would say no salary raise yet.
I do agree with 30% cash bonuses every year though. That is where the merit recognition comes from. Not a raise every year.
So...let me ask it maybe a 4th time.
Let me ask it another way maybe itll register this time....
What is a fair salary for the CEO of CBAI?
SunFunMoney,
Youre not thinking clearly. What does tax information have to do with my mark on the world?
Hardly seems connected.
Sun,
Should we meet one day in vegas perhaps youll have the chance to ask me what mark ive left on the world.
If I think youre good enough, Ill offer you a chair to sit down so you can learn a thing or two about perspective.
Ask matt what tax bracket he is in and how much more cash in the form of salary would tip him into the next bracket.
I bet he knows the answer and if you dont think that sometimes the tax hurts more than it helps youre not thinking at all.
I dont claim to be a tax or financial know it all. I know very little about it but Im not afraid to call it out when I have an answer.
Furthermore
When an opinion is offered and I counter....I hardly think that is armchair quarterbacking.
That response makes me feel even more that some on this board are blinded by love. He has every single dime of the companies money protected by the bankruptcy laws of being incorporated.
There is a reason for the high risk disclaimer on the sec filings.
Its because there isnt any liquidity for shareholders right now.
Get real
Well the pricipals of rewarding hard work are very well known to me.
THey fall under the basic pricipals of leadership. You must make public recognition of people who deserve it.
I have an entire decade of military experience to back that up.
You said matt needs a merit raise.
I say matt gets a merit bonus of up to 30% and a very nice salary of 165k with guaranteed 5% raise. Id say he very comfortable for now.
Thats his merit recognition.
What kind of raise do the three of you think matt should have at this point?
Is my math all wrong to say that...
11m shares at the time of the 7m dollar settlement would mean every shareholder got something like .63 cents as an agreed settlement?
I never said he makes alot of money.
I said he gets a raise. EVERY YEAR. 5% and 30% bonus. Thats over 200k a year plus stock.
and his household income is being funded by us and his wife's income....which is being funded by us too.
Wall St is kicking 8000 people to the curb. The buisness market couldnt be more crowded.
Lets look at his contribution to people around him
Matt isnt creating any significant amount of jobs.
Matt isnt making shareholders money yet.
The company is in debt.
Youve seen nothing from your investment so far.
Matt might be getting sued. You have no idea what the details are. It could anything.
Hes doing all these super awesome things and im on it and support that. Let him keep making what he's making becuase id say thats a fair salary for a infant toddler baby company and when we grow up and start wearing big boy britches...matt can too.
oh and I got another angle you probably didnt consider...
Matt doesnt want too much more money in the form of cash salary. Its going to change his tax bracket.
Mark this post over the years and see if matt continues to stay low key for a while longer till he can justify building out the executive benefits.
Ask matt if he wants his personal portfolio to take a tax hike.
Matt schissler, What is the maximum amount of cash salary you wish to receive based on your tax preferences?
Matt schissler, isnt it true that merit is acknowleged in the form of a cash bonus at 30% of your salary?
Matt schissler, isnt it true that while you could justify a higher salary, its not really the right thing to do?
Ha. eat it
I never said he makes alot of money.

I dont like tattles posting but I have to agree that some of you are in la la land
You are way ahead of yourself. You are not valued at more than a couple pennies and youre telling me the CEO needs more money cause he's doing such a good job.
You sound like a butt kisser...
We keep chipping away at the facts here and youre all rose colored. You have to play both sides here. We are always going to be on the outside of the company. You have no idea what could and is going on behind the scenes.
Dont be a sheep.
I think youve invested entirely too much in the this company at this point and you have no choice but to toot it. Youre stubborn and thats the way it is. Dont make yourself out to be an insider or that you have some sort of insight.
The fact is you rarely respond with the good intentions of making people aware of facts. Your response is usually some kind of tit for tat with this condescending overtone.
Why dont you start explaining YOURSELF locks....and please dont tell me that youre involved in that bs joeyoreganomikeramos crap atyahoo
oh great selective copy and paste guy
Reminds me of on of Michael Moore's "Films"
he will get a raise....every year he gets a raise and stock.
Matt doesnt need more money till we get more money. Dont get all ahead of yourself.
youre more optimistic than me.
I see gains but I dont see retiring off of 1million shares. Not a chance in hell.
How many shares does it take to do that....lead the way..
oh totally
Thats the first thing I thought when CBAI hit CCELL after a tit for tat statement with DWHP
Not for nothing but this could be the market consolidation you are talking about with a huge stunt intended to create some industry news as well as pull out in front of the world as the new little guy running up to the front of the pack...
The thing is..as the little guy get closer and closer..you realize....he aint so little...
Nothing like creating some news in the Cord Blood Banking industry that affects 3 big companies and puts us in the top for real this time.
I want to know how much money DWHP wants to lend us.
Hey whats up with celegene
I noticed just early this morning that Celgene purchased a placenta collection company in 2002 I believe. They were way ahead of the game.
When you say all aboard choo choo I think of the fat kid from the latest Shrek movie.
Do the roar..
Make him do the roar dad!
Do the roar!
Do it...
There you go...merger and issuance of new shares. Less of them hopefully.
But can we still remain qualified to uplist if change symbols? Wasnt the point of reporting consistantly to the sec to uplist into the NYSE?
Celgene purchached a placental stem cell collection company in 2002. They might be one of the best biopharm grow companies out there. (btw Cel-Sci ticker CVM is going to be as big as Celgene and extremely undervalued at .80c check it out!)
On December 31, 2002, we acquired Anthrogenesis Corp., or Celgene Cellular
Therapeutics, a privately held New Jersey-based biotherapeutics company and cord
blood banking business, which is developing the technology for the recovery of
stem cells from human placental tissues following the completion of full-term,
successful pregnancies. Celgene Cellular Therapeutics, or CCT, now operates as a
wholly owned subsidiary of Celgene Corporation.
