.... ratchet up here above $7 and start using $7 (instead of $6) as a support base.
Interesting that volume has been dropping more-or-less since 7/7 .... but the PPS has been moving up.

If NEOM could close above .0032 or so today ....
.... it would still be in a short-term uptrend.
RSI staying above 50 , that's something we haven't seen in a while.
It sure does look like selling overpowering buying every time the PPS gets up a bit though.
Acc/Dis looks like distribution remains the overriding theme , but I have posted in the past how that indicator can be faked out. Not much else indicator-wise looks very good , 'course in a stock like this news trumps TA for the most part.
Real news including at least a teensy bit of talk about revenues , that is.

SEC, others, to probe short seller manipulation

NEW YORK (MarketWatch) The U.S. Securities and Exchange Commission said Sunday that it and other regulators are firing up new examinations to prevent stock-price maniplation by short sellers and others.
The agencies' goal is the "prevention of the intentional spread of false information intended to manipulate securities prices."
The SEC said these examinations are in addition to the commission's enforcement investigations into alleged intentional securities price-fixing "through rumor-mongering and abusive short-selling that are already underway."
The examination will be conducted by the SEC, New York Stock Exchange regulators and the Financial Industry Regulatory Authority (FINRA)

DAILY CHART
The day isn't over yet but at the moment it looks like we could add another green day to the week , and on continued steady volume.
The indicators are a mixed bag , on the whole looking more positive , or at least moving in a positive direction , than they look negative.
We seem to be hanging in at the upper part of that little ascending triangle .... but we're not exactly attacking it.
In spite of the general 'could look really positive soon' appearance of the chart ... the Acc/Dis line continues to imply marked distribution of the stock with continued selling pressure. Except for the Bena-fueled pop a while back , it has looked that way since the beginning of April.

Well , the 'D' is for 'Direct' ...
... and that is the logical choice between Direct and Indirect in that box.
But the -0- in that box says no derivative securities (options) were owned following the transaction ... so what does that mean is the question IMO.
I still can't figure out where the 20MM comes from.
He could have been awarded 5MM per the Initial Option at the end of 2007 and 5MM per the Bonus Option at the end of 2007.
Then he could have been awarded half of the remaining balance of 15MM Initial Option shares upon leaving , for another 7.5MM.
That adds up to 17.5MM options.
Am I missing something? These guys usually aren't guilty of 'bad math' lol.
At least we learned what the options strike prices were , as I don't think that number was included in the original employment agreement.
Those options had strike prices at .035, so at least Yorkville wasn't giving millions of 'cheap options' as CH would have to
have gotten the PPS up 10X higher than where it is today to begin seeing green from an options conversion.
It's amazing that a simple Form 4 has to have ambiguity in it.
Why N/A in relevant categories like Exercisable Date and Expiration Date? I imagine that someone knows what N/A in those boxes implies.

Above description? The 'above description' doesn't quite spell it out to the average layperson IMO.
Options Awards usually say 'Option Award' .... not 'Other'.
'Expirations' usually say 'Expiration'.
I just think this filing is ambiguous. In the big picture it probably doesn't matter as whether it's 20MM or 17.5MM or expired or awarded isn't going to affect our share price going forward LOL.
But in the interest of clarity it would be nice if it was , well , clear ;)

Since it's a Monthly chart I arbitrarily provided several time frames for CMF and RSI. Note the shortest ones , CMF(2) and RSI(2) , and my annotations on those.
Still , CMF at all settings is in very bearish territory and indicative of strong persistent selling pressure. RSI peeked up just now , but we had a rumor and a pop that yanked that up ... the month isn't over yet.
Acc/Dis looks simply miserable.

Totaling 14 green days & 5 red days.
We haven't seen that in a while.
It looks like , on average , higher volumes on green days than on red days.
And we're still in that ascending triangle.

2008 RUSSELL-TIME-FRAME PPS + VOL + SHORT INT.
re: SHORT INTEREST
TIV's PPS on 6/10 , the day prior to the most recent short interest reporting period , was $5.97
Then between 6/11 and 6/25 we saw the PPS move up to as high as $9.73 , with hundreds of thousands of shares trading , and then close at $7.50 on 6/25 , the last day in this reporting period ... which was two days before the actual Russell Recon. Day.
During the 5 days when TIV was trading in the $9's over 2.5 million shares traded.
Makes it look pretty easy for some shorts to get off another quarter million shares short ... and the quarter million may well have been limited by difficulty in getting locates on shares to short.
Now we have to wait another two weeks to see what the short interest is today , 7/10 , as the period from 6/26 through 7/10 is what will be covered in the next short interest report which will be published on 7/24.
In that report we'll perhaps get to see if short interest took another jump up on Russell Recon. Day itself , with shorts perhaps selling to Russell buyers?
It's too bad there will be nearly two weeks of trading after Russell Recon. Day covered in the next report , during which time some covering might have taken place.
I wonder when/if the rules will change and we'll be able to see , on a day to day basis , which trades are short sales or short covering , and see a running tally on the short interest and how it changes relative to various events.

No , I wouldn't think that at all. He could buy shares cheaper than that on the open market if he had a mind to.
YJ's thought about expiration is probably the closest to the correct answer ... although I couldn't make the numbers add up to 20MM based on what CH should have received ... and as I said in another post , I've seen filings regarding options expirations and they simply say ... they expired , like the Form 4 shown below for Chas' expired warrants a while back.
No biggie , I was just curious as to what actually transpired. It certainly was filed late for a 5/22 transaction.

I may not have seen everything there was to see on NEOM's website. When I looked at the drop down menu for D&O's it only showed Iain and JJ. However I see that when clicking on the D&O 'button' it goes to a page which still shows GO and JJ.
'course, that same page still shows Dr. Steinborn as COO , although we did see this in an 8-K:
"The Board accepted the amicable resignation of Dr. Christian Steinborn as Chief Operating Officer of the Company, effective June 11, 2008. The Company does not intend to fill the vacancy in the office of Chief Operating Officer at this time."
But you probably raise a good point , G.O. may still be around.

YJ, I think that's probably the case.
I am still trying to figure out how Chip had 20MM options TO do ANYthing with.
The answer to that can perhaps be found in the below from his employment contract , but I'm not sure because non of those terms would seem to add up to Chip having control over 20MM options in June of 2008.
The first case would seem to add up to 40MM , and the second would add up to perhaps 10MM. Ah, wait, he probably already got 5MM options from both (b) and (c) at the end of 2007 , for a total of 10MM. Then per (c) he would have "one half (½) of any remaining portion of the Unvested Initial Option to immediately become vested and exercisable".
The only problem there is, if he already got 5MM of those , one half of the remaining 15MM would only be 7.5MM.
Oh well, the elusive 2.5MM? lol , no biggie I suppose.
We've seen 'expired options' before and typically the form says 'expired'. So perhaps that leaves a little wiggle room as to what that filing is really about. Why would these options expire? Because it wouldn't make sense to exercise them at the current PPS?

I recall Chip having two ways to get 20,000,000 options:
(i) Initial Option Grant. The Executive shall be granted on the Effective Date, an option to purchase 20,000,000 shares of the Company’s Common Stock (the “Initial Option”). The shares covered by the Initial Option, if immediately exercisable, would constitute one and one-tenth percent (1.1%) of the outstanding Common Stock of the Company on a fully diluted basis as of the date of grant. The shares covered by the Performance Option, if immediately exercisable, would constitute one and one-tenth percent (1.1%) of the outstanding Common Stock of the Company on a fully diluted basis as of the date of grant. The Performance Option shall be granted within two (2) weeks of the Company’s filing of its Annual Report on Form 10-K for the applicable fiscal year, which shall include the Company’s annual audited financial statements for such fiscal year. For performance greater than or equal to 80% of the agreed upon performance objectives, options shall be granted on a pro rata basis (i.e. 40% of options for 80% of performance goals). The Performance Option shall be vested and exercisable as of its date of grant. For the portion of the Performance Option that relates to the Company’s fiscal 2007 year, the Executive will be granted 5,000,000 options, of which one half (½) shall be based upon the agreed upon operating plan with respect to revenue and operating profit, and one half (½) shall be guaranteed if the Executive shall be employed by the Company as of December 31, 2007.
Both of those would have taken 4 years before either of them could have generated options to buy 20,000,000 shares , so the two together would still have taken two years.
Was there another way for Chip to have some control over 20,000,000 shares , to either convert , or let expire , or anything else?

No , I'm afraid I'm solely responsible for it ...
... and they have actually all tried really hard to keep things legal. Filings are painstakingly comprehensive and reflect the amount of money paid to insure their accuracy. I and others have only found 4 or 5 possible errors/failings in those efforts.

You know , I would update that graphic showing connections between Yorkville & Friends and Clients and Neomedia and Helpers just as you suggest but for three things:
- If I include a pic of Al , I'd soon have to include a pic of everyone else on there and there simply won't be room
- I don't have a pic of Al
- I think the major players are all adequately depicted.

p.s. I don't think there were actually any revelations lately raising the importance of "ole Al" as you call him. I merely answered the question another poster posed to me related to a 2-3 months old post of mine. You might ask him what prompted him to reference that post.

He took FMDAY down from a couple bucks to around a dime and got them de-listed from the Naz.
It appears he has left the Neomedia Board of Directors with nary a word from the company , after 'turning us around' kind of like a drill augers into the ground and collecting around a quarter million bucks for his efforts. Wouldn't the departure of a BoD member warrant at least an 8-K? Mention of his departure could have been included in the 8-K about Chip's and Frank's ouster , at no extra cost. Maybe I missed it.

Neomedia as a Yorkville Client is certainly one piece of a 'network' I've never seen the likes of before. The connections between all the players who have learned how to game the otcbb system for their own financial gain ... at the expense of shareholders/investors in publicly traded companies ... are simply amazing IMO.

That was a different subject entirely from your "this patent update" , but a valid subject , as that has to be a concern discussed/addressed at least briefly , at least one time , when you have an otcbb company for which 'patents' have been a significant factor and for which no good has come of them to shareholders other than some free 'licensing' or whatever that was to Virgin who took the easy way out ... free , and whatever little we got out of any other patent litigation.
I'm sorry that my asking B.E. for his 'inside' former-NEOM-employee opinion on the subject , and his subsequent 'clearing of that air' , causes any discomfort but that doesn't invalidate it as a bona fide topic of discussion , especially when it is asked of someone who could well have intimate and detailed knowledge of the subject matter.
Or are you talking about the fact that I was the first person to post the USPTO's most recent action and I have voiced my opinion on the meaning of it?

My opinion differs from yours on that subject , but that doesn't mean you don't have the perfect right to express your opinion , just as I do to express mine.
IMO it is a VERY big deal.
Every one of those 95 claims was REJECTED by the USPTO upon reexamination.
If every one of those claims had been upheld this would have been touted as a GREAT thing to the high heavens! Logically then , if they are REJECTED , even in a non-final action , it has to be a BAD thing ... IMO.
Some are of the opinion that it is merely a procedural thing , or SOP , or USPTO 'rubber stamping EFF's reexam request' ... personally I think those are illogical interpretations of what just happened.
If the USPTO was going to 'rubber stamp' anything and if that was really what this was all about ... they could have done that long ago , months ago in fact. I for one don't think the USPTO is in the business of 'rubber stamping' anyone's re-exam requests.
It looks to me like Anjan Deb spent a LOT more time than just cursory 'procedural stuff' here , he provided very detailed and logical rationale for the rejection of each and every one of those 95 claims. But that's just my opinion.
As to 'hashing this to death' , have you ever thought that if I didn't receive so many contrary responses to my statements of my opinions on this subject , like the one I am replying to , statements in which I provide my substantiations of why I said what I said in each of my posts on the subject ... that there would be less of an opportunity for any 'hashing'?
Just because I am a shareholder doesn't mean I am going to 'post to my position' as I believe it is called. What's the point of that? I prefer to engage in logical debate on issues/events as they arise. Whether the logical / rational discussion takes things to a positive note or a negative note is immaterial ... in my opinion.
