I noticed that Rite-Aid has 4,700 stores and Wal-Mart has about 8,500. I know that Wal-Mart has a bigger name, but it has less than twice as many stores as Rite-Aid, if the figures posted are accurate. So, Rite-Aid is a big deal indeed. Wal-Mart is a bigger deal and a higher profile company, but it is not necessarily the blockbuster many here are pinning their hopes on. However, Walmart is a leader and hopefully if that deal comes through, many other reatilers will follow like dominos.The posting about the Rite-Aid deal seems pretty firm, so I am optimistic that it should occur, but with the caveat that one never knows in pinkyland.

Gyspsy, first, I want to say that the way you spell your screen name is just fine with me, LOL. Regarding the trustee, although it would give me more comfort for SS to agree on the trustee, I still am very cautious; would prefer to not see this in outside hands in view of our experiences and various pressures here. Interestingly, the trustee on the Madoff case, Irving Picard, seems to be doing a good job there. I would put the most trust in our EC attorneys and would prefer to see them litigate, although that will likely take more time. Although many are understandably impatient after all this time, I am willing to wait for a just and proper result At this point, I would rather not put our fate in an unknown entity.

Since we have been let down by so many people in this case, why should we expect a different result from a trustee?
I don't expect a quick decision. That doesn't mean that the judge's carefully thought out decision necessarily favors the POR. I thought that the hearings went very well for us, but we are all speculating about the outcome here. If justice is rendered, we should prevail. Ilene did a great service to our board today by her brave and articulate testimony, and she can be proud as are all of us.
Ilenes, first I want to thank you for the invaluable input you have given to our board. Regarding your testimony tomorrow, you are getting much input, sometimes conflicting. I am concerned about asking for a Trustee in light of the examiner's findings. To me, the most important item lacking in this case is the asset valuation and lack of exact asset figures. In real estate, the most important issue is location, location, location. In this case, IMO, the most important issue at this juncture is assets, assets, assets. Good luck tomorrow, you will represent us well.
When is this asset valuation hearing?
I don't think she is ruling on the POR tomorrow. I think that all along she has wanted a settlement rather than ruling, which is understandable in view of the pressures of this case. However, it appears that there is little, if any, desire on the part of JPM or FDIC to settle, it's been stall, stall, stall. If we have no assets in evidence for our side, in that absence they have the advantage, IMO. A trial is risky, and our best interest would be served by a fair and equitable settlement, if possible. We are in the right, but unfortunately the right doesn't always win.
What later date? I thought PJS was one of our most important witnesses. Time is running out here, postponing his appearance doesn't make sense to me. If we appeal and go to trial, this could take several more years.

The longer this goes, the more witnesses on the stand, the better it is for us. No rush when we have them on the ropes. The truth will set us free, morally and hopefully financially. We all deserve it, and thanks to Ilenes, Fish, Uzual and many others who have been tenacious and steadfast for us all.
In a perfect world, you are correct. I think that this is likely to have to go to appeal. I sure hope that I am wrong.

How long does it take to prepare and file the 101, and can that be done immediately after the 30 days of drilling? Also, how long does it take to get the approval of the 101 after filing? TIA
