CPD is not suing PSNH or Laidlaw
LLEG does not have a PPA, they have an agreement of terms that still need to be made into a PPA then approved by the PUC. It’s been 2 years and counting.
The mill is in the process of being sold and that sale is more likely because CPD is offering steam. Steam is more beneficial to the mill then the hot according to mill employees.
LLEG does not have their financing as stated by Bartoszek in Berlin.
Laidlaw has no provisions to provide steam or hot water to the City or any business other then hot water to the mill.
CPD owns the land, has all their permits and is making preparations to begin construction. Which means they must be close to a PPA and financing.
CPD is ahead of Laidlaw in the ISO queue.
FERC denied another part of the PSNH request and grandfathered Clean Power Development so any exemption will not affect them.
“Specifically, this week’s ruling by FERC has confirmed that PSNH retains its obligation to purchase the electrical output of CPD’s Berlin, NH facility"
How do you know?

SamDan you are free to base your investment on all the misinformation you like. But the facts are the facts. Without a PPA they will not get financing and will not get a permit. I heard MB tell the EFSEC committee they were working on getting financing. He also does not know who the owners of the property are. Interesting huh?
Just doing my part to help clarify the endless stream of misinformation found here for those who want to base their investment decisions on fact.
You are mistaken, SEC will not issue a permit until they have a PPA because without a PPA they have no financing and without financing they have no project. Additionally the PUC would need to approve any such PPA. That in itself could take months.
Laidlaw DOES NOT have an agreement with PSNH, they are simply “talking” to them.
Kind of makes you wonder where your money is going huh?
Oh well, it was only money you can afford to lose anyway right? Otherwise why invest in penny stocks? Right?
Keep your chin up though; there is always the next PR to look forward to.

Preliminary Statement
This matter arises out of the design of a biomass energy power station in Berlin, New Hampshire (the “Project”). The Project is being developed by the defendant, Laidlaw Berlin Biopower, LLC (“Laidlaw”). On or about July 17, 2007, the plaintiff, Waldron Engineering & Construction, Inc. (“Waldron”) entered into a written agreement with Laidlaw (“Agreement”) to perform engineering services for the Project. A copy of the Parties’ July 17, 2007 Agreement is annexed hereto as Exhibit A. In accordance with its obligations under the Agreement, Waldron performed a significant amount of engineering work for Laidlaw over a period of 2-1/2 years. During that time, Laidlaw accepted the benefit of Waldron’s services and used Waldron’s work product to acquire land, apply for Project permits and obtain Project development financing. At no time did Laidlaw ever complain about Waldron’s services. Nevertheless, in or about February 2010, Laidlaw advised Waldron in writing that the Parties’ Agreement was “never formed” and that in its view; the matter was “closed”.
PSNH Vice President of Energy Delivery stated that PSNH has neither a contract or a term sheet with Laidlaw. Simply that they are talking, which is something they do on a regular basis with anyone who would like to sell them power. MB spun it into a “20 year deal” when in fact it is nothing more then a cordial conversation that takes place on a regular basis with anyone who would like to sell them power.
Going, going....it likely won’t be long before it’s gone. With no one to sell hot water to, and no plans from Laidlaw to accommodate business around the boiler, they too will go the way of paper mills in the North Country. With the only difference being that they won’t be missed.

The false assumption is that this proposed project is worthy and beneficial when in reality it is quite the opposite. But then there is not much about Laidlaw that equates to reality IMO.
Except that in 10 years they have never produced 1 MW of power.
Like the saying goes, you can justify anything if you try hard enough. Your post proves that.

Didn’t he and his followers end up wondering around the desert for 40 years waiting for answers? In that regard the similarities to Laidlaw are remarkable.
I agree scoty nice letter, and more to come. This is the point when reality begins to set in, so you may want to get use to hearing just the facts. Because unlike LLEG investors, most people like to hear the facts. After all, denial isn’t a river in Egypt.

It’s clear you are dismissive of any information not coming exclusively from MB “Sage of Florida”. Do you have proof of cash inflowing from the JV? Because last I saw dilution was still happening. How about those “new projects” coming through? Got proof of those happening other then MB’s word?
Perhaps you should take your own advice and get your ear out of the keyhole. The heat in Florida is obviously making it difficult to reason.
I really don’t mind helping you with your dd Gman. I understand it can be difficult to know what is being said on the streets and at meetings here in Berlin when you don’t live here. I recall a post that stated that the new mayor was obviously supportive of the previous council's choice of attorneys. I believe that we determined that that was a very misleading post.

I cannot say it any clearer then this for you. Those who support Laidlaw have the most to gain financially and they will have to check with SEC to see if they will be able to voice their support in order to reap the financial rewards they seek.

I am not sure I will be able to help you comprehend how the process works Gman. I suggest you check the SEC site for answers on who will be permitted to be heard. I agree those who support Laidlaw will be the ones who will “reap some sort of financial gain”.

Thank you for agreeing with me Gman. I thought you might. Yes majority rule. IMO the election proved that a majority of residents remain opposed to biomass on the mill site by the fact that those opposing the Laidlaw project were reelected and remain a majority. And the fact that the attorney hired by the previous Council remains on board protecting the City’s interest by exposing issues Laidlaw will not be able to overcome.
One for the City, Zero for Laidlaw.
Sorry I ruffled your feathers Matt. I certainly understand why you don’t like to hear the reality that Berlin will expose issues that Laidlaw rather not deal with. But the fact remains that Laidlaw will not be coming to Berlin because they cannot address the issues that will be raised.

Apparently Matt doesn’t fully comprehend the significance of why the previous Mayor and Council hired this particular attorney. It is news to those that hoped the new Mayor would fire the attorney (not that he could) hired by the previous Mayor and Council. The new Mayor obviously supports the previous Councils choice of an attorney whose specialty is environmental issues and has a reputation of going after PSNH. Yes in this case I do believe intervene does mean interfere.

The city council voted back in May to file as an intervenor when the Laidlaw project came before the SEC for its certificate. The city at that time hired Peress of the Lebanon law firm of Downs, Rachlin, Martin to represent it throughout the process. Peress specializes in environmental law and has extensive experience in electric generation and environmental permitting.“
Nice to see the new Mayor supports the decision of the previous Mayor and Council to hire someone who has experience in electric generation and environmental permitting. I hear he also has a reputation for going after PSNH. Watch for additional influential opponents of Laidlaw to seek intervener status.
Noble is moving forward with their wind farm and CPD may break ground this spring. All major issues for Laidlaw. The PPS is likely to continue falling as this process unfolds and reveals the projects shortcomings. IMO.
I expected as much. Which is why I also posted it on another forum everyone here reads because they know this forum is censored by the MSS.
