City petitions to be intervenor in Laidlaw proceedings

“In the city’s motion, Peress argues Berlin “is a steward of the economic, environmental, public health, and welfare interests of the city and its residents”.
He said those interests include the appropriate uses of land within the city and the orderly development of the region. Peress wrote that because the proposed biomass plant would be located near the downtown, Berlin has both a substantial and a unique interest in the outcome of the proceedings. That interest, he said will not be protected by other parties to the proceedings.

The city council voted back in May to file as an intervenor when the Laidlaw project came before the SEC for its certificate. The city at that time hired Peress of the Lebanon law firm of Downs, Rachlin, Martin to represent it throughout the process. Peress specializes in environmental law and has extensive experience in electric generation and environmental permitting.“

Nice to see the new Mayor supports the decision of the previous Mayor and Council to hire someone who has experience in electric generation and environmental permitting. I hear he also has a reputation for going after PSNH. Watch for additional influential opponents of Laidlaw to seek intervener status.

Noble is moving forward with their wind farm and CPD may break ground this spring. All major issues for Laidlaw. The PPS is likely to continue falling as this process unfolds and reveals the projects shortcomings. IMO.
