I wished all Good luck the other day, I'm still not sure how much good luck we got. I suppose the answer is 50/50. We have lost that near term income the company really needed. However, it was a small population anyway. The real money is in Muscular Distrophy, AIDS, and insulin resistance, but these are years off before revenue can be found.
What is interesting and implicitly woven into the settlement statement is TRCA and DNA's buy opt in ability. This is confirmation of the likely outcome of these future indications. I don't think the market is going to like this news tomorrow, but we must have been facing injunction and future litigation or management would have never taken this deal. It's like cutting off your arm to free yourself from a burning car wreck. Take injury to preserve life and maybe to someday go on to greatness.

Too many opinions are toss about and the result is opinions begin to sound like likely outcomes. Remember during the trial, how many longs gave the opinion that an injunction was off the table, an out of the question thing. It took on a life of its own and became a forgone conclusion that even if we lost worse case 15% and no injunction, no way. What a bunch of faloopy that all was.
He is right this is all still up in the air and no conclusion can be drawn by the delay. The 12 million share day a few back, that's interesting. Exactly what was it, hard to say. The Ny times article, possible Eu approval, possible Eu partner, possibility of the delay meaning something. All very hard to see or say and be sure.
I for one am in and a holding. If this goes well and we hit $2, I'm out. It's been 3 years, and it still ain't gone to the moon, and Alice, I'm afraid this one is just another of my hair brain scheems and big dreaming.

No one has a christal ball, and it is impossible to accurately judge what will happen in Feb. when the judge's decision comes down. This is a highly speculative decision, and you should be fully prepaired for the consequences if it goes against us. I am in this and well underwater. I have, IMHO, no choice but to see this out, for I would kick myself forever if I sold and no injunction materialized. INSM has a lot going for it, and, at this moment, it has a lot going against it.

Does anyone out there have any kind of clear idea when we will definitively hear the judge's decision on injunction? I remember someone writing one month or two? is this correct? I don't have the time to call the company.
Though I must admit I was surprised be the verdic, I was blindsided by the possibility of injunction which is now a possibility. If we dodge that, all will heal with time, news, and new indications. Dear God!

I must say, I'm not so happy with this outcome. I kind of had it figured in my folish mind that the great length of time the jury was in deliberation for, ment a great deal of indecision was present in some jury members minds and that this would work for us in some mannor. Guess I was dead wrong on that theory.

I was told by other posters this could not happen. I'm not happy to say I was correct

I don't think this run will hold unless there is an outright win, some real news that follows, and some new sources of news coverage on INSM. The fact is many institutional or not have laid money on this in the last 5 days for a quick turn over of 50% + or -. These kinds of investors are not longs. True institutional longs and retail longs as new investors or new capital will only come when this is over, with more positive developments, and new news sources that can spread the good word about INSM, which is still very much an unknown to many.

Well it seems we are on the eve of seeing some result to the trial. At least that's what today selling said to me. I get the impression that the jury is moving piece by piece through this is a methodical way, and I think this will result in INSM getting tagged for some royalities. I think we would have seen a verdict by Tue. if it had been a slam dunk acquitial. I hope I'm wrong and we get off scott free, but I don't think the odds are with us. Thus, I think it will be back to 1.20 in no time flat when the ruling comes out. I would like very much to be wrong. Perhaps a partner in the wings announce after the trial conclusion will stabilize the situation. Just my humble opinion that I really want to be proven incorrect.

Several weeks ago, someone found and posted a doc. from the Vet. Admin. stating that INSM had been awarded, I think it was, a 7mil contract for IPLEX. This never received a PR. Can you explain what this was, when the revenue will flow to INSM, and if or how it affects 2006 sales?

I agree with your observation that the big boys think the case is going well for INSM. Since INSM started its defence the volume has increased substantially and our pps. has also increase by approx. 30%. Some of this is undoubtedly retail investors who have held out as long as possible and are willing to roll the bones as holding out any longer could leave them shut out if a positive settlement is made, which could come at any time if it does at all. Thus, retail investors are climbing on board;however, institutions and big boy investors must be a part of this as well because, IMHO, the volume is too great for retail investors alone. Institutions and big boy types must have eyes and ears in the courtroom, and the reports must have been favorable because the volume indicates someone wants in now bad, and the blocks are just too large and the volume just too heavy to be folks like you and me. JMHO

He explained it was a busy time, and I expect, like most of us, is just lurking as speculation where facts are thin is probably more harmful than good. I like zake's take. The next 45 days are very significant. It is impossible to predict the outcome of this trial, but more announcements once it is over are, it seems, likely.

So, this was written by an INSM lawyer to summarize why judgment should be entered in INSM's favor and was submitted to the judge for consideration or will be submitted to the jury for consideration? or is it just lawyer paperwork as part of the process and trial requirements. Thus, although the document is convincing and interesting, its context and use is what's lacking and really matters as to it significance.
Can you elaborate on the documents purpose, use, and audience?

I appriciate your opinion on BP3, and it makes sense. One would think if something was there, INSM would have partnered it, as going it alone is cost prohibitive.
If I may ask, you are a man of some experience in biotech. What do you feel of our current situation? Do you think this will get settled or actually go to trial? If we really loose, is it at max a 5-10% royality and no chance much of an injunction? Why haven't we yet seen a European partner? Is INSM going to smash TRCA in sales as so many here seem to feel is about to become evident in the next few quarters? How do you feel about Muscular Distrophy and Insulin resistance as successful clinical trial outcomes? I for one feel Muscular Distrophy data should be out very soon, and I'm hopping it is positive, as I don't think the Muscular Distrophy Association and the National Instute of Health would have pumped millions into this research if the outcome was not forgone.
I realized I have asked many a question and some big ones, and I'm not in your knowledge class. I only seek opinion and knowledge, as being invested in this sock has been such a great learning expeience. I have held 9k shares for about 3 years now, and for me that's a lot. I believe this will hit $5+ if the suit gets settled in a positive manor, INSM does pull ahead in sales, and Muscular Distrophy going for approval in the future is a likely reality. What of you?

I see much that's positive ahead, though having been burned by TRCA's unspeakable tatics, I am always leary of what could be up their sleev, a sleev you can be sure TRCA management is turning inside out right now for any crap they can further fling at INSM. They must be desperate, and desperate men can get creative.
I must think this way, as if I allow myself to drift off into profit happy land where sweet music plays, I will have to kick myself and eat my hat when the sound of war interrupts.

I added yesterday 10 min. before the close. IMHO, and it's just that, this acheivement should be the beginning of a new uptrend, that will pick up speed as pr's flow, revenue is exposed, and predictions are made.

This is not correct. Eports have a one time install/sale profit and monthly reoccuring revenue because when an Eport is installed it must be also hooked up to USALive, USAT's credit card processing and machine monitoring system. The real idea is to get enough macines on USALive to gennerate positive revenue from monthly service fees.

No I'm saying ustt management has a history of rewarding themselves nicely for a job poorly done and selling the shit out of warnents and shares to whomever at rediculously low prices to prop the whole thing up and keep it a going so management may prosper on the backs of investors. Perhaps Wellington and company can get a leash on management and keep them behaved long enough for this to become a real stock after the reverse split. When Wellington and company are done and have taken their profits, current management will go back to its old modous of operanda

well that's about as long as I've been in. Remember when it made that first run in early 04 to 0.65? I made some twice on the way up to that, but ended up buying much around o.35 and never thought we'd see 0.10. So how do you feel about the reverse split?

USTT has much to overcome in credibility. Many a deal have fallen through, and many a times management has rewarded it self for a job well done, when really profitibility was far off in the distance. As a pennie stock USTT does have runs every so often. As an eleven dollar stock? I don't know.
I know I sound negitive, but I'm long on USTT with about 90000 shares that are well underwater. This company may well deliver if Master Card helps them push the big vending corps to adopt this technology, "if" Management, must change or change its attatude and start putting the common share holder first ahead of them.
