So now we know that Chuck is finally going to lay his cards on the table tomorrow
But that doesn’t necessarily mean that Chuck’s bill will be the first to cross the finish line
The SAFE Banking Act remains the lowest hanging fruit amongst all cannabis legalization bills (it’s already passed the House multiple times and probably has 60 votes in the Senate), so we could still wind up seeing it advance on its own in the Senate
On the other hand, Chuck could attach The SAFE Banking Act to his MJ Decriminalization/Legalization Bill with the goal of using cannabis banking as the sweetener for federal legalization
Here’s some good analysis about several of the legislative options on the table and what we could see happen moving forward:

There is more money in CBD-infused Foods & Beverages than anything else, and because the Food & Beverage industry has a lot more financial clout than the Dietary Supplement industry, it has greater lobbying power as well
So I continue to believe that the more likely outcome is CBD Isolate Legalization in Dietary Supplements, Foods and Beverages
There is one other thing besides legislation to federally legalize CBD that could really open up the national CBD industry — the FDA releasing its policy on Enforcement Discretion for CBD Products, which would be tantamount to CBD Legalization

The market is really waiting on Chuck to unveil his MJ Legalization/Decriminalization Bill
Amazon has come out in support of the House’s far more liberal MJ Legalization Bill
Clarence Thomas is a super conservative Supreme Court Justice and it was surprising and very encouraging to hear him publicly declare these anti-prohibition thoughts
But ultimately we probably need to see Senate legislation announced in order to reignite the cannabis sector
We’ve all been waiting patiently
Hopefully we see that happen now

Clarence Thomas says federal laws against marijuana may no longer be necessary...
"A prohibition on interstate use or cultivation of marijuana may no longer be necessary or proper to support the federal government's piecemeal approach," he wrote.

June 28,2021 ,
by Pete Williams
Clarence Thomas, one of the Supreme Court's most conservative justices, said Monday that because of the hodgepodge of federal policies on marijuana, federal laws against its use or cultivation may no longer make sense.
"A prohibition on interstate use or cultivation of marijuana may no longer be necessary or proper to support the federal government's piecemeal approach," he wrote.
His views came as the court declined to hear the appeal of a Colorado medical marijuana dispensary that was denied federal tax breaks that other businesses are allowed.
Thomas said the Supreme Court's ruling in 2005 upholding federal laws making marijuana possession illegal may now be out of date.
"Federal policies of the past 16 years have greatly undermined its reasoning," he said. "The federal government's current approach is a half-in, half-out regime that simultaneously tolerates and forbids local use of marijuana.”
Thirty-six states now allow medical marijuana, and 18 also allow recreational use. But federal tax law does not allow marijuana businesses to deduct their business expenses.
"Under this rule, a business that is still in the red after it pays its workers and keeps the lights on might nonetheless owe substantial federal income tax," Thomas said.
The Department of Justice has instructed the nation's federal prosecutors not to pursue cases against marijuana businesses that follow state law. And since 2015, Congress has prohibited the Justice Department from spending federal money to prevent states from carrying out their own laws.
The federal government's "willingness to look the other way on marijuana is more episodic that coherent," Thomas said.

Waiting for Chuck to introduce his bill, especially after seeing the excitement generated by mere chatter of the prospects of MJ Legalization earlier this year, hasn’t been easy — but if it resembles the STATES Act and is more of a MJ Decriminalization + Cannabis (MJ, Hemp, CBD) Banking Legalization bill, then the prospects of passing this Senate are certainly there
And I think that’s the kind of bill we’ll see, because a more liberal MJ Legalization bill similar to the House’s version just doesn’t have enough support to pass the more conservative Senate in 2021
How quickly cosponsors line up behind the Senate’s bill will provide some data to predict the prospects of its passage
The really nice thing about Chuck’s bill is that the fallback option of passing SAFE Banking and federally legalizing all cannabis banking, so every MJ, Hemp and CBD company can access banking and an investor base with much deeper pockets, is always there — and SAFE Banking has some real support amongst Senate Repubs (already 8 cosponsors) this time around, so its prospects look pretty good right now, with 12-15 Republican votes a distinct possibility, more than enough to overcome any filibuster
As for CBD, we have the opposite setup, with the House’s CBD Legalization bill being the more conservative one and the Senate’s CBD Legalization bill being more liberal
The difference between MJ and Hemp/CBD is that MJ products are only available at dispensaries, whereas Hemp/CBD products can be sold in any store
Dispensaries are heavily regulated and really set up to screen out minors — retail stores, convenience stores, supermarkets and gas stations, where Hemp/CBD products can be sold, are a totally different ballgame
This is why FDA and many members of Congress are strongly opposed to the idea of legalizing CBD products that contain THC — there is no getting around the fact that there are safety risks associated with the psychoactivity of THC, as well as its effects on motor coordination
As a result, it’s highly unlikely that Full Spectrum CBD will make it in the final version of any Congressional legislation that legalizes CBD Products in 2021
So that leaves us with CBD Isolate and Broad Spectrum CBD as the formulations that have a legitimate chance at being legalized
In terms of safety, which is an important issue for FDA and Congress, there is far more data on CBD Isolate
In terms of standardization of product content, which the FDA prefers, CBD Isolate can be produced consistently batch after batch, whereas Broad Spectrum CBD cannot as it’s really a veritable soup of cannabinoids with every batch being unique — there is no consistency there — in addition, hemp can be bred to produce higher amounts of the cannabinoids with far less safety data than CBD (CBG, CBN, CBC, etc), which is another safety hurdle for Broad Spectrum that isn’t there for CBD Isolate
In the end, I think there are two compromises between the House and Senate versions of CBD Legalization that are most likely to occur
CBD Isolate being legalized for use as a Dietary Supplement and Food/Beverage Additive
CBD Isolate and Broad Spectrum CBD being legalized for use as Dietary Supplements
So that’s definitely worthy of keeping an eye on, though there hasn’t been much chatter recently about a timeline for its publication date

SAFE Banking is the lowest hanging fruit of the three cannabis legalization bills, and it should sail through the Senate Banking Committee whenever Sherrod decides to schedule it for a vote, sending it thru to the Senate Floor

The time appears to be demandingly close.
Sales of CBD-only products at recreational marijuana retail outlets have been falling since 2018 in four Western states as more of these goods move into mainstream stores and online, according to an analysis of sales data from Seattle-based Headset.
The market share of noninhalable pure CBD products in adult-use stores has declined around 5 percentage points each in California, Colorado and Washington state between 2018 and 2020, with the share of overall sales in Nevada tumbling 23 percentage points.
The expansion of CBD-only products in everyday retail, including grocery, drug and specialty stores, along with the growth of CBD in e-commerce is most likely responsible for the decline.
Still, CBD-only products accounted for almost $43 million – or 10% of all noninhalable CBD sales – at marijuana retail stores in the four states in 2020 cali colo neva wash
According to the most recent data, combined sales of all CBD products for recreational marijuana retailers in these states (cali colo neva wash) was nearly $42 million for May 2021, a 110% increase from May 2018.

Geographic contagion is the mechanism through which MJ legalization spreads across America
NY, NJ and CT all passing legislation within the past several months is no coincidence

The biggest impetus for MJ legalization has always been the money
Now Chuck needs to deliver his bill so we can find out whether the financial ramifications of decriminalizing/legalizing MJ are strong enough to free the weed

The introduction of the House’s MJ Legalization Bill in 2021 is great to see, but we already know it will pass based on it passing in 2020
So the real action will take place in the Senate with Chuck’s MJ Legalization Bill
The Senate is a more conservative body than the House and the Democratic margin is obviously even slimmer, so the Senate’s version of MJ Legalization will probably look a bit different
Based on Chuck using the term decriminalization interchangeably with legalization over the past month or so when he has spoken to the media about his bill, one might expect to see something more akin to The STATES Act in the Senate, which is definitely more likely to pass than The House’s more liberal MORE Act
Something to watch for moving forward is whether Chuck will attempt to pass his MJ Legalization Bill by reconciliation, which is one way to avoid any possibility of the filibuster, thus requiring only 51 votes — if this is the case, the odds of passage will increase considerably

On 4/19/21, the House passed The 2021 SAFE Banking Act, so now all eyes are on the Senate:
U.S. House Approves Marijuana Banking Bill For Fourth Time, Setting Up Senate Consideration
The vote marks the fourth time the House has approved the Secure and Fair Enforcement (SAFE) Banking Act. Lawmakers passed it as a standalone bill in 2019 and then twice more as part of coronavirus relief legislation. At no point did the measure move forward in the Senate under Republican control last session, however.
But this time around, advocates and industry stakeholders are feeling confident that the bill’s path will not end in the House. With Democrats now in control of both chambers and the White House, there are high expectations that the proposal will make its way through the Senate and onto the president’s desk.
