popovsky is the ceo of a company that is in the same business as spng...which makes him a expert in that particular sector..which is why his statement in the matter was sought..so the quote by him is more than an "opinion"..he also is a competitor of spongetech...which means he has a potential to profit with a loss of spongetech credibility...with the statement he made, he basically called spongetech management flat out liars..publicly..in print..a direct quote.......yea, i think that is actionable...it isnt even close...once again..common sense..
as for getting a reporter to testify to that statement...a subpoena should be all thats necessary...she isnt protecting a confidential source..she questioned popovsky, took his quote and published it along with his name..whats to protect or hide?...
