THe issue doesn't appear to be collusion or whether or not there is infringement. Nokia appears to be saying, based on its own statements, that the Ericcson case somehow affects the size of the royality. On a side note, the single base station concern that we discussed before apparently came to fruition.
I just read the judge's decision and am worried about an appeal. Even if IDCC decides to accept the outcome, it's not clear that ERICY won't appeal. This means that the arbitration will be put on hold until the matter is resolved many months (a year?)from now?
in some perverse way...this might actually help...the arbitrators will now see that ericy had some ammunition to see the case through...yet they willingly signed a contract that requires them to pay ongoing royalties......i hope!!!
