JimLur: understood. This is why I can't see "much" happening until NOK is resolved. NOK will not be resolved until arb is completed in 2005.

NOK has no incentive to settle--no penalty for screwing IDCC
for years of not paying

IDCC has no incentive to settle--they will only lose money, because NOK probably wants to pay them substantially less than what is owed.--NOK is losing marketshare...hence it might be better for IDCC to hang on and get as much as it can for 2G.

Yes...and why would any company sign and pay IDCC now?? Why would IDCC give any type of concessions to get a licensee that may harm them with the NOK arb??

But we do have NEC, Sharp and Sanyo!! And IDCC can withstand waiting only a few months more....IDCC position and balance sheet is getting stronger and stronger by the day.

Since the 11 month's that have passed since Nokia has initiated Arbitration proceedings...Merritt has signed High Tech, Sierra and Sanyo to a 3G license..IMO:Sanyo will replace both Sony/Ericsson and Sharp...and become IDCC's second largest recurring revenue source and close the gap with NEC , which is IDCC's largest revenue producer...

I don't know anything about IDCC's licensing process but I do know this. If I was in charge of a company's licensing program and Merritt came in my office and told me my company needed a license for 3-G I would tell him this.

Come back when Nokia/ERICY start paying you for 3-G.

What could he say?

It depends on the company. Novatel for instance does not have the deep pockets of a Lucent. They are now producing UTMS products which infringe on IDCC's patents.

"Novatel Wireless, Inc. (Nasdaq: NVTL), a leading provider of wireless broadband access solutions, today announced the Federal Communications Commission (FCC) regulatory approval of the Merlin U520(TM) Wireless PC Card Modem based on Universal Mobile Telecommunications System (UMTS) technology."

Why would they spend money to defend a law suit that they will lose? I do not beleive they have much in the way of past due infringement money that they would have to pay so why not sign.

I fully expect this to get done soon. The revenue is probably not very relavant but the actual signing of another company will only advance IDCC's momentum.
