I agree Steady and we may very well see other tactics by the defendants but so far, we have defeated every one of them. If it takes a little longer than we think then so be it. I can wait.

As for OJ, there were many things favoring OJ such as the negative perception of white cops, OJ's celebrity status and the poor job the prosecution did. In this case, there is already a bias against big oil and the belief they are greedy so if anything, things are leaning in our favor.

O.J. only got off on the criminal case, where a unanimouse verdict of guilty is required.

He lost on the civil case, which was based on a preponderance of the evidence and majority vote of jurors.

We have a civil case. ;-)

In addition, I expect the defense to throw everything they can against the wall and see if anything sticks. They have little to lose doing that. If they get lucky and something sticks i.e. gets ruled on in their favor, that is little bonus.

This is a potentially very expensive case so the legal fees are not an issue compared to the costs of losing.

I suspect that one part of their strategy is to simply out spend our lawyers. As I understand it the Mosh lawyers are on a contingency fee, but even so, they probably don't have as deep pockets as Pioneer. So I'd expect the defense to try to use up as much of the MOSH teams resources as they can prior to the trial date.
