If the parties did not know the full contents of the staff report until yesterday, of course they would still be negotiating. I do not think NOK would have concluded any negotiations without knowing the contents of the staff report.

Nokia's CFO isn't saying that he is less optimistic than IDCC regarding a settlement, and he doesn't directly disagree with anything in IDCC's 8k.

What he says is that he is less optimistic than investors regarding a settlement. IMO, that means that Nokia's CFO 1) is closely following IDCC's stock price, and 2) feels it is appropriate to comment on movements in IDCC's stock price. This appears to me to be a shocking attempt by Nokia's CFO to publicly manipulate IDCC's stock price at the same time that he admits to being involved in settlement negotiations.

IMO the purpose of these comments is clear, and I do not take them as a negative indicator regarding the state of negotiations. Just the opposite. I added some shares today at $21.47. I plan to hold these shares until both Nokia and Samsung settle.
