LOL, every time you pick up the legal file, you get a rash. Stay away from the file cabinet and work on KoP using your bricks. The rule of thumb in pleadings is "you cannot get what you do not ask". It is a way of life in the legal field today. There is also a rule of thumb for cases, "if you cannot prove it, you do not get". Quit letting these Nok lawyers get under your skin. It is not worth fretting over. In the final outcome, the judge is going to realize that the case is all about the habit and custom of the wireless sector. There may be a few companies with clean hands, but the majority spend a lot of time around the cess pool because the top companies in the sector force them to do so. The case is all about nothing in order to threaten interference with the patents of IDCC without the fear of an infringement action. It will not fly.
