That the illegal judges fiasco resulted in an inordinate amount of rulings in their favor does not mean that any defendant/company was not inherently involved in wrongdoing. It may mean that one ends up getting fined because they looked the wrong way and their shoes are not polished…or committed an egregious crime, or something in between.
But, because of that egregious technical judge mess, all cases should have been thrown out…end of story. No one should have been found of any wrongdoing, no fines should have been imposed, and reimbursement for attorney fees and other expenses should have been the order of the day for every company courtesy the government. None of that happened.
No doubt that BIEL made the right decision to move on with a much lesser fine. Did that agreement include any written statement that the company denies involvement in any wrongdoing? A favorite maneuver of many a company these days. But I doubt one was included. Because if I’m sitting in that position, the game plan is to pay the much reduced fine and get heck out of dodge, especially given the government’s unlimited budget to persevere anyone to the black hole.
What ultimately counts is what the potential investor sees from all this. They are the judge.
Lastly, if what I read here is true in that the fine has still not been paid, well, why give a potential investor another reason to hesitate? Put this baby to bed!
