What is the Rule of Law?

The rule of law is a set of principles, or ideals, for ensuring an orderly and just society. Many countries throughout the world strive to uphold the rule of law where no one is above the law, everyone is treated equally under the law, everyone is held accountable to the same laws, there are clear and fair processes for enforcing laws, there is an independent judiciary, and human rights are guaranteed for all.

The SEC violated the Constitutional mandate for an 'Independent Judiciary'. This was not a one time slip up. They designed their Administrative Proceeding system so that the SEC had hiring and firing authority over the Judges that would preside over the cases that the SEC prosecuted.

This illegal system continued for years and years even as legal scholars warned the SEC that it was Unconstitutional.

Why would the SEC knowingly break the law?

The SEC got a 90% conviction rate from the Judges it hired who were not "Independent". When SEC cases were tried by Federally Appointed Judges, who are "Independent", the conviction rates dropped into the 60% range.
