Raf, Lunacy is a good term. They have made no attempt to stop the infringing behavior. You can't continue to commit
actionable behavior and defend the behavior by clamming ignorance. I think the lawsuit in and of itself should be evidence of their current knowledge. I agree. If I was a judge I would be upset.

It's astonishing that they actually put that in writing.

They might just as well have said we all missed that day in law school when they talked about patents.

As you stated, if I am the judge, the blatant lunacy and simply reading those words would have prompted me to throw something across the room.
