Yes, we are in agreement that they lost, and that the judge's OPINION was that revocation was not the appropriate punishment under the circumstances.
The reason that this is an ongoing case is because 100% of prior cases where companies failed to file (as DBMM did) they were revoked.
Now either the sentence was wrong for many of the prior cases, or the sentence was wrong this time...
And for the record, I do not believe that revocation is appropriate here!
That said, history (all prior cases) show that the SEC believes that revocation is appropriate here! It is not hard to believe that they will find for that again here!
Hence why this has been ongoing for over a year!
