Popular opinion is that no, they cannot issue new preferred shares without changing the ownership structure... if they had issued them at the same time that the common shares were handed out, it would have been covered under the "freebie" ownership changed allowed during emergence from BK, but it's now too late.

I have a social disorder (although it's not quite full blown Asperger's), and can come across differently than intended...if you're offended by something I've said, I probably didn't mean it with such animosity - please take it with a grain of salt. :)
