It's not a criminal trial, and I don't think it's about any overriding principles of "fairness".




Here's a summary of a post of mine from the AMRN board Wayback machine;

Mobil fabricated performance lubricants by taking a very pure feedstock, natural gas, and fabricating oils to the exact molecular structure desired. They marketed this as "synthetic oil" since they started with simple gaseous building blocks and created a complex liquid. Castrol refined lubrication oil by taking crude oil and boiling off the lighter partials and dropping out the tars and rocks and marketed the resulting high quality oil as "synthetic oil". Mobil sued Castrol over stating an equivalence in the products and lost. The judge said, "Both come out of a plant where they are processed and both are man made, or "synthetic" oil.

Hardly seems "fair". But sometimes things don't work out and you should be aware of the possibilities. So I'm invested on the basis of mostly knowledge with a skosh of belief. So tally me up with HDG as a fudster if you wanna... But if you think things hafta because because, that's an argument the kids often lost when I was the judge, jury and executioner... and it happens in larger venues also...

If it's possible, you have to recognize it to discount it...
