You are probably closer to correct with the percentage, and I agree that SG opinion certainly gives USSC an out to disregard the issue altogether.

Just to be clear, I totally agree that they are a hired gun just wasting time... in other words, the real 'patent trolls'.... but I'm just saying that as Congress wrote it, RPX may have found the chance to delay further. As I read it, their argument is not based a loss from the fee they paid... I believe they are claiming that Congress authorizes them to dispute patents whether they've suffered a direct loss or not.
