A permanent injunction against Google has nothing to do with any award to the plantaiff. An injunction is a punitive measure against the defendant....that's it. If Google finds themselves with a permanent injunction against the products in question after the Dec 8th hearing, MAXD will have to pay a bond (percentage of the expected revenue loss to the defendant) in the case that the injunction is ever reversed in an appeal. The next step in the process if MAXD secures a permanent injunction against GOOG is to have a nullity hearing (which will be at least a year in the future). A nullity hearing in Germany is equivalent to a PTAB patent review here in the states. The PTAB determines the validity of the patent in reference any potential prior art. What longs are speculating is that Google will lose the permanent injunction hearing and MAXD will enforce the injunction through payment of required bond. This will back Google into a corner as the cost to their business (loss of revenue from YouTube, Android, and Chromecast for at least one year) will be greater than the option of paying a license to MAXD for the VSL video codec. A license from Google would be a great payday for all MAXD investors.
If MAXD does not secure a permanent injunction in Germany, investors will have to solely rely on potential revenue from signed contracts or future contracts on the HD-audio side. Many investors have lost faith that MAXD can close a deal that performs as they have yet to realize any revenues from their current licenses.
