The SCOTUS ruling uses the term "purely functional and generic" as how it relates here.
The question is, does the information Langs patent rely on use generic data or something else?
Further it takes that very specific data and uses it as a building block to define another very specific outcome.
THis is not an Excel spreadsheet math feature here which is the concept I think the SCOTUS opinion is ruling against.
I think this validates Langs patent more than anything.

There is little oversight of shorting in that it has to be reported. Naked shorting goes on every day without anyone doing a damn thing.

As far as tone goes, judges, always play that hand. I suppose it becomes an acquired skill over time. Means little in my experience in front of plenty of them. They like to keep the lawyers on their toes.

With regard to Vringo's counsel on latches.
Listen to how it went down. He waived his five minute rebuttal because there was nothing to say. Goog did not bother to address it at all.
That was huge in my opinion and should result in summary judgement on the latches appeal.
This was a very well done hit piece and a well organized short attack that has been in the making for days.
What the Bloomberg editor failed to mention:
The judge asked Googles attorney "Did you not raise 101 in this case?
They answer with " um well, no...
So that takes 35 U.S.C. 101 off the table?
Add to that the laches argument. Googles counsel did not address the cross-appeal. To the extent that Vringos counsel waived the rebuttal. Thats not newsworthy? Really?
The stock should be up today not down.
After listening to the tape I bought more at $3.66.
I liked what I heard.
We heard that Judge Jackson was on the take, corrupt, an obama friend, etc.
He went on to make an ironclad, impartial, and fair final ruling.
I cannot imagine this court will be any less impartial and professional.
The way Bloomberg editors wrote their article it would lead one to believe this is a slam dunk no contest win for Google.
I also agree that this is another buying opportunity.

until 2013. That means these patents were validated on his watch.Google then went on to unsuccessfully write a workaround that failed. I would say copying is rather clear.
Vringo unequivocally proved infringement "copying" during the trial so I smell a rat here and I suspect it is Bloomberg editors.
Really? So these judges are going to retry a case? And for all these years I thought appeals courts only dealt with technical errors.
The only two technical errors I know of in this case are laches and the jury error.

During the 30 minute hearing, the judges questioned the complexity of the verdict sheet, in which the jury was asked specific questions about factors regarding the validity of the patents. Circuit Judge Evan Wallach said he had “problems with the jury’s findings” when it came to things like whether Vringo had proven evidence of copying.
“Maybe it’s a hash -- the jury made a hash of it,” Circuit Judge Raymond Chen said.
What exactly was Chen referring to? Wanna bet he was referring to the jury error?
I cannot listen to this recording but I suspect this was not in the context the Judge said.
I would not doubt what Wallach said was taken out of context.
I suspect journalistic malpractice versus judges who would say such things without exploring the evidence.
Hon Raymond Chen looks like he helped write the rules for exactly this type of patent while he served as a solicitor United States Patent and Trademark Office. From what it appears, he served there in a major role when this patent was reviewed and upheld.
I would say him being here is very good news.

Well I have been lurking for a while here. Long VRNG since May of last year. The events of the past week has sealed Googles fate. The odds of a true work around are slim to none. I have learned to never say never but this looks like the Judge has called their bluff. I actually am in the camp of believing Google will settle and do it soon. They have nothing to gain by moving forward with presenting a "colored" version of the patent. I believe this will be settled this week.
Seeing JJ Seabrook here is a real good sign too. JJ I remember your wisdom from FHAL, back in 06. Remember ol Rufus! I am sure you remember that drama!

Anyway, been in VRNG for a few months and it looks better every day. I totally agree that someone must desperately need to keep this under $4.00 until the options expire Saturday.
I suspect however, with Hudson, being paid off, we see a juicy PR this week on another settlement that pushes it well over $4.00.

When you have hacks like Newt Gingrich and Rick Perry attacking the Federal Reserve on a level that would make Gold bugs blush one thing can be certain. Gold is going to be a new standard as a storage of value. It is a matter of time and I am not talking decades. Now is the era of gold, more than any time in history. Either that or DC politicians are going to become fiscal hawks across the board.
