During the 30 minute hearing, the judges questioned the complexity of the verdict sheet, in which the jury was asked specific questions about factors regarding the validity of the patents. Circuit Judge Evan Wallach said he had “problems with the jury’s findings” when it came to things like whether Vringo had proven evidence of copying.
“Maybe it’s a hash -- the jury made a hash of it,” Circuit Judge Raymond Chen said.
What exactly was Chen referring to? Wanna bet he was referring to the jury error?
I cannot listen to this recording but I suspect this was not in the context the Judge said.
I would not doubt what Wallach said was taken out of context.
I suspect journalistic malpractice versus judges who would say such things without exploring the evidence.
