ok, so reread taguchi complaint, section 1, notes 37-43, and while it says she was not aware of some patients and says she didn't believe the full 120 allergens tested was necessary all the time, no where does it say there were billings for tests not given.
per complaint, accused of:
37. aryc has test running for 120 type allergies tested.
38. taguchi ok to work with gov
39. admit to guilt. statement not medically necessary to test for 120 each time. schena falsely uses her med # to submit claims. schena submits false docs to regulatory bodies to certify lab.
40. aryc client services manual addressed, question validity of claims in it.
41. consultants paid commissions to offer aryc test to patients
42. aryc used taguchi to per #39, order tests for patients wo skin conditions or contraindications for a skin test that would make it necessary to use a pin prick vs traditional skin test for allergy.
43. billing data, says aryc billed medicare 5.9 million and private insurance 63 million. was paid $290k and $2M+.
that's it. no claim of 'billing for tests that were not even given"
I don't get the final sentence, hospitals bill incorrectly all the time
they rely on insurance for their business
that's why their collections are so lengthy...so many errors

Ahh, The plot thickens, we all know that the DOJ case against Arrayit for testing for to many allergies is complete BS. There is no way anyone could possibly test for to many things a person might be allergic to. Now we have a situation where the gov claims that Shena was personally responsible for improper billing and kickbacks and yet in his response he claims that he "is not involved in payor negotiations or any billing aspect". I like the part in his response where he claims that there covid-19 test is nearly 100% accurate in both specificity and sensitivity. That's the first time I have heard them claim that. Puts a whole new light on things. Would not surprise me one bit if it's found out later that some competitor started an office dealing with Arrayit allergy and covid-19 tests so that they could engage in improper billing just so that all this could happen. Drive the stock price down so you can pick up cheapies. Let's face it millions of share have been trading every day, someone is buying those shares. If it's such a POS why are they buying?
reading that Mark Schena brief today, he NEVER went to JAIL
he was released (on paper) but was never in Santa Rosa, just as I had said.
not sure when on Thursday 6/11 he would have been in SR, which is about 2-2.5 hrs drive North from Sunnyvale. I was at home depot in the AM, drove by ARYC 10-1030am. ACtually caught Mark in a photo on the phone in the parking lot out front of building.
