With all due respect I doubt you see $0.0016 for awhile...look at the volume, the presumed float has traded three times over in short order. What do u think gagging the T/A is all about??? Why the secrecy?
If your company is on the up-and-up, like your PR with share structure portends, then u don't need to mess about. Nothing good here...
Chart-wise the $0.0011 level should have held-- VERY long-standing support here dating way back, but it broke...this stock is now in a downtrend!! I am almost finished getting my $0.0011 sell orders filled, made my ~25% and it is time to leave...I was PLANNING on holding this one through the summer...but you CAN NOT PLAY WITH your MONEY...especially investing in manipulating CEO's. Anyone who has been in PENNY LAND long enough KNOWS THIS!!!
PS- IF you want a no-nonsense genuinely good summer-long double your money stock, have a look (do some DD) on TDGI...then you'll know the difference between a potential scam & potential BLOCKBUSTER!!! (and a safe place to put your hard-earned money imho)
I would not be surprised to see it go lower still...we don't know how many shares are being dumped on us...I bought in the $0.0008 and $0.0009 price points...I have been selling all morning @ $0.0011 and I doubt that $0.0010 holds...
Until this company fixes their penchant for manipulative tactics...they can not be taken at their word for anything in my view...ME & MY MONEY...therefore, go elsewhere.

Agreed, I was considering taking a much larger stake in this company based upon the ungagged T/A. But, as with many scam penny stocks and their closely related cousins...the CEO saw fit to announce the share structure in a PR (as if to send a message of transparency) and then went right back to GAGGING the T/A... again!!
NOW, instead of INCREASING my position today...I will be DECREASING the amount of shares I currently hold to manage my risk (and might just get out altogether).

I am not suggesting they will R/S at this or any point. Rather that management in many corporate penny-stocks will often do WHATEVER they can GET AWAY with. I encouraged shareholders to contact MRNJ proactively & aggressively to discern where they stand and invest accordingly.
I have seen enough to know, personally, I won't be buying this POS anytime soon. I don't make excuses for poor corporate conduct towards shareholders, nor dismiss what they have done...I choose not to live in denial. I suggest shareholders NOT complain about the goings-on here and get facts. The faster the better...OTHERWISE, and to the point of my message, they may find themselves facing R/S and all manner of hell as a consequence! PERIOD!
At this point in time shareholders ought to contact the company and express their consternations, make demands over a conference call, and communicate the need to get a handle on what is going on over there.
Unfortunately, although I agree with some posters about MRNJ's potential and valuations, companies that conduct themselves in this manner tend to know this as well. And, things tend to get WORSE far faster (via R/S for example, further incessant dilution,...) than shareholders seeing any benefit if the company is not pressed. By engaging in what essentially amounts to shareholder "carrot-dangling" while MRNJ continues to milk funds off the pps/investors. By proactively pressing them, you'll come to realize where you stand with regards to your investment far faster than hoping they will "do the right thing". In my experience, few penny stock managements EVER do so without heat from shareholders. Moreover, if they are unresponsive,... take it as a sign to GET OUT!!!
I don't know if this pps depreciation is fixable in any way, shape or form. But, if you are a shareholder your voice carries weight and you ought to demand it be heard. Take it as a proactive sign that this is another penny stock looking out for themselves at the expense of shareholders should nothing positive result from such communications.

It looks like MM accumulation now. The first drop off from $0.17 was clearly dilution (company raising capital as it went from 53M O/S to 100M O/S over a week period).
With only 100M O/S and all the news, market position, and very lucrative businesses this will be testing $0.12 on very short notice. Mainly, imho, after the MM have had their fill and let it run.
I see this stock with VERY VERY little downside risk with tremendous upside. Accumulating along with MM (I've learned that it's always best to work with them...filling gaps, balancing books, getting even, and making a profit!!!...Remember they hold shares to profit too!!!)

It's funny actually, Apple just named them as their next platform, they are the 4th LARGEST APP provider (behind Apple, Google, & Amazon alone) with new deals being struck daily.
THEY now have the IN,...their newly accepted platform is 1000x faster than anything else making TV, Movies, Apps, & other programming stream MUCH faster than before...and suggesting integration between multiple Apps is on it's way.

Hmmmmmmmm, conspiracy theories? If you go to buyins.net you find alot more than theories regarding the existence of naked short selling strategies. And since SPNG has been one of the most shorted of all stocks in the entire market according to SEC information, I wonder what the SEC's policy is in regards to a situation guaranteed to create a MOASS? For instance, if 500 million shares of shorts exist in the float and SPNG or Pike or someone else buys up those shares and put hold onto them, then what happens? Don't tell me that is impossible because one of the nss favorite ways to get unaccounted for shares of shorted shares is to have a broker or MM "accidentally on purpose" mis-mark the forms they must fill out at the end of a day of trading...if they do this consistently over the course of two years (yes, records prove nss of SPNG has gone on for more than 2 years) then a few million shares mis-marked here and there for two years could account for many hundreds of millions of shares mis-marked and not being actively looked for by the SEC...even billions of shares could end up being marked as Longs when they were really short.....so if billions of shares of short shares existed in the float and someone like SPNG bought back and retired the entire float...what would happen? Not just a MOASS, but something much more sinister....an impossible to rectify situation. What would the SEC's position be in that situation? That is a question I would like to get the answer to....anyone have a guess?
Well put. I often find this subject brushed under the rug. Unfortunately, even with RegSHO, leading to FTD's & grandfather clauses, the system is purposely ineffective. Such that a law, which goes unenforced (sans prosecution) is really no law at all. The US Capital Markets are too steeped in fraud, with NSS, and although I am hopeful that might change,...I find it naive of me to believe it will.

So it left me considering the following:
(1) As a former reporting company now on the grey's, is that legal? (whether they are or not is immaterial) Meaning, can they buy shares here if they wish?
(1A) If they did would they be obliged to report that fact, and if yes, on what timeline?
(2) Can anyone suggest who I might contact to verify whether or not they can buy and subsequently report if its required?
(3) Are there any (more/less or same) restrictions regarding SPNG being able to sell shares here? (Forget whether or not they have done anything inappropriate to this point) Simply can they do so "legally" or not?

(1) Some posters suggest a stock fraud manipulation scheme.
The actions taken against EESO are more consistent with that line of inference. Similar time frames involving two separate companies (EESO & SPNG) followed by SEC actions with dramatically different consequences.
If SPNG was acting in accordance with what some posters "would have shareholders believe" then the resulting outcome/expectation ought to have been closer to the SEC (& others) sanctions as taken against EESO. Simple deduction, that's my point.
Contrast the SPNG "story" to this point in time with another equity which was "flagged" around the exact same period (EESO, link below).
Note the differences in SEC actions b/n the two. Specifically if fraud was "obviously" perpetrated, as some posters here would lead you to believe.

Did some checking on Pacer. Trial date period is set for February 1, 2011. I understand the CEO (Jared) wants to supply a settlement for some issues, not all, by paying money to get some of the problems settled.
There is a court appointed Mediator and the parties have until
December 23 this year to object to the person appointed and to make a motion to stipulate and alternative mediator. If they don't object then they have until September 15 2010 to complete mediation.

FULL DISCLOSURE: I am NOT an investor in either company. I have been watching EESO for over a year and was not convinced to buy (although I really wanted to) and am grateful I did not (to this point).
I have also been following SPNG (in all its variations E, greys, etc) and am VERY CLOSE to buying at these levels. Partially because of the trading range, PIKE, CVS & other store tracking I have done and seen with my own eyes, Marvel & other licensing deals, and a recent visit to the bustling NYC headquarters as well as the DICON facility prior to their move out of NJ.
According to FINRA's OTC Compliance Unit (and my various phone calls placed to them @ (240) 386-5100), SPNG is required to update/be current in all financial filings (restatements, audited financials, recent Q's, K's, etc.) in order to gain uplisting. In addition, a Form 211, presented by a MM, around the same time, would complete the uplisting requirements.
It was made repeatedly clear to me that there was no time limit or constraints regarding how long they may dwell here on the "greys"; except that, if they were to uplist, all their filings must be current along with a MM-completed Form-211...PERIOD.
That's how I understood my conversations with FINRA over the last couple of weeks.

Patchman, I have a SPNG question for you.
I originally took a position in SPNG in July, traded it and made money. Fine. However, while watching the L2 trades go around that time I couldn't help but notice that NITE was consistently on the ASK & hardly ever on the BID. At first I thought they may have purchased a ton of shares prior to my observations and explained it all away as such. Although as time marched on, I saw more of the same for months on end. The RegSHO lists and FTD's I saw later this past summer made me believe that NITE was responsible for them.
Fast forward to suspension-time whereby SPNG goes down & NITE goes up (check the charts). Fortunately, I bailed from SPNG around the time when the 10K was NOT produced. I later went and shorted NITE based upon what I saw just prior to the post-suspension open of SPNG assuming they were short a bunch (just my opinion is all).
Then, more recently, a Y! MB poster named thefitstar starts tracking ONE online retail shorting broker called IB (Interactive Brokers) on a daily basis & begins reporting what he sees (unfortunately his posts on the matter have been deleted and his account terminated-- some of his threads I included here were largely ignored).

Essentially, in this NITE "short account", thefitstar reports that each night from around 11:30pm-2:30am...the account dwindles from around 5.3 - 7.3 Million, down to as low as 500 - 850,000 shares available to short. Now, around 6am to 8:30am each morning the account is "restored & replenished", day-after-day, to around 5.3-7.3 Million share figure (pre-market). Calls put into the trading desk at IB reveal that this is unusual as their accounts adjust in REAL TIME (as shares are shorted, the account shares are decreased and covering elicits the inverse effect) to accommodate supply/demand.
Curious, I began to track this ONE account myself and see the exact same pattern day-after-day. What is very puzzling about this phenomena is the costs associated with shorting on this ONE account. They are as follows; $2.50 per share, plus share costs and commissions.
Who is shorting this daily volume of around 3-6Million? Considering this now 8week tight-trading-range of $.04-$.05, the aforementioned rather-large daily "short" volume, the difficulties of selling/buying (shorting/covering) in a profitable manner in this trading range, the risks & sizeable costs (which are prohibitive in my view under these conditions) all point to a highly unprofitable venture and therefore unlikely executed by any retail investors or consortium of same such. Furthermore, when I personally called IB to ask after this matter, they suggested that I contact the SEC...being highly atypical (according to Dan at the trading desk, as well as Jeff & Liz). So, thefitstar logically suggested that it was NITE (Knight Capital Group) that very well may be behind this trading action...as in WASHING trades. Who else has the motivation, access, and presumably the need to "cover" the shorts they amassed? If not them, then who?
I write all this because I understand you have developed a reputation for being an investor advocate (I have seen you on TV in that role), and I have read some of your published reports.
Am I missing something here with regards to these observations in particular? Moreover, this very narrow trading range, volume and whatnot seems highly irregular & bordering on manipulation with NITE at the helm here "matching trades" so to speak. Well, what do you say about all that I have written here?

The poster contacted IB and was told that the trading in this short account is atypical and should be discussed with the SEC. Essentially, it is not "trading" in REAL-TIME and often millions of short sales/supply is deducted and credited within a 24hr period. Smacks of WASH trades.

Anyone observe this same behavior with other "retail shorting brokerages" and/or wish to contribute a pov? It is interesting to say the least.
No one is suggesting that shorting a stock is illegal. Even NSS is legal (to a point). The fact that NSS permeates markets in FTD's and goes unregulated, unpunished and is considered "illegal" but prosecution absent,... represents another matter altogether.
Many have witnessed Nite being on the ASK and not on the BID for months ad-nauseum, many have commented here, there and everywhere.
The posters point is that the behavior of NITE could imply WASH trades. Who else would absorb the substantiative (and prohibitive) costs of shorting this equity ($2.50 per share, plus share costs), in the volumes observed daily, can profit in this narrow trading range, and risk being able to do so at such volumes when trade executions are also prohibitive to profiting. Not to mention that the late-night account adjustments are inconsistent with IB account activity. Normally, shorting causes a REAL-TIME decrease in shorts available and covering the opposite. This account is not operating in real-time, but "off-line" and shows millions of shares being depleted and replenished daily.
Yesterday's volume, for example, was almost entirely reflected in NITE's short account with IB (having gone from 6,100,000 to 850,000 buy about 1am est, only to be brought back to 5,700,000 this morning pre-market-open). Strange goings-on. I have called IB myself, watched this ONE short account, and have questions as to what is going on here. That's all.
However, it could be that WASH trades by NITE fits that interpretation. Looking at NITE's stock price superimposed with SPNG's is also interesting in that NITE went from above $23.00 post-suspension open to around $13.90 thereafter. Interesting stuff.

Open Question concerning "Air Shares" (or NSS):
This will sound like a trick question, or one without an answer. But, I figured I would give it a try in case someone knows some methods that I am unaware of.
How are the NSS, that some are convinced exist, determined? Aside from the previous RegSho list, the Buyin.com PR (972Million shorts @ $0.09 avg pps), I am not aware of how to validate the MASSIVE NSS position that some claim to exist. I am not in disagreement that there may be, just wondering HONESTLY how many have come to this conclusion AND how they determined the actual amount.

Well, my information comes from the same filing- as well as others.
However, you may not be reading the filing correctly; it is my understanding that the right column is an aggregate of what they already owned & purchased (as represented by the green figures).
If you simply tally the green column (from your linked post) you'll find that they add up to 42Million shares purchased on the dates AFTER the suspension.
