This may seem like a stupid question but I thought I would ask anyway - How does ACY know who the shareholders of AAPU are.
Correct me if I am wrong - you need the latest shareholder list which would comprise of shares held in electronic form via brokerage accounts and shares held in cert form. So when people are stating ACY is in control or hold our shares, how have they achieved that?
There would have to be an exercise carried out by the Old TA or if they are using a new TA then the old one would have to pass over all the records and then a reconcillation process would have to take place beteween the TA and the brokers before transference of shares.
That means your broker and TA should know if this exercise has actually ever taken place - correct ?
So why don't we ask ?

Nocents the CEO has screwed the shareholders twice in this stock - first when he failed on his original business plan and put the company into significant debt and las suits filed against them and now by diluting the crap out of the company to pay for - well take your own guess at that.

Cdnstocker - Kip seems to like to collect shells and then do nothing with them - he has 4 that I knoe of and not a sniff of a merger with one of them.
Maybe he is not trusted in the shell/merger world, he certainly ain't doing a great job of promoting them thats for sure.

Looks like A.C. wanted to distance himself from any of the official docs after the company was suspended - I would have thought being the CEO he would have had to sign these docs, at least we have the e-mail from his lawyers that confirms he was the CEO.

kzivann unfortunately I have had a few stocks that got suspended and most of them put a PR out after the suspension stating they are supporting the SEC with there enquiries and expect a positive outcome and back to normal trading but not one of them have. Usually the last time you here from them is in that last PR after suspension.
Just the way it goes , blagging right up to the last.
Not saying thats going to be the final outcome here but it is following the same path so far.

Tradingismylife can you ask Bill why he has not posted the companies financial status ?
In a PR released in Nov of last year, Bill promised to update shareholders on the financial condition of the company.
I think he owes the shareholders that much since he is using them to keep the company operational by raising funds and diluting the o/s through the 504, don't you think ?
He is asking shareholders to support the company so don't you think he should be supplying the shareholders with fundamental company info ?

Poster looking at the timing of the e-mails and don't see anything wrong.
The 2nd and 3rd responses came on top of each other (within 3 minutes of each other) - she just decided to send the answer to my 3rd e-mail first before her answer to the 2nd one.
First mail sent at 6.49am west coast time (which would be 2.49pm uk time).
Pacwest send First mail back at 3.22pm uk time (which would be 7.22 am west coast time).

YOTB I gave Pacwest every opertunity to state wither or not they had transfered the shareholder records to another TA or other entity and they did not - for some other entity to control this data base they would have had to request on the current TA.
Maybe someone could ask that question directly on them.

No problem YOTB - I did not want to ask if there was merger going on because if I did and she said no, then other board members will just say she would not have that info.
I tried to get status with regards to what was happening with the shares and I maybe wrong here but shares have to be managed by a TA if they have public status . So what does it mean when a TA's contract has been terminated and the control of the share holder base has not been passed onto another TA if we were to be merged.

If board members have questions for the TA that they believe will yield greater clarity to the current status at least you

The company is AAPU and it seems as if they decided to dissolve operations in March of this year.
Could you confirm if/when the shares will actually be removed from the system ?
If you have not received direction from the company to remove the shares could you give a reason why ?
Could you also confirm contact details that you have on the company as I would like to get in touch with them.
I must admit I was disappointed that a public company took this action and did not inform its shareholders.

youngMillionaire I must admit I don't like a company calling what the PPs are going to be on their stock especially when they have not generated any revenue as yet - only had bad experiences with that in the past.
In saying that these guys seem to be respected with in the industry and have their reputations on the line here - I think they would be risking a great deal if they attempted to mislead the public through PRs or information disseminated through their website.

jimmenknee this situation is black and white , there is no grey areas here for shareholders of AAPU.
We either are going to be part of some merged entity and we benefit as being shareholders or it has been a scam from the word go and there never was any value in AAPU and the financials and past PRs released were part of the illusion to attract investors so they could dump shares.

What I don't get if this was such a no brainer and the price was heading to the 70c range this year why would people that either know or are associated with the directors of the company not be buying large blocks of free trading shares in the open market at this level.
It's legit as all the info has been made available to the public and they would be able to trade their shares when and how they wanted.

Has anyone actually confirmed with the company directors that there is a merger taking place and APPU shareholders will be part of the merger ? You know a statement directly from the horses mouth.
Its not exactly insider info to let shareholders of a company that you have de-listed know that their investment has not been lost.
I am not saying they should give details, something like - you will be part of a merger but we cannot discuss at this moment in time while we are working out the details.

If someone is speaking to management or e-mailing them I think it would be a good idea to ask them to clarify to the investment community how they are arrived at the PPs for 2008 as stated on their website.
If they are going to project PPS people want to know how they arrive at those numbers.
If they backup their numbers with a believable explanation I think we would see the PPs move north.

Read the revenue / earning projrctions . Maybe missing something or do not fully understand the data but how does 35k net income in 2008 relate to PPS of $3.09 in 2008 when we have an o/s of 79m ?

I would suggest trying to findout if the A/S has increased if you want to want to know where they are getting the shares from.

rjbluesky no one has supplied a scanned in copy of a letter supplied by their broker.
All we have had is phone call conversations and typed versions of what they have received.
If someone is convinced of a conversation/communication they have had with their broker then put it beyond reasonable doubt and scan in an offical letter to confirm their findings.

Algol - Shizz can you please ask your contacts at E-TRADE to send an official letter confirming what they have told you - you know one with an official letter heading and signed.
I was unfortunately part of the cmkx saga and individuals were for ever coming on to the message boards and saying their brokers told them this and told them that and in the end it was all a load of bs. Not one produced official proof.
So can we make it a rule that if a board member is going to pass info to the board from their broker then it is an official correspondence.
If it is official then I am sure it will have a name and contact details that another board member can then confirm.
