I don't understand the trading pattern here. The company puts out doom and gloom prs, tons of people come out of the woodwork talking crap, yet someone keeps buying chunks. Curious.

This is key. Who knows what was promised to Scott? Are his shares vested? Is he actually a creditor? Did he actually file the requisite legal paperwork or did he just make stuff up as he went along? Who knows? Not us, but Dan and Otto presumably do. Let's wait and see what happens.

The BOD does not need to sue Scott to revoke his shares in the company. Just yesterday the BOD of Wells Fargo revoked 45 million dollars worth of shares they paid to their CEO John Stumpf and 19 million in shares paid to Executive Carrie Tolstedt. They did this in response to a lawsuit that proved wrong doing on the part of these officers, but it was NOT a stipulation of the lawsuit itself. The BOD acted in the best interests of its shareholders. As the chairman of the Wells Fargo board, Steve Sanger said, "The independent members of the board will take such other actions as they collectively deem appropriate."
If Dan and Otto suspect fraud on the part of Scott, it is their responsibility to revoke shares paid to him as compensation.

The BOD has the legal right to rescind restricted stock awards. It happens even in Dow and Nasdaq listed companies. The most common reason boards rescind stock awards is because they overcompensated their officers in violation of the company's charter. I think that's what happened last year with American Capital if I'm not mistaken.
The solution is take away Keevils shares and give them to someone else.
