Just spoke with Ares at IR. The following points were discussed:
Due to the undisputedly impressive rise of ACLH stock and trading within just a matter of days, and for the most part based on pure positive PR, the SEC understandably took notice to the activities within ACLH. Ares was adamant about his understanding of the SEC's concerns; although equally made it very clear that the suspension was not merited based upon any improprieties on ACLH's part.
With the suspension ACLH sought out and obtained VERY competent legal counsel that has advised them to maintain a conservative (silent) position during the information gathering process being undertaken during this suspension. To this extent, however, Ares confirms that either today or tomorrow ACLH will be submitting to the SEC an over-abundance of documentation to satisfy the SEC's questions and/or concerns. This information will include:
1. confirmation of ownership of patents;
2. exclusive use/rights of the oil fluidizer;
3. professional business relationships to Ancon Marine, BP;
4. historical documentation of 15 years of business conducted
with various petroleum companies and efforts.
In regards to commencing trading on June 09 on the grey or pink sheets, Ares believes that we will commence trading on the pink sheets because of the extensive documentation/reassurances being provided to the SEC. However, based on the knowledge I've gained from our more knowledgeable posters, I respectfully requested Ares to inquire further to learn if ACLH will need to have a MM submit the appropriate forms to permit the initial quoting on ACLH, and subsequently thereafter, piggybacking by other MMs. Ares confirmed that he will verify this information in order to ensure that we will open on the pink sheets come this June 09.
Lastly, I suggested that ACLH consider possibly contracting with a PR firm or lobbying group to reach out to Gulf coast politicians/decision makers to further get the word out on the ACLH solution to the clean-up effort. Ares stated that he would discuss this option with Mr. Kidder.
Bottom-line...I am feeling VERY confident that ACLH will be one of those rare securities that will bounce back after an SEC suspension. I also trust that we will be receiving the first of many positive, SUBSTANTIATED press releases within the next few days.
I believe we'll be looking back at the 10-day suspension as one hell of a turn on this roller coaster of a ride to success and global recognition for ACLH....!!!!

When the SEC Suspends Trading in a Stock
The federal securities laws allow the SEC to suspend trading in any stock for up to ten trading days. This document answers some of the typical questions we receive from investors about trading suspensions.
When can the SEC suspend a stock from trading?
When it serves the public interest and will protect investors, the SEC may suspend trading. For instance, the SEC may act when public information about a company is not current, accurate, or adequate. The SEC has acted when serious questions arose about a company's assets, operations, or other financial information.
Why couldn't the SEC forewarn me that it was about to suspend trading before I bought the security in the first place?
The SEC cannot announce that it's working on a suspension. We conduct this work confidentially to maintain our effectiveness and to guard against the destruction of evidence if our work becomes widely known. Confidentiality also protects a company and its shareholders if the SEC ultimately decides not to issue a trading suspension. Mindful of the seriousness of suspensions, the SEC moves as quickly as possible when it considers a trading suspension.
What happens when the ten-day suspension period ends? Will the SEC issue a statement about the status of the company after the suspension has ended?
No. The SEC will not comment publicly on the status of a company when the ten-day suspension ends because the company may still have serious legal problems. For instance, the SEC may continue to investigate a company to determine whether it has defrauded investors. The public will not know if the SEC is continuing its investigation until the SEC publicly announces an enforcement action against the company.
Will trading automatically resume after ten days?
It depends on the market where the stock trades. Different rules apply in different markets.
For stocks that trade in the OTC or the over-the-counter market, trading does not automatically resume when a suspension ends. (The OTC market includes the Bulletin Board and the Pink Sheets.) Before trading can resume for OTC stocks, SEC regulations require a broker-dealer to review information about a company before publishing a quote. If a broker-dealer does not have confidence that a company's financial statements are current and accurate, especially in light of the questions raised by the SEC, then a broker-dealer may not publish a quote for the company's stock.
In contrast to OTC stocks, stocks that trade on an exchange or Nasdaq resume trading as soon as an SEC suspension ends.
If the suspended stock resumes trading, why is it trading at a much lower price?
The trading suspension may raise serious questions and cast doubts about the company in the minds of investors. While some investors may be willing to buy the company's stock, they will do so only at significantly lower prices.
Why would the SEC take such action when it knows it will hurt current shareholders?
Because a suspension often causes a dramatic decline in the price of the security, the SEC suspends trading only when it believes the public may be making investment decisions based on false or misleading information. Suspensions give notice to current and potential investors that we have serious concerns about a company. A suspension may prevent potential investors from being victimized by a fraud.
How can I find out if the stock will trade again after a suspension?
You can contact the broker-dealer who sold you the stock or a broker-dealer who quoted the stock before the suspension. Ask the broker-dealer if it intends to resume publishing a quote in the company's stock.
If there is no market to sell my security, what can I do with my shares?
If there is no market to trade the shares, they may be worthless. You may want to contact your financial or tax adviser to determine how to treat such a loss on your tax return.
What can I do if the company acted wrongfully and I have lost money?
To get your money back, you will need to consider taking legal action on your own. The SEC cannot act as your lawyer. You must continue to pursue all of your legal remedies. There's at least 10 times as much oil spilling into the Gulf of Mexico than official estimates suggest, according to an exclusive NPR analysis.

At NPR's request, experts analyzed video that BP released Wednesday. Their findings suggest the BP spill is already far larger than the 1989 Exxon Valdez accident in Alaska, which spilled at least 250,000 barrels of oil.
BP has said repeatedly that there is no reliable way to measure the oil spill in the Gulf of Mexico by looking at the oil gushing out of the pipe. But scientists say there are actually many proven techniques for doing just that.
Steven Wereley, an associate professor at Purdue University, analyzed videotape of the sea-floor gusher using a technique called particle image velocimetry.
A computer program simply tracks particles, and calculates how fast they are moving. Wereley put the BP video of the gusher into his computer. He made a few simple calculations and came up with an astonishing value for the rate of the oil spill: 70,000 barrels a day — much higher than the official estimate of 5,000 barrels a day.
The method is accurate to a degree of plus or minus 20 percent.
Given that uncertainty, the amount of material spewing from the pipe could range from 56,000 barrels to 84,000 barrels a day. It is important to note that it's not all oil. The short video BP released starts out with a shot of methane, but at the end it seems to be mostly oil.
"There's potentially some fluctuation back and forth between methane and oil," Wereley said.
But assuming that the lion's share of the material coming out the pipe is oil, Wereley's calculations show that the official estimates are too low.
"We're talking more than a factor of 10 difference between what I calculate and the number that's being thrown around," he said.
At least two other calculations support him.
Timothy Crone, an associate research scientist at the Lamont-Doherty Earth Observatory, used another well-accepted method to calculate fluid flows. Crone says the flow is at least 50,000 barrels a day.
Eugene Chaing, a professor of astrophysics at the University of California, Berkeley, got a similar answer just using pencil and paper.
Without even having a sense of scale from the BP video, he correctly deduced that the diameter of the pipe was about 20 inches. And though his calculation is less precise than Wereley's, it is in the same ballpark.
"I would peg it at around 20,000 to 100,000 barrels per day," he says.
Chiang calls the current estimate of 5,000 barrels a day "almost certainly incorrect."
Given this flow rate, it seems this is a spill of unprecedented proportions in U.S. waters.
"It would just take a few days, at most a week, for it to exceed the Exxon Valdez's record," Chiang said.
BP disputed these figures.
"We've said all along that there's no way to estimate the flow coming out of the pipe accurately," said Bill Salvin, a BP spokesman.
Instead, BP prefers to rely on measurements of oil on the sea surface made by the Coast Guard and the National Oceanic and Atmospheric Administration. Those are also contentious. Salvin also says these analyses should not assume that the oil is spewing from the 21-inch pipe, called a riser, shown in the video.
"The drill pipe, from which the oil is rising, is actually a 9-inch pipe that rests within the riser," Slavin said.
But Werleley says that fact doesn't skew his calculation. And though scientists say they hope that BP will eventually release more video and information so they can refine their estimates, what they have now is good enough.
"It's possible to get a pretty decent number by looking at the video," Wereley said.
This new, much larger number suggests that capturing — and cleaning up — this oil may be a much bigger challenge than anyone has let on.

The moment we all have been waiting for is almost here. The motion to sell the company was filed on 6/2. There is a hearing on June 5th on the sales motion.
According to Docket #154, several bidders submitted bid on 5/18/09. The initial non-binding bids received reflected significant interest among bidders for the acquisition of all of Asysts'business.
Deadline for Qualified bidders shall be June 7th. If more than one qualified bidder, there will be an auction on June 9th at 3pm Pacific time.
All bidding thereafter shall be made in the form of an overbid. The bid procedure anticipates an overbid process for the Asyst US Assets.
No later than 6/8, qualified bidders will be notified.
There is no stalking horse bidder, hence no break-up fees. This bodes well for the estate.
Keep your fingers crossed and hope for a major bidding war!
