Damn. I remember when Burlington Industries lost their Nanotex division in a Chap 11 and got basically nothing for it. No one got anything at all. Criminal.
I guess we await to see what the new trustee has to say when he/she comes on aboard May 11 or thereabouts. Someone mentioned the possibility of attaching REM assets to the recovery under PA laws, etc. I know in the RMEC case the CEO lost everything he had in a personal Chap 7 and the shareholders got it all, after lawyers fees.
There will be active litigation for some time I am sure. Who knows what the common will get if anything. It seems the Unsecured Creditors Committee is still active so who knows.
Drifter - could the company or individuals under some kind of stock-based compensation plan be selling, simply because they need the money and can't wait (any longer) ?

The hearing on May 11 will tell us more as to what happens as far as whether we go Chap 11 or Chap 7. As Speed mentioned, there are still the insurance claims, and the activity of the Unsecured Creditors committee that we need to see get played out, then the Omnibus hearing on June 12, which I no real idea what that is for. WHAIQ as a stock ticker symbol and as a corporate entity is likely to be with us for some time, as I expect a lot of issues still need to be resolved. But I am not really having expectations about anything, though there is still a lot to be played out yet, the Pittsburgh newspaper article notwithstanding.
pfrenz - I decided to get 1M BKMP myself, though I wonder why the company wouldn't simply buy out the CD's instead of share buyback. Anyway, it appears they could be making money so why not. WHAIQ - the best hope here is the shareholders association with the unsecured creditors, similar to the WorldcoN case.
Someone has to knock out PERT who has been selling all the way down from .125 nonstop and pushing down on the ask.

Does it strike anyone as strange that on May 11 either a Trustee under Chapter 11 will be appointed (or conversion to Chapter 7) - if a Trustee under Chapter 11 is appointed it would suggest that a reorganization will take place, and that possibility has not been ruled out. At that point a SHC could once again be attempted to be formed under approval of the Trustee. With recent developments and the REM hearing today it might be possible that a SHC (if even necessary at that point) could be formed, with legal representation being financed by WHAI.
May 11 may not be the correct date as it was recorded in docket 268 but amended in docket 269. Docket 269 could not be retrieved to see what the amended date is.

OT: I decided to get into SPZI, scaling in my buys and sitting on a good block of shares. Just a matter of letting things simmer for a while and watch the doors get blown off later on this summer most likely if all goes well. I like it.

In particular, docket numbers 268, 269 (appointment of Trustee under Chap 11 or conversion to Chapter 7 on May 11 or ?? date), 282 (Omnibus hearing June 12), and 302 (request for information by Unsecured Creditors Committee) would be interesting.
So it seems it is yet too early to say whether or not the common shareholders are doomed. I suspect the efforts of the Unsecured Creditors Committee are for our benefit and at a glance it appears they are still busy.
I don't have a Pacer account. Shame on me. Maybe someone knows someboday who was at the hearing and can tell us.
Anybody know what happened at the hearing today ? Who won the auction - so far I have not been able to find anything, unless the documents have posted on Pacer already but I don't know the turnaround time.
Either someone knows something or some risk takers weighing risk/reward and figuring its worth a shot. Or someone trying to create a momentum run and take this for a joyride for no other reason than that they can. Oops back to .007 - it does not take much to move this thing in either direction. If we can hold some decent gain with volume that might set off some alarms and attract a crowd.

My WAG is 30% chance Alda and the consortium buy the assets, all claims are settled, existing shareholders are diluted but still hang on to .04 a share equivalent. Any recovery beyond this will have to settled in civil court. That is as optimistic as I can get.
I am prepared however to get nothing (70% chance).
GLTA - one way or another I hope everyone can at least find some closure soon.

FWIW I follow some the same stocks pfrenz is in. We have SPZI, WHAIQ, and QBID in common. I also have AANI, IESV, RSHN, and WNMI. I also like WLSF longer term but so far that has been a disappointment.

VWKM.......180m @.00018 - don't know
GZFX.......1.25m @.0095 - needs a push from somewhere
SPZI.......850k @.014 - this should go big within 4-12 weeks
BKMP.......47.5m @.0003 - convertibles are a problem here
QBID.......165m @.0001 - it has a chance now

I noticed yesterday on L2 that 3 of the market makers were open but had no bid. Could be they have enough shares in inventory or it was just a real slow day. The market makers do not necessarily have to put up an L2 that reflects outstanding orders.
I think someone mentioned that Bob had been just a little sick the last couple of days so he might not have gotten around to doing everything he wanted. Anyway why waste a PR going into a 3 day weekend.
I am pretty sure Palisades brought in Alda, who are turnaround specialists. The old consortium of major shareholders with Peterson still in the mix, may have aligned themselves with Palisades and Alda to participate in the auction and win the WHAI assets. Capsource can certainly be taken out by this alliance. Whether or not the assets can still be kept (returned ?) under the WHAI control is something I am wondering about. If so it will not matter whether or not we are in the money, so to speak.

Speed, do you have a feel as to what would happen to the class action lawsuit if Alda and the consortium win the auction and take the assets under 363 ?
STTK got bashed bad today by stocklemon.com - STTK put out a PR saying they are going to take them to court. It looks like AIDO contract is for more $$ than STTK's, and AIDO has only about 1/3 as many shares outstanding. If these guys can deliver we can sustain our current price and more.
My guess is they needed some seed money to get the project going. Sounds like they're pretty convinced this is all going to happen.
IMO when one sets "time lines" for "events" and then they are not met, one sets oneself and others up for the
"psychological fall" when actually conditions may have remained the same or have become better but not reported yet just another form of subliminal manipulation!

Baddog, don't let Instructmba fool you about what he thinks about r/s. He knows better. ERHE can never reach anywhere near full valuation on the OTCBB because there is simply not enough money there to push it. Yes it is possible to see some temporary instability in s/p if and when ERHE moves to a higher exchange but I think anyone who tries to short it at the wrong time will get their heads mailed to them in a plastic bag. HOWEVER, it would be better when ERHE can demonstrate better its reserves and value to the street at large first, before making its move off the OTCBB.
That time is not yet, IMO.

I would have to thank Ultimatepick for his tip as well, little doubt in my mind things will turn out in our favor here. Nice place to come to recoup some WHAI losses, though I still haven't given up the ship over there yet.
I bet these were lots of people sold at .0001 last week, especially on Friday when there was no bid. I don't beleive we will see too many .0001 sellers from here on out.

The IHub admin Matt assures us that the WHAI board will not be removed under any circumstances, so we will always have a place to discuss developments.
Same kind of thing happened to RMEC except the SEC revoked their registration and the shareholders of record on the date of revocation received a final settlement, though it was some months after the fact. I for one, will hold. Let 'er rip !!
I'll bet there were some rookies who panic sold and lost too. Not all this was profit taking.
