(BSNS WIRE) Mobility Infrastructure Revenues Decline 16% in 2002 According to Dell'Oro

REDWOOD CITY, Calif.--(BUSINESS WIRE)--Feb. 14, 2003--According to
Dell'Oro Group, in 2002 mobility infrastructure revenues declined 16%
to $28.8 Billion, compared to 2001. This figure included
GSM/GPRS/EDGE, TDMA, CDMA (all variants) and WCDMA.
In 4Q02, the market was up 15% compared to 3Q02 on seasonal
strength. Compared to 4Q01, however, the market in 4Q02 declined
nearly 5%. These figures are exclusive of service-related revenue
which adds 25-30% to the overall market figure.
WCDMA, which more than doubled compared to 2001, was not able to
offset declines in more mature technologies as both GSM/GPRS/EDGE and
CDMA declined in the mid-teens versus 2001. In 2002, WCDMA comprised
6% of total mobility infrastructure revenue.
"Looking forward, we expect that mature technologies will continue
to be under both price pressure and capital spending cuts by network
operators, and that the market will decline by nearly 10% in 2003.
Whilst we forecast that the WCDMA infrastructure market will grow to
nearly $4 Billion in 2003, these gains will be offset by further
revenue declines in the GSM- and CDMA-based infrastructure," says Greg
Collins, Director at Dell'Oro Group. "We do not expect the total
market to return to growth until 2004."

WASHINGTON, Feb 12, 2003 (United Press International via COMTEX) -- Optimism to
the point of delusion is the key force driving financial markets, said Daniel
Kahneman, last year's recipient of the Nobel Prize in economics.
"How else can you explain ... why you think you could beat the markets, better
than anyone else?" he asked alumni of Princeton University's MBA program in a
presentation late Tuesday.
The Israeli-born laureate is a professor of psychology at Princeton, and he won
the prize for his studies on behavioral economics, by integrating psychological
research into economic science. Specifically, his studies focused on how human
judgment might take shortcuts that systematically depart from basic principles
of probability.
One reason that rationality flies out the door and individuals take high stakes
in financial markets despite the odds is due to an exaggeration of one's skills,
Kahneman said. For example, most people think that they are good drivers -- yet,
if the vast majority were as skillful as they claimed to be, there would be far
fewer car accidents, he noted.
Another reason for optimism about financial gains is the "illusion of control
... which is the most damaging," he said.
Specifically, he noted that while ability can get people far, much is actually
dependent on chance and opportunity, both of which are out of anyone's control.
"Massive overconfidence underestimates the element of uncertainty," he said.
On the other hand, individuals tend to be thrown off by the way risks are posed
to them, as they are willing to take on some bets but not others depending on
how they are presented.
For instance, Kahneman said, people might eat 90 percent fat-free cookies but
not cookies that are labeled as containing 10 percent fat, though both labels
refer to the same product.
Similarly, he said, investors might be unwilling to take on a bet that states
there is a 50 percent chance of winning $15,000, with a 50 percent possibility
of losing $10,000.
But they might be more willing to take the risk if they were offered a 50
percent chance of gaining $15,000 in addition to their usual income, and a 50
percent probability of losing $10,000 from their income, though both proposals
mean the same thing.
As such, decisions might be swayed by the manner in which risks are framed,
Kahneman said. He added that investors tended to take decisions one small issue
at a time, which was not the most conducive to making profit. Moreover, he
pointed out that when investors had a mixed portfolio of winning and losing
stocks, they tended to sell off the winners, which often subsequently gain in
value.
"These findings are really depressing," said one MBA alumni attending the
lecture.
But interestingly enough, optimism is often a reflection of an individual's
cultural background more than other factors such as gender and income level.
"Americans are the most optimistic people in the world," Kahneman said, adding
that U.S. society broadly encourages and rewards optimism, while pessimism is
"seen as a sign of weakness."
"But in other cultures, Europe in particular ... optimists can be seen as simply
being naive," Kahneman said. Moreover, the two sectors that are especially
dominated by "huge optimists" are the financial sector and the military,
Kahneman said.
"Military generals, by their very nature, have to be very optimistic," he said.
Yet he pointed out that generals on two warring sides "cannot both be right,
expecting victory," as one side must lose in order for the other to claim
victory.
"And that optimism is alarming," he added.

WASHINGTON, Feb 07, 2003 (United Press International via COMTEX) -- If you
haven't heard about the "precautionary principle," you may do soon. Simply put,
this is the idea that any new technology or product must be proven completely
and utterly safe before it is introduced for general use.
It certainly sounds attractive. After all, we don't want dangerous technologies
killing untold numbers because their side effects weren't thought through
enough. However, the thing that differentiates the principle from good
old-fashioned common sense is that bit about technology being "completely safe."
Genetically modified food, for instance, has never harmed anyone; fears of
modified genes being transmitted to wild flora or killing off Monarch
butterflies seem to be overblown. Yet the principle is being used to halt the
introduction of the technology to areas like Africa or India where it could save
lives by preventing famine, because we're not 100 percent sure it's safe yet.
We see variants of the precautionary principle all the time. Cell phones are a
leading source of unfounded worry. Some biomedical researchers at Harvard, for
instance, recently declared cell phones unsafe because their tests discovered
that active cell phones might cause electronic medical equipment like
defibrillators or ventilators to shut down. Biomedical researcher Cheryl Iden
Shaw, admitting that most hospitals ask visitors to shut off cell phones, said
that doctors with active cell phones might cause a ventilator to shut off.
Shaw did not provide any evidence of this ever happening in an actual hospital,
rather than in a test lab. Doctors' use of cell phones has, of course, speeded
reactions and has probably saved many lives. Moreover, Shaw admitted that the
manufacturers of the ventilator that failed have upgraded the machine so that it
is no longer vulnerable to this problem. The problem is purely theoretical, yet
Shaw called for safety standards to be updated.
It is a good job researchers like Shaw were not around when fire was introduced.
We would probably still be huddling in caves, thankful that the dangerous new
technology was not blighting our lives
Another new danger that scientists have uncovered threatens the West Coast
particularly, it seems. The Silicon Valley/San Jose Business Journal reported
the findings of a study in the February 2003 European Respiratory Journal that
details a dreadful new condition called e-thrombosis.
It afflicted a young man from New Zealand, whose computer work caused a deep
vein thrombosis that resulted in a pulmonary embolism. It seems to be the fact
that the young man was sitting for prolonged periods of time at his computer
that caused the thrombosis, rather than any dangerous microwaves or some other
emanation from the device. In this respect, the condition is not new. As the
Journal mentioned, it has been known that sitting for long periods without
moving can cause thrombosis since the condition was discovered in people sitting
in deck chairs in air raid shelters during the London Blitz.
The Journal also mentioned that the young man was sitting at his computer for 18
hours at a stretch (perhaps not the right word, in the circumstances). Given
that astounding figure, it is a wonder that his legs had not withered away
before thrombosis had a chance to develop.
How do statisticians categorize Hispanics? "Variably" is the answer. Because
Hispanics can be of any race (Hispanic is an "ethnicity," not a race), Hispanics
are sometimes counted as white and sometimes as black. This can distort
statistics each way. For instance, for criminal justice purposes, most Hispanics
are categorized as White, so increasing the number of crimes committed by that
category.
Sometimes, however, Hispanics are counted as a non-white minority. This was the
case recently when a Harvard University Civil Rights Project study alleged that
the U.S. was "resegregating," because there were large concentrations of
non-whites in inner cities. A new study from the liberal Brookings Institution,
however, looking at the same data, separated out Hispanics from
African-Americans and discovered that, "for the third straight decade,
segregation between blacks and non-blacks across American metropolitan areas has
declined dramatically."
It found that Latinos, particularly families with large numbers of young
children, had moved into inner-city areas, leading to a boost in the number of
minority children in schools there. If they were counted as "non-white," it
seemed that segregation was increasing. If they were counted as "non-blacks,"
the reverse became true. The issue of race in America grows ever more complex.
Recent research from the Department of the Obvious: "People who chronically
doubt their judgments ... often feel anxious, are prone to sadness and mood
swings, and are likely to procrastinate and avoid thinking about difficult

STOCKHOLM, Feb 6 (Reuters) - Loss-making telecoms equipment
maker Ericsson named Swede Carl-Henric Svanberg as its new chief
executive on Thursday, ending months of uncertainty and driving
its battered stock some 12 percent higher.
The appointment of a new boss extends the sweeping changes
at the top for troubled Telefon AB LM Ericsson <ERICb.ST>, the
world's biggest producer of mobile networks, after it took on a
new chairman and fresh board members last year.
Chairman Michael Trescow has been a driving force behind the
overhaul in his bid to return the company, which has been in the
red for nine straight quarters, back to profit. Battling a
shrinking market, Ericsson expects to return to profitability
only towards the end of this year.
Markets welcomed the appointment of a man who has a
reputation as a cost-cutter and strong manager despite the fact
he has no experience of the telecoms industry.
Svanberg, currently head of the world's leading lock maker,
Assa Abloy <ASSAb.ST>, will take over as Ericsson CEO on April 8
from Kurt Hellstrom, who has served as president of the company
since 1999 and as CEO from 2001.
A senior Ericsson source told Reuters Svanberg, who turned
50 last year, had been the only candidate proposed to the board.
"The board wanted a candidate who was a Swede, a well known
chief executive of a listed company, and well below retirement
age," the source said.
Hellstrom will turn 60 in December this year, often the
retirement age in Sweden. He has been struggling to slim down
Sweden's biggest company since he took the helm from
Sven-Christer Nilsson -- who was sacked for not restructuring
the company fast enough.
Ericsson, like its rivals in the sector, has been hit by the
falling demand for telecoms equipment from operators, many of
whom are struggling under piles of debt which they have to
service amid a slowing world economy.
But Hellstrom has been heavily criticised by the media and
some investors for not acting decisively enough to prevent
Ericsson's mobile handset business, once the third biggest in
the world after Nokia <NOK1V.HE> and Motorola <MOT.N>, from
withering.
MEDIA-SAVVY
With the bulk of Ericsson's cost-cutting scheme already in
place, Svanberg's job will be to make sure that the company
meets its targets of reducing its workforce to below 60,000 by
end-2003 from just above 64,000 at the end of 2002, in order to
reach a planned break-even on sales of 120 billion crowns.
Svanberg is regarded as more media-savvy than Hellstrom, who
often appeared uncomfortable in the spotlight.
Investors welcomed Svanberg's appointment and by 1108 GMT,
Ericsson shares were up 11.9 percent at 6.55 Swedish crowns.
"It is positive for Ericsson and the market that the issue
(of succession) is solved," said Marianne Nilsson, fund manager
at Sweden's biggest fund Robur, which has 3.3 percent of votes.
"Our view is that Svanberg is a person with good management
skills, well-known and with international experience. He has
created a good corporate culture and results at Assa Abloy."
Assa Abloy stock fell 10 percent in Stockholm on
disappointment that the CEO was going and as the company's
fourth-quarter results came in just below market forecasts.
"(Ericsson's) incoming CEO has a reputation for excellent
cost cutting and acquisition integration. Cost-cutting is very
much needed at Ericsson," said one telecoms equipment analyst.
Ericsson shares lost a quarter of their value over Monday
and Tuesday after the company reported weaker-than-expected
fourth-quarter earnings and said it expected a further fall in
sales this year.

Svanberg, currently CEO of the world's leading lock maker, Assa Abloy, will take over as Ericsson CEO from Kurt Hellstrom on April 8, Ericsson said in a statement.
Hellstrom became president of Ericsson in 1999 and CEO from the start of 2001. Analysts welcomed the move and at 4 a.m. EST, Ericsson's share was 11 percent higher at 6.55 Swedish crowns.
"Ericsson's appointment of a new CEO is great news for the stock. He was previously CEO at Assa Abloy and was well respected there," said one telecom equipment analyst in London.

Assa Abloy stock fell 10 percent in Stockholm on disappointment that the CEO was going and as the company's fourth-quarter results came in just below forecast.
Ericsson, the world's leading maker of mobile telecoms network infrastructure, has posted losses for the past nine quarters as debt burdened telecoms operators have reduced investments in networks.
Its stock tumbled more than 20 percent earlier this week after the company reported weaker-than-expected fourth-quarter earnings and said it expected a further fall in sales this year.
Svanberg, who has been among the potential candidates mentioned by financial market analysts, "will continue ... Hellstrom's successful work in controlling Ericsson's costs, while keeping up our leading market position," Ericsson Chairman Michael Treschow said in the statement.

(COMTEX) B: Mobile Phone Exposure Causes Brain Damage in Rats; Study Published Today in
Environmental Health Perspectives Finds Significant Impact and Raises Questions
about Use
RESEARCH TRIANGLE PARK, N.C, Jan 29, 2003 (BUSINESS WIRE) -- A study published
today in the online edition of the peer-reviewed journal Environmental Health
Perspectives (EHP) found for the first time that electromagnetic fields (EMFs)
emitted by certain mobile phones damaged neurons in the brains of rats.
The researchers studied 12- to 26-week-old rats because their developmental age
is comparable to that of human teenagers, who are some of the heaviest users of
mobile phones.
"The situation of the growing brain might deserve special concern," the study
authors wrote, "since biological and maturational processes are particularly
vulnerable. We cannot exclude that after some decades of often daily use, a
whole generation of users may suffer negative effects as early as middle age."
Three groups of rats were exposed for 2 hours to GSM mobile phone EMFs of
different strengths. GSM, which stands for Global System for Mobile
Communications, is the main standard for mobile phones used in Europe, as well
as in many countries in the Middle East and Asia. GSM is one of several
standards by which mobile phones in the United States operate.
The study found that EMF exposure was associated with leakage of albumin through
the blood-brain barrier and neuronal damage that increased in response to the
amount of exposure. The authors acknowledged that the study sample was small,
but stated that "the combined results are highly significant and exhibit a clear
dose-response relation."
Earlier EMF studies have focused on whether exposure might cause cancer, with
some studies finding increased risk but most showing no effects or even
decreased risk.
"Scientists have been looking for some time at the possible effects of exposure
to the energy coming out of cell phones," says Dr. Jim Burkhart, science editor
for Environmental Health Perspectives. "These scientists decided to look in a
new place, studying potential nerve damage, rather than cancer growth. Their
results suggest a strong need for further study as we all rely on cell phones
more and more."
The study team was headed by Leif G. Salford of the Department of Neurology at
Lund University in Sweden. Other authors include Arne E. Brun, Jacob L.
Eberhardt, Lars Malmgren, and Bertil R.R. Persson. The study will appear in a
future print issue of EHP.

NTT Docomo to Replace Battery in 840,000 NEC Phones

TOKYO (Reuters) - Japanese mobile phone giant NTT DoCoMo said on Wednesday it would replace the battery packs in about 840,000 camera-equipped mobile phones made by NEC Corp. due to a glitch that caused handsets to overheat.
The move, affecting the hot-selling "N504iS" model, is the biggest-ever replacement or recall by DoCoMo, Japan's largest mobile phone operator.
DoCoMo and NEC are still estimating the cost of the replacement program and are discussing how it will be split, a DoCoMo official told a news conference.
DoCoMo, Japan's No.2 provider of photo-taking phones, said eight instances of overheating had been reported since the model was launched in late November -- one case for every 100,000 units sold. The model is one of DoCoMo's 10 camera-equipped phones.
DoCoMo will mail new battery packs to all users starting in mid-February. It will suspend new sales of the N504iS until all existing handsets are replaced, probably by the end of March.
An NEC spokeswoman said the impact of the replacement program was not yet known as it was still investigating the problem.
DoCoMo said the problem was caused by a hardware conflict between the battery pack and handset, which in some cases reached temperatures of up to 212 Fahrenheit.
The model is more prone to overheating due to its thinness -- just 0.8 inch, an official said.
DoCoMo has reeled in more than five million users for its photo-taking handsets in just over seven months since the launch of its camera phones.
There were about 15 million camera-phone users in Japan as of the end of December.
Shares in DoCoMo ended down 0.43 percent at 233,000 yen before the news. NEC shares lost 6.22 percent to 437 yen, in line with sharp falls in the high-tech sector.

Ericsson Mobile Communications and Report the Joint Venture's Fourth Quarter
Results
Jan 29, 2003 (Hugin via COMTEX) -- Tokyo and Stockholm, January 29 -- Sony and
Ericsson today announced that the two companies have decided to make an
additional capital injection to their 50:50 jointly owned Sony Ericsson Mobile
Communications, AB ("SEMC").
In order to strengthen SEMC's capital structure and support business expansion,
Sony and Ericsson have decided that during the quarter ending March 31, 2003,
each company will contribute Eur 150 million to SEMC. This capital injection
represents the continuing commitment of Sony and Ericsson to the joint venture.
SEMC estimates that approximately 115 million units were sold (sell-through) in
the total market during the fourth quarter and approximately 395 million during
the full year of 2002, compared with approximately 390 million in 2001. SEMC
forecasts that total market sales will be approximately 435 million units during
2003, representing year-on-year growth of about 10%. Sony and Ericsson today
also announced SEMC's fourth quarter results ended December 31, 2002. Units
shipped in the quarter reached 7.1 million, which is 4% higher year-on-year and
42% higher compared to the third quarter. Net sales for the quarter were Eur
1,235 million, representing year-on-year and sequential increases of 18% and
42%, respectively. Income before taxes in the quarter was Eur -77 million and
net income was Eur -69 million, which represent year-on-year improvements of Eur
75 million and Eur 70 million, respectively. Note: As a 50:50 joint venture, 50%
of SEMC's results are reported by Sony and Ericsson as a joint venture accounted
for under the equity method.

its U.S. operations, consisting of T-Mobile USA, Inc. and Powertel, Inc., both
of which operate under the T-Mobile brand.
The T-Mobile USA results reported in this press release include Powertel's
results.

we increased our customer base by more than 40% in 2002," said Robert Dotson,

In the fourth quarter ended December 31, 2002, T-Mobile USA added 1,017,000 net
subscribers compared to 869,000 in the third quarter and 667,000 in the fourth
quarter 2001. Net contract subscriber additions amounted to 1,078,000 in the
fourth quarter of 2002. Contract subscribers now comprise 86% of the 9.9 million
customer base compared to 74% at the end of 2001. Contract churn was 2.45% in
the fourth quarter, down from 2.60% in the third quarter and down from 3.30% in
the fourth quarter of 2001. The pre-pay customer base decreased by 61,000 in the
fourth quarter as the company continued to emphasize its contract business.
For the year ended December 31, 2002, T-Mobile USA added 2,923,000 net customers
(including 73,000 from acquisitions). Net contract subscriber additions during
2002 amounted to 3,388,000 (including 45,000 from acquisitions). The pre-pay
customer base decreased by 465,000 in 2002.

Lego wins landmark Chinese court victory in piracy lawsuit

Lego yesterday claimed a landmark victory in the war against copycat manufacturers after a Chinese toymaker was found guilty of infringing the Danish company's copyright.
Lego, renowned as a vigorous defender of its intellectual property rights, said this was the first time the Chinese legal system had delivered a judgement confirming copyright protection of industrial design and applied art.
The judgement is viewed as precedent-setting because it establishes the possibility of gaining "double protection" under China's legal system. This allows a company to register design protection and simultaneously obtain copyright protection for a product in the courts.
"This is a remarkable ruling which is sure to play an important role in the future as more and more companies have to watch copies of their products being made and sold in China," said Henrik G. Jacobsen, Lego's intellectual property lawyer.
Other legal experts, unconnected with the case, agreed that the ruling was a breakthrough. "The Chinese government has been making some strides in recognising and protecting international intellectual property rights in recent times. It is reassuring to finally see some concrete evidence that this is leading to improvements on the ground," said Richard Woulfe, a partner and IP specialist at Mason, Hayes and Curran in Dublin.
Lego began its legal action against Coko Toy Company of Tianjin in 1999 after discovering Lego-lookalike elements in a range of childrens' playsets, including castles and pirate ships.
The ruling, delivered by the Beijing High People's Court, means that Coko must halt production of the copied items and turn over the relevant moulding equipment to the authorities for destruction. It also has to publish an apology in the Beijing Daily and pay symbolic compensation.
Since Lego's eponymous interlocking bricks were patented in 1958, the company has fought court cases all over the world.
Dozens of cases against copycat producers are brought every year, Lego said yesterday. Some cases go to trial while others are settled out of court when the pirates realise the odds are against them.
However, legislation varies depending on the jurisdiction. Last month, Lego lost a case against the Canadian company Mega Bloks for copyright infringement in Switzerland.

(COMTEX) B: SAMSUNG, LG CHOSEN AS PRIORITY PROVIDERS FOR SK IMT'S W-CDMA
SEOUL, Jan 21, 2003 (AsiaPulse via COMTEX) -- SK IMT, one of the nation's two
asynchronous-mode IMT-2000 licensees, said Tuesday it has selected Samsung
Electronics (KSE:05930) and LG Electronics (KSE:66570) as priority equipment
providers for the Wideband-Code Division Multiple Access (W-CDMA) service.
"We selected the two out of five, including Nokia, Nortel Networks and Alcatel,
after reviewing their letters of intent," the company said.
The third generation (3G) mobile phone service subsidiary of SK Telecom will
consult with the last two candidates over conditions, compatibility between
equipment or service functions as well as a function to work with the dual-band
dual-mode, in order to choose the winner.
The nation's No. 1 mobile phone service operator SK Telecom plans to statutorily
merge with SK IMT in April and launch the commercial W-CDMA services in
September or October.
Meanwhile, KT ICOM, the other asynchronous IMT-2000 licensee and 3G mobile unit
of the nation's fixed-line telecom giant KT, had started building W-CDMA
networks with LG Electronics in September.
KT will merge with KT ICOM and is scheduled to begin the test service in April
and the commercial service in June.

The pic was taken just north of mile marker 197 on I35 in Oklahoma (north of OKC) -- we're in the median, having come up from the south and then pulled around in the median to be pointed south (in case we needed to run). At that very moment I was trying to convince my compatriots that we should swing back around onto the northbound lane and get closer; they were chicken and wanted to run to the south; so we split the difference and stayed there until the F6 had crossed I35 (flattening mile marker 200, and various other things, in the process) before we finally headed north.
The effect where the tornado crossed I35 was genuinely mind-boggling. In particular, a large horse that had been picked up more than half a mile west of I35 had been slammed into one of those super-heavy guardrails, the type that barely gets scratched if an 18-wheeler hits it, on the east side of the northbound lane, so hard that an entire c. 15' length of the guardrail was bent to the east by up to a good 3'+ -- the horse, jammed into and under the guardrail at the point of maximum distortion, had no tail or ears left, just ripped off, with other pieces of its hide missing, including bones exposed, here and there as well; its mouth and nostrils were absolutely stuffed full of thick mud; each of its legs had at least one compound fracture; etc. (I don't think it suffered; sure looked like death had come very quickly, anyway . . .) As the tornado then moved on to cross U.S. 77, a few miles east of I35 (and still well in our view), it not only completely stripped the (very solid, very good condition) asphalt right off of the underlying concrete base, but it also actually gouged grooves in that underlying concrete base, and even ripped some pieces right out of that underlying concrete base (. . . -- !!). Fortunately, this tornado remained in rural areas; no human fatalities, and just a few injuries [it was SO visible, from miles away]; something like 2,000 head of cattle, along with some other animals, did however buy it -- later that evening, as I ate dinner at a cafe in a nearby town, I heard people saying that they'd found (what was left of) some head of cattle more than 20 miles from where they were suppposed to have been (again, . . . -- !!) (the locals were hurriedly trying to get organized to get the carcasses to the area slaughterhouse).
And it really was an F6 (the 'experts' just don't want to admit they exist, after having said for so long that F5s are as strong as they can get) -- by definition, 318 mph winds at ground level are the upper limit of an F5; doppler radar observations plus the several excellent videos of this event make it very clear, IMO, that the max ground-level winds in this event were at least somewhere in the 330-350 mph range. (The Moore tornado that tore through the south side of OKC on May 3, 1999 was also definitely an F6 -- in fact, a virtual twin of this one that I saw.)
(I only found this picture about 24 hours ago, when I went searching the web for a pic to add to my signature -- I'd never seen it before, didn't even know it existed.) (I do remember the van that pulled over on the right shoulder of the northbound lane, just to our south, and then after a minute or two crossed over the median and took off southbound . . .)

take another look at the pic -- do you see anything in the background? -- a large dark mass reaching to the ground from the (rapidly rotating wall) cloud above? perhaps a monster 1-mile-wide F6 tornado, about 2 miles to the NNW, that was moving steadily ENE at 35 mph, and was still growing (reaching over 1-1/2 miles wide just minutes later)?
and in the foreground is a second F6 . . . (the dark car in the foreground is a 1982 280ZX 2+2 Turbo, jade gray in color, with about 100k miles on the odo) (now, how would I know that . . . ??) (just intuitive, I guess . . .)

(COMTEX) B: Stripper Can't Deduct Implants on Taxes
STOCKHOLM, Sweden, Jan 14, 2003 (AP Online via COMTEX) -- You can't deflate
your taxes by inflating your chest, a Swedish stripper learned after a
three-year legal battle to deduct the cost of her breast implants from her
income taxes.
An appeals court in Stockholm sided with the latter and ruled the 25-year-old
woman's 26,000 kronor (US $3,000) breast enhancement surgery could not be
deducted from her 1998 income taxes.
The woman, whose name was not released, claimed the "size and shape" of her
breasts were crucial to her income as a stripper. She listed the cost of the
surgery as a business expense and sued the tax authorities when they rejected
her deduction.
In its Jan. 9 ruling, the administrative court of appeal in the Swedish capital
upheld the decision of a lower court, saying the surgery wasn't commercial, but
private.
The woman's defense lawyer, Christer Transby, said Tuesday that the courts had
treated his client unfairly because of her profession. He said other performers,
including opera singers and dancers, were permitted deductions for different
types of cosmetic surgery, although the benefits were more private than
commercial.
"She derives absolutely no pleasure from (the surgery) privately," he said.
"It's of 100 percent commercial interest."
Transby said his client had not yet decided whether to appeal.
Danish tax authorities turned down a similar appeal by a stripper there in 2001.

Thanks for pointing out that the situations are not perfectly analogous. (I actually knew that -- in particular that QCOM hadn't yet been infringed; but QCOM was operating from a rather different footing in its case, now wasn't it?)
I was simply, and I believe correctly, inferring that it would hardly be inconsistent of ERICY to once again settle on, or very near, the proverbial courthouse steps.
