Finally! I found the old deleted posts about the Electric Witches and the cult. Ercilia (wife of FBI agent?) has a Louisiana address.
The lawsuit against the FBI agent was filed the first week of Nov. 2006. She claims it coincided with nufced leaving the CMKX RB message board, and that nuf was being investigated because she works for RB and shorty. Bad girl nuffie! lol
She also claims between August/Sept 2006 she was attacked and ended up in the hospital because of three "laser-like burns" that caused severe bleeding. Her doctor told her she had an ulcer, but she believes it was the laser burns. Could this be what the lawsuit is over?

It happened again! A second court has ruled in favor of PIPE deals. This should officially put to rest the argument that PIPE deals are technically NOT naked shorting. Never were! So stay away from stocks that make PIPE deals, imo.

PHILADELPHIA (HedgeWorld.com)—Despite a last-minute effort by the Securities and Exchange Commission to explain why he shouldn't, a federal district court judge in Pennsylvania followed precedents set recently by colleagues in New York and North Carolina, ruling against an SEC position about the registration requirements for private investments in public equity, or PIPEs.
The underlying dispute in this case, in U.S. District Court for the Eastern District of Pennsylvania, is as it was in the other two forums. According to the law, if an issuance meets certain requirements, PIPE securities are exempt from the registration mandate of the Securities Act of 1933. But the SEC has long contended that when a company short sells the securities it intends to buy through a PIPE transaction, it falls outside the scope of this exemption, and so illegally sells non-exempt unregistered securities. This is known as a Section 5 violation.
The Pennsylvania district court judge, Eduardo Robreno, granted a defendant's motion to dismiss the Section 5 aspect of a lawsuit filed by the SEC against Robert A. Berlacher and the hedge funds Mr. Berlacher controlled Previous HedgeWorld Story. Mr. Robreno denied the motion to dismiss as to another aspect of the lawsuit, which amounts in essence to an insider trading theory, and he ordered that the complaint be amended so that the phrase "PIPE information" will be explicitly defined.
In its complaint, filed in September 2007 Previous HedgeWorld Story, the SEC listed 10 distinct PIPEs transactions in which it alleged that the defendants had employed an illegal trading scheme, realizing more than $1.7 million in illegal gains.
On Jan. 18, the eve of a three-day weekend and only five days before oral arguments on the motion to dismiss, the SEC filed a "surreply," presenting new arguments as to why this court shouldn't follow the examples of those of North Carolina—where a judge threw out part of an SEC lawsuit accusing hedge fund manager John Mangan of insider trading and selling unregistered securities Previous Reuters Story— and New York, where a judge did essentially the same thing in a case against Gryphon Partners, a family of Dallas-based hedge funds, and associated entities, and against Gryphon's Chief Investment Officer, Edwin Buchanan Lyon IV Previous HedgeWorld Story.
Those courts had concluded, for example, that because the short sales undertaken by PIPEs purchasers involved securities the sellers didn't own, they weren't truly "sales" in the sense that requires registration.
In its Jan. 18 brief, the SEC said the other courts had erred because the statute defines "sale" quite broadly, including "every attempt or offer to dispose of … a security or interest in a security, for value."
In response, defendants in the Pennsylvania case contended that the issue isn't whether a statutory sale takes place, but when. The sale doesn't take place when the contract to make a sale is entered into. It takes place later, when the PIPE sales are used to cover the short position. Accordingly, no purchaser of securities from the defendants received any PIPE shares that were restricted at the time they were received.
In a statement after the court's ruling, attorneys for the defendants said that they were pleased, "because the SEC raised new and different arguments in support of its Section 5 and related claims that were not raised in the earlier Mangan [North Carolina] and Lyon [New York] cases, yet the Court saw through those arguments and reached the right conclusion, fully in line with how the Third Circuit views a transaction of this sort and how both the Mangan and Lyon courts view this type of PIPE transaction, including the shorting and covering of the trades with registered PIPE shares."

purporting to be Ron Paul supporters.
I have heard other journalists make similar accusations

Late Friday afternoon I got a call from Mr. Robert Green of the SEC's office of Investor Relations. He was responding to the Jan. 18 letter I had written on behalf of our group to Chairman Cox. I started explaining to him a bit of the USXP story since he first acted like he knew very little about this case, but then he mentioned something about the SEC suing the company, etc. I quickly set him straight on that. The main reason he called was to say that the request contained in the letter viz; for the SEC to open its books on USXP, can only be fulfilled through a Freedom Of Information (FOI) Request. He asked me to email him about this request and he would forward it with the letter to whomever within the SEC to see if they could look into it. His email addy is greenr sec.gov. If you desire, write to him saying you belong to the shareholder group, referring to that letter to Cox and reinforcing our group's request for that information.

If the earnings were better than expected, some way would have been found to say something about that before the Jan options expired. It's hard to see an an EBITD profit. They can't use the one time charge reversal "revenue" trick again. Maybe they will exclude free shipping as an expense.

Cyberstalking, Pretexting: Doesn't Judd Bagley Have Anything Better to Do?
Overstock.com's nauseating house stalker, Judd Bagley, has been busy lately.
Not at Overstock.com, where the OMuse "Wikipedia wanna-be" that he was supposedly hired to run has languished --two new articles were commenced so far this year, and both consist of about five words each so far. It still remains in "beta" one year after being launched.
No, instead he's been working hard, doing what he is paid to do, which is to harass and stalk people on Internet message boards and Wikipedia.
He posted messages like this on a Yahoo message board that sent users to Overstock's stalker website, antisocialmedia.net, and then bounced them back to Yahoo, where a script was initiated to put on "ignore" messages posted by fraud-fighter Sam Antar and another Overstock critic. Here's a post from Internet sleuth Scipio Africanus explaining how it was done.
Lastly, Bagley engaged in a bit of crude pretexting, sending a forged Wikipedia page to a Wiki administrator from the email address garyweiss.mail at gmail.com. (I originally said "probably Bagley" but the genius later boasted on an anti-Wikipedia website (below) that the pretexting and forged email was his.)
My email address is garyweiss.email at gmail.com. The aim was to demonstrate that a Wiki user he doesn't like, "Samiharris," is me. To gild the lily, a spyware script was added to the email.
"garyweiss.mail@gmail.com" has never been my email address, and I did not send that email.
Bagley fed a similar forged email to a reporter for a British Internet tabloid who was working on an anti-Wikipedia hatchet job. British libel laws being as they are, the tabloid did not mention the forged email.
Bagley's skirting close to, if not exceeding, a violation the law with his crude pretexting gambit. I guess it would depend on how teed off the prosecutors would be, if they decide to go after him for his latest sliminess. Since he's clearly engaged in this activity on behalf of Overstock, thereby doing it for gain, I'd imagine what he's doing is more likely than not to be illegal.
What's he done is actually worse than what happened at Hewlett-Packard, since what he's doing here is not to gather information, but to plant disinformation.
But since when has the law ever stopped Judd Bagley from serving his masters at Overstock?
It's certainly not ethical, but then again the word "ethics" has been ripped out of the dictionary at Overstock.
Aside from the usual, nutty, self-destructive obsession with sabotaging message boards and Wikipedia -- which loom large in the fevered brain of Overstock CEO Patrick Byrne -- the aim, of course, is to divert attention from Overstock's stinky finances and its plummeting share price.
The Street consensus is a small profit in the fourth quarter, the first in memory -- though with Overstock's accounting being so shady it's hard to say if a "profit" would really be a profit. My question is: does Bagley crawling out from under a rock mean it will be worse than expected?

Probably the bidder didn't meet the seller's reserve, and the auction ended without a sale being made.

We don't know everything. And there are many things we can't explain.
When changes occur, which happens almost daily, we report them ASAP then return to the work of sifting through disinformation.
We try not to "go out on a limb" with these update's as being wrong is embarrassing and affects our credibility. The rules are not "hard and fast" but generally speaking we have talked to a dozen or more sources before reporting to you or else we clearly state otherwise, i.e. one source says this or one source says that.
Last night ALL sources agreed deliveries would be today. Of course we can't identify sources but as we have said before they are Trustee's, Bankers, Military, Treasury, Attorneys, Brussels, Frankfurt, Asia, etc.,etc.,etc.. When all are on the same page as they have been the last two days we are very comfortable with the information provided to you. Then something else happens, or doesn't happen and we must begin again.
Already this morning we smell a rat.
More trades (4) were attempted overnight and blocked by the good guys. This should have ended with the recent agreements. BUSH is Jeckyll and BUSH is Hyde.

Time and time again we have encountered "steps" we didn't know existed until after the fact. By way of example, if a deal got made to accommodate the State of the Union speech before funding we might not learn of that for two or three days. We have no such information, just giving an example.
It is unfortunate CHRISTOPHER STORY went silent on us. We were often able to use his information as a "crowbar" in our work. One possible scenario which we have alluded to before is massive disinformation on a world scale. And the more times that "fool proof" information results in no deliveries the more possible this scenario becomes. If this is the case and we are caught up in a web of deceit along with the sources mentioned above then we don't know when we will overcome it as we are only as insightful as our sources.
Consider the hundreds of billions being pumped into the extinct system here and abroad. WHY?? Consider the stimulus package. WHY,...if debt forgiveness for the public is on the horizon??
We can't explain these obvious opposites of expectations.

Yep. If we do not get OUR ROI and the money we EARNED through our years of trading and investing in the market looking for the next microsoft.. WE FOUND it... and 'they' sabotaged the company...and I'm sorry, they can take their $9,999.00 and stick it...but it does buy a lot of spray paint.
So...this is the low budget revolt plan which is 100% volunteer basis and of course all plans of getting our extracted value and righting a monumental wrong are on the table. This is the just the low budget plan.
We all get cans of spray paint and paint GOT CMKX all over every building... (we'll have to look at the penalties so we can keep the counts low)...
THEN if we don't get caught..it could make the news if it's synchronized
AND if they charge us.. we get a jury trial (which is free to us), and we tell them it was crime of passion and tell all the juries the truth about what the Federal Reserve/SEC/Gov't did to us and the JURY...what the DTCC did.... and we can even get a court appointed attorney (free) OR we can represent ourselves with our extensive documentation.
$9,999 dollars is enough for some spray paint!

We have been wronged and we are in the right. They are in the wrong. We have the law on our side but not the means to bring about our justice and expose the crime of the century.
But there is more than one way to skin a cat.
WE can calculate how much it would take to remove the graffitti (sp?) and put it against the amount of money stolen from the loophole in the clearing system over the past 25 years +/- and we're doing it for the good of the people against the crooks.

A question we need to ask Matt. Why are so many on-topic posts being deleted?
I just a had post (14088) deleted from that board for no good reason. It was NOT a TOS violation. Can someone tell me how I go about requesting the post be restored? TIA
