The Markman hearing puts a legal gun to defendants heads. That's when the full nature & extent of infringment, in addition to trade secrets, come out publically in court. You'll recall that's when Microsoft settled with SFOR. I'm looking forward to when Mr. Wolfe, our lead attorney at Blank Rome initiates that Markman hearing. It then becomes a game of Russian roulette for the defendants. Their primary question will be, is the next chamber loaded or not? If it is, they stand to lose big time with treble damages. Yeah, the last R/S took place in a dark time for SFOR before the sea change event of the Microsoft settlement payment. This company is no longer struggling to survive but planning on just how to thrive IMHO.

I believe he will try to do so. The only thing that could possibly prevent it is Congress. By the Constitution they have the power of the purse. That is exactly why I wrote all 535 members of Congress & encouraged others to write their Senator and Representative. The Congress that was recently sworn in has a greater number of veterans than recent earlier ones. This is due to members having served in America's longest war, the war on terror (15 years and counting) then returning home to run for office. These men and women know that good COMSEC saves troops lives. They will realize the gravity of the situation of these unprotected, military issue I-Phones. I believe, they will act to fix this chink in our armor, with the best defensive software, once they have been made aware of it.

That's possible but not probable until the judge brings some more clarity to the issues IMHO. Once that judgement is rendered then a buyout could happen in short order. However, the more likely game changer would be scheduled Markman hearings. Once the defendants know they will have to reveal the exact nature & scope of their infringment, how they profited off it and most importantly trade secrets I believe they will toss in the towel like Microsoft did.

No kidding! New Administration. They may incorporate elements of the Obama Administration's efforts in the new National "Anti-Hacking Plan" or not. It's their call. However, the previous efforts at least brought together the appropriate parties to work with one another. It was a fine starting point. Once the plan is complete (90 days following Senator Coats confirmation as ODNI) we'll know what the score is and where the Trump Administration is headed cyber security wise.

IMHO Singapore Telecom then must consider purchasing SFOR. They rolled out their 2-FA, OOBA mobile banking service to all their customers in Asia this Oct on Singapore's "Cyber Day". If they want to expand this service into the lucrative US market through their subsidiary, Trustwave need that patent. Otherwise, they set themselves up for another IP infringment legal battle. Fool me once shame on you, fool me twice shame on me. I don't think Asia's largest telecom provider is foolish. Do you?
