The Markman hearing puts a legal gun to defendants heads. That's when the full nature & extent of infringment, in addition to trade secrets, come out publically in court. You'll recall that's when Microsoft settled with SFOR. I'm looking forward to when Mr. Wolfe, our lead attorney at Blank Rome initiates that Markman hearing. It then becomes a game of Russian roulette for the defendants. Their primary question will be, is the next chamber loaded or not? If it is, they stand to lose big time with treble damages.
