loophole73, I thought that the 1st quarter actually means the last quarter of 2004 (with the new revenue recognition) and if there is a settlement (unless some adjustments are recognized towards past quarters) we would see the effect in the 2nd quarter of 2005. Am I correct? please correct.

olddog967, thanks. If the DE court action is only effecting the CDMA2000/WCDMA overlap patents (as per texb's message), then shouldn't IDCC get paid irrespective of this lawsuit based on other WCDMA patents that it holds. Things are really getting interesting.
With this new CDMA2000/WCDMA overlap discovery regarding NOK lawsuit, how does the NOK license ending in 2006 will play out? TIA

Is NOK currently selling any WCDMA technology phones or infrastructure anywhere? Texb, thank for the info. This sheds light on the NOK 3G fight. It could be the indemnifier/libility issue as L2V referred. Anyway, feeling lot better already.

I guess IDCC will be looking for the whole enchilada if there is a settlement (3G deal might be the only incentive to budge a little on the 2G deal) or else it will be a panel decision that should serve as a warning to all infringers out there. IMO, panel is pretty much ready with the decision and is just holding off on it to give the parties some time to discuss. If the parties think (particularly if IDCC thinks) that they are not heading anywhere, they can inform the panel about the stand off and we would immediately get a decision. I am still expecting something within a month.

ziploc_1, how can you conclude that? Trying to understand if you are seeing any indications. These kind of settlements usually are very complicated and take longer time (covering all fronts and leaving very little wiggle space). Remember the Ericy settlement, I guess it almost took 2 months after they decided to settle (they pushed the trial date by 2 months in Jan, 2003 and the settlement was announced in Mar, 2003).
My point, settlement could still be in works.
With this company, a negative news can leak (as we saw during Mar, 2004 earnings and we had a $10 hair cut)....but a positive news never leaks (llok at the volume during the week before Ericy settlement)

ams13sag, I as wondering about all the three (stock grant, earnings date announcement and rumor) happening on the same date (2/28/05). Since they all got stock grants just a couple of months back, it seems logical that these new grants must have been tied to some accomplishment. IMHO.

ams13sag, I guess it could be just that people are in wait and jump mode and till than the manipulators are playing it like a fiddle. Any small buy interest should push the price up pretty decently (like it did yesterday). Leaks of something negative would have caused heavier volume (like the one that we saw in Feb/March of 2004...unexplainable weakness accompanied with large volume before earning). So, I would rule out negative leaks at this time. I hope KOP breaks the silence with a melodious tune.

How come no one talked about loss yesterday when the stock was up in spite of market weakness (except for the closing action which took it down by a mere 4 or 5 cents). It is funny how people come out and start speculating on a down day.

How can loss be in the cards? They gave an Upped revenue guidance somewhere towards the end of Nov, 2004 and I don't think the legal expenses have jumped up in just one month (Dec, 2004). As far as the forward guidance of legal expense is concerned, we have a new income source that could easily eat it (GD contract 18 mil). IMHO this is just a weakness spawned out of skepticism and someone feeding on it.

IDCC might have said "On or Before" because at some point if the talks fail it could just ask ICC that there is no progress being made so that ICC could announce the decision that they've already made. IMO

tfwg, regarding legal expenses, I don't think they would effect last quarters numbers (they might effect future guidance, though). IDCC upped its estimates for the quarter in the last week of Nov, 2004 or in the 1st week of December (can't remember the exact time). Had they had any legal expenses offsetting the earnings, they wouldn't have raised the estimates. Our board accounting experts can comment on that.

How many days notice do we usually get for earnings release? I was thinking with all the new accounting/reporting stuff, IDCC could have released the results by mid-Jan. But, since that didn't happen, I am guessing that IDCC is working on bigger things to put forward a package.....all in MHO.

HGM_142857, very vivid imagination, but, seems less plausible. If you look at the actions of Nokia in last one year (in fact even within the last six months...the time frame that you have mentioned in your post), seems to me that they are going into digging into the ERICY and SE agreements desperatley. If your assumption of SE not being trigger is true, NOK would have stopped this exercise long back.

All, let's not try to manage IDCC's responsibilities. It is a really good intention to help out IDCC with its patent problems by trying to approach the senators, but, remember that we shouldn't go overboard in trying to help IDCC. It is like we are trying to manage the company with what we feel is JUST and we don't have all facts in our hand and I am sure that we will never be able to get all the facts. Let IDCC do its job. I can understand the feelings of frustration but our frustrations shouldn't interfere with IDCC's operations. Let's try the suggesting these things to IDCC's board.
