The manipulation began on 5/9 when Adam Feuerstein sent out lies regarding Linda Liau. Management has a record of all tweets, trades, and statements. It will be interesting to discover if Adam Feuerstein was colluding with market makers.
Discovery does not "work both ways." Each party in the lawsuit must know what to ask for and it must be relevant to the case. Defendants cannot go on a fishing expedition asking for every single piece of paper that's ever come across the eyes of Linda Powers. Nor will NWBO be forced to open their books any further than what's been reported in SEC filings. Discovery only involves evidence that can prove or disprove elements of the case.
Spoofing is the subject of the case not the conspiracy theories put forward by short sellers. Northwest Biotherapeutics isn't vulnerable to discovery in any way since they're not on trial. Nothing Northwest Biotherapeutics did or could ever do would enable or justify Market Makers to engage in criminal behavior. If defendants algorithms are designed to spoof then their intellectual property could be asked for in discovery which explains why they will likely want to settle!
If you read our SEC filings you would know the firm has barely sold any of the series C.
Dilution isn't a concern as the firm can always buy back stock in a few years when we're bringing billions in revenue from Sawston. Merck went over 2B shares and has been buying back stock using Keytruda revenue. We could easily do the same.
Did you know that Sawston can store around $60B in frozen DCVax doses? Very little focus on the immense foresight Linda Powers put into manufacturing capacity planning at Sawston.
Well said bio. Discovery could bankrupt the defendants which means they will be paying billions to settle if they want to avoid this case going to trial.
The company doesn't need the lawsuit to bring DCVax to market. You act as if it detracts from management operations which it does not in any capacity. You also routinely claim without a quick settlement there will be dilution. These are all fantasies you concocted due to what reason who knows but they're not serving the long-term interests of shareholders.

You could use the same flawed logic to argue the Mafia didn't exist or wasn't a big problem in given the lack of prosecutions in the 1950s when in reality the opposite was true.
Spoofing is pervasive but the SEC has for a long time been a captured agency lacking staff to go after the criminals.
Luckily NWBO has Cofer Black, Linda Powers, and Cohen Milstein on the case.

If the plaintiff thought it would not be provable then Cohen Milstein wouldn't have taken the case on contingency. They could be putting up 10-20 million in billable hours on this case which won't be paid unless there's a settlement. For this reason shareholders should have confidence in our ability to win extremely large damages.
We are not desperate. Market Makers need to understand that criminal spoofing will not stand as a business practice. The cost of us making that happen isn't high since Cohen Milstein are representing us on contingency. I see no downside from a rigorous defense regardless the duration required for appropriate redress.

Ken Griffin's second rate legal team did not author NAFTA, EU Patent Law, or defeat Glioblastoma. Let's be clear if we're throwing around credentials nobody beats Linda Powers.
The notion that an NWBO long would want the firm to settle when they have evidence of criminal behavior which every party in the lawsuit are legally required to record, as an SEC mandate, makes no sense. Adam Feuerstein won't be taking the fall for them because there's multiple copies of evidence showcasing their criminal malfeasance.
They can try to burn down their data centers but ultimately that will lead to even more penalties meanwhile Cofer Black has his own copy of evidence that he's been gathering since joining the firm.
The defendants are in a trap. Their only option in this prisoner's dilemma would be cooperation with the plaintiff though that would imply collusion amongst the defendants. In reality they acted alone in their criminality and will all pay large penalties as they have no leverage to get themselves out of this predicament besides their large bank accounts.
Linda Powers will not settle for anything under 2 Billion. Ken Griffin has a house in Manhattan worth 200 million. Anyone who thinks Linda will settle when she has him by his tiny balls well you're not paying attention.

They have no substantive criticism of NWBO so they try to equate Landmark Trial Results with the hundreds of failed oncology trials done by other companies.
I agree but management would have a duty to disclose trial failure. They can't sit on bad news from the FDA. They didn't because they never got any. Approval will occur this year.

The SEC and FINRA don't take action against these large firms because they have the resources to defend themselves whereas regulatory capture means only the most egregious cases which regulators are sure to win are brought. Thankfully our world-class management team of lawyers are able to navigate this landscape with precision.
There's nothing difficult about proving spoofing. Market Makers are required by the SEC to retain a copy of their trades for 7 years as are all proprietary trading firms. FINRA also has a copy of the data for Market Makers. Nobody had the balls to sue because the fear of counter lawsuits. Though Linda Powers had the foresight to gather evidence for the last 5 years.
The investment of shareholder equity brought us DCVax which will be worth trillions over a long enough time period. The average drug cost 1-2 billion in R&D. Management did that without a single trial failure while creating several distinct manufacturing processes. We don't have manufacturing approval yet. Our novel approach may need regulatory validation before we get buy in from possible suitors. They can't replace our process which we own wholly. So let's wait a while. What would you rather buy. T bills? Boring.

The share count has been at 1 billion for months. I am not feeling any deluge of dilution. The authorized share count happens to be higher but they're not in circulation and we all knew that was going to happen. Our low share price results from the Mafia Tax we are paying being on OTC. It won't last forever. Merck has a 2B shares.
My only regret was the buys I made around NYAS though my dollar cost average remains below the current share price. Shorts could bring it lower but I would only buy more. We're not leaving. This is a $100B company.

I would also announce financing near good news events. The terms of that financing would obviously be better if conducted in such a manner.
I don't see how keeping NWBO in operation could be framed as cold water. We are all aware of outstanding financial obligations which shouldn't be a factor considering the many billions in revenue which DCVax will bring to shareholders.
