Verizon Pays $3.6B To Buy Comcast’s Wireless Spectrum

In a turn of events that must put more pressure on AT&T (T), Verizon Communications (VZ) this morning said it will spend $3.6 billion to purchase wireless spectrum from Comcast (CMCSA), Time Warner Cable (TWC), and privately held Bright House Networks.
The spectrum, covering 259 million potential users, or POPs, across the U.S., was licensed by the three companies under the guise of “SpectrumCo,” a holding company, back in September of 2006 in an FCC auction.
The holding company paid approximately $2.4 billion at the time, hence, today’s sale marks a roughly 50% return on investment.
The deal also involves both sides becoming “agents to sell one another’s products,” with the prospect that the cable companies may sell Verizon’s wireless service on a wholesale basis.
Comcast CEO Neil Smit said the deal would give his company the ability to offer mobility to its cable customers. Verizon Wireless CEO Dan Mead said the spectrum would enhance the company’s ability to offer the so-called Long Term Evolution, or LTE, form of 4G wireless service.
Verizon shares are up 16 cents, or 0.4%, at $37.93 in early trading. Comcast shares are up 78 cents, or 3.5%, at $23.35.
And AT&T shares are up 6 cents at $28.90.

Clearwire Surges After Payment, Sprint Deal

.Clearwire Corp. (CLWR), the money-losing wireless carrier, surged after making a $237 million interest payment to creditors and striking a new network-sharing agreement with partner Sprint Nextel Corp. (S)
Clearwire, based in Bellevue, Washington, rose as much as 37 percent and was up 22 percent to $2.17 at 10:06 a.m. New York time. The stock had lost 65 percent this year before today.
Clearwire and Sprint will extend a deal under which Sprint buys wholesale wireless capacity from Clearwire and then resells services to its own customers, the companies said in a statement today. Clearwire will get as much as $1.6 billion over the next four years, helping address its cash needs as it shifts to higher-speed wireless technology.
“This is a significantly positive development for Clearwire,” said Michael Nelson, an analyst with Mizhuo Securities USA Inc. “Without this deal, there would have been increased challenges for them to raise additional funding.”
The deal comes after a standoff over how the two companies would work together when their current network-sharing deal ends at the end of 2012. Sprint, which is Clearwire’s largest shareholder and wholesale customer, had said it would stop selling devices that use WiMax, Clearwire’s existing technology, after next year.
Clearwire has said it plans to move to higher-speed Long- Term Evolution, or LTE, wireless technology. Still, the company said it needs about $1 billion to roll out the updated wireless network and fund operations.

Phone 'Rootkit' Maker Carrier IQ May Have Violated Wiretap Law In Millions Of Cases
A piece of keystroke-sniffing software called Carrier IQ has been embedded so deeply in millions of Nokia, Android, and RIM devices that it’s tough to spot and nearly impossible to remove, as 25-year old Connecticut systems administrator Trevor Eckhart revealed in a video Tuesday.
That’s not just creepy, says Paul Ohm, a former Justice Department prosecutor and law professor at the University of Colorado Law School. He thinks it’s also likely grounds for a class action lawsuit based on a federal wiretapping law.
“If CarrierIQ has gotten the handset manufactures to install secret software that records keystrokes intended for text messaging and the Internet and are sending some of that information back somewhere, this is very likely a federal wiretap.” he says. “And that gives the people wiretapped the right to sue and provides for significant monetary damages.”
As Eckhart’s analysis of the company’s training videos and the debugging logs on his own HTC Evo handset have shown, Carrier IQ captures every keystroke on a device as well as location and other data, and potentially makes that data available to Carrier IQ’s customers. The video he’s created (below) shows every keystroke being sent to the highly-obscured application on the phone before a call, text message, or Internet data packet is ever communicated beyond the phone. Eckhart has found the application on Samsung, HTC, Nokia and RIM devices, and Carrier IQ claims on its website that it has installed the program on more than 140 million handsets.
Specifically, Ohm points to changes made to the Wiretap Act under the Electronic Communications Privacy Act of 1986 that forbid acquiring the contents of communications without the users’ consent. “Because this happens with text messages as they’re being sent, a quintessentially streaming form of communication, it seems like exactly the kind of thing the wiretap act is meant to prevent,” he says. ”When I was at the Justice Department, we definitely prosecuted people for installing software with these kinds of capabilities on personal computers.”Carrier IQ didn’t respond to my request for comment, but the firm has posted a response statement on its website, claiming that it collects only limited “operational information” on devices for its carrier customers:
“While we look at many aspects of a device’s performance, we are counting and summarizing performance, not recording keystrokes or providing tracking tools. The metrics and tools we derive are not designed to deliver such information, nor do we have any intention of developing such tools. The information gathered by Carrier IQ is done so for the exclusive use of that customer, and Carrier IQ does not sell personal subscriber information to 3rd parties. The information derived from devices is encrypted and secured within our customer’s network or in our audited and customer-approved facilities
But even if the data were somehow aggregated and anonymized before being communicated to a remote server, Ohm argues, Carrier IQ and possibly even Sprint and other carriers shown to have used the company’s services should still expect a costly class action lawsuit. “Even if they were collecting only anonymized usage metrics, it doesn’t mean they didn’t break the law,” says Ohm. “Then it becomes a hard, open question. And hard open questions take hundreds of thousands of dollars to make go away.”
“In the next days or weeks, someone will sue, and then this company is tangled up in very expensive litigation,” he adds. “It’s almost certain.”Over the last month, Carrier IQ has attempted to quash Eckhart’s research with a cease-and-desist letter, apologizing only after the Electronic Frontier Foundation came to his defense. Eckhart’s legal representation at the EFF declined to comment on the legality of Carrier IQ’s business practices.
If the case went to court, Carrier IQ’s first line of defense might be that users have agreed to some form of tracking in their contract with one of Carrier IQ’s cellular carrier customers. But when I reached Eckhart by phone, he pointed out that in his tests, he turned on the phone’s airplane mode, shutting down its cellular connection and using only Wifi. Even then, the app seemed to record all his keystrokes and communications as they happened. “[Sprint] defines their service as their network,” he says, referring to his own tests on his Sprint-connected HTC Evo. “I don’t understand how my phone on my own wireless network is their service, and how they have the right to look at that.”Ohm argues that even when the phone is connected to the cellular network, only carriers are protected by contracts they make with users, not an intermediate software company of which most users are unaware. And carriers themselves typically don’t spell out in their contracts the kind of surveillance that Eckhart has shown Carrier IQ to be performing. “This seems like really intrusive, comprehensive surveillance,” says Ohm. “If so, is there really a provision in the contract that’s so all-encompassing? They may say they’ll periodically monitor for quality assurance, or something to that effect. But that seems like a far cry from saving every keystroke.”

Microsoft in Search of Beta Testers for Next Security Essentials Build

Microsoft is looking to wrangle a handful of "guinea pigs" adventurous users to help test the next version of its 'Microsoft Security Essentials' (MSE) antivirus software. Beta registration for the next-generation build of MSE is currently open, and Microsoft said it will be selecting a "limited" number of people who will be notified when it's available for download.
According to Microsoft, the new build will sport a simplified user interface in place of the existing one that's already fairly easy to use. It will also feature a new and improved protection engine with "enhanced detection and cleanup capabilities," enhanced performance to minimize the program's impact on your system, and enhanced protection through automatic malware remediation that will "clean high-impact malware infections automatically, with no required user interaction."
If you're not digging the idea of beta software stopping malware dead in its tracks but are a fan of MSE, Microsoft says it expects to release the new version to the general public by the end of the year.

Driven by near-universal support among mobile network operators, the next-generation 4G wireless standard known as long term evolution (LTE) will enjoy stratospheric growth during the next few years, allowing the technology to account for 10% of worldwide mobile subscribers by 2015, according to an IHS iSuppli.
Worldwide subscribers to 4G LTE at the end of 2011 will number a projected 11.6 million, up a superheated 4062% from just 300 thousand in 2010. Another round of explosive growth is anticipated for 2012 when the technology increases its subscriber rolls by an impressive 442% to hit 62.8 million. Growth in the three years after 2012 will slow down somewhat but will remain robust, at 214% in 2013, 105% in 2014 and 84% in 2015.

I've been long Rambus since 1997. I wasn't all in, but my Rambus investment is/was significant. It won't affect my lifestyle, but if we won it WOULD have. During the past several hours of reflection on this stunning setback, I've come to the conclusion that the days ahead will be a test of my character. Will I have the wherewithall to be kind to my family and friends just as before? And I came to realize that is not preordained but rather a decision, and I've decided it wasn't anyone's fault but my own, and I therefore I resolve to be even nicer to those close to me than before 2:45 this afternoon. Turn all my venom towards the cartel, their enablers and the legal system...turn it into positive energy, positive passion to make myself a better human being.
No one who has invested treasure and immeasurable time into this stock can remain the same. Either we become resentful and hateful or we resolve to let this make us stronger, better. I urge all my friends here to stay focused on the positive. Plus these things usually take a few days to settle before we understand what the future will look like. Hang tough my friends.

Qualcomm has just issued a press release announcing the commercial availability of their Gobi 4000 chips for 4G LTE and HSPA+ capable devices, a variant of which could very well ship in a next-generation LTE-capable iPad. In August we discovered Apple had possibly begun field testing a next-gen LTE iPads with LTE code floating around the iOS builds, and it’s likely Apple would go with Qualcomm’s chip, as almost every 3G iOS device since the Verizon iPhone has used their Gobi platform, the exception being the the AT&T iPad which uses an older Infineon chip.

An AT&T customer, he was thrilled last week when the firm released its first two "real" 4G LTE phones -- the HTC Vivid and Samsung Galaxy S II Skyrocket. A Washington, D.C.,-area resident, he's lucky to live in one of the handful of cities where the providers' highest-speed service is currently available, so he was ready to jump in with both feet.
Then, he read the contract.

Apple earns more than half of all industry profits among mobile handset OEMs according to a monthly analysis of the market by Canaccord Genuity technology analyst Michael Walkley. “Apple generated a remarkable 52% of handset industry operating profits among the top 8 OEMs.” This represents a 5% increase over the third quarter of 2010, when Apple’s share of industry operating profits was 47%.
In an epic reversal of fortunes, Mr. Walkley pointed out that in 2007, Nokia had 67% of operating profits while Apple had just 4%. Today, while Apple has 52% of industry profits, Nokia has been relegated its rival’s former position with just 4% of operating profits.

OCZ RevoDrive 3 X2 Review Update

Over the summer we reviewed a pre-production version of the 480GB OCZ RevoDrive 3 X2 SSD. Even though the hardware and firmware were not final builds, the RevoDrive 3 X2 was still incredibly impressive, given the speedy PCIe interface and four SandForce SF-2281 processors. We've finally been able to log enough time with the production version of the RevoDrive 3 X2 and our excitement over the platform has done nothing but grow. In fact, the performance of the card rose so signficantly that we had to adjust the scale of our benchmark charts to compensate.

OCZ Provides Vision for Next Generation SSDs and Processors
At the Needham 5th Annual HDD & Memory Conference
today, OCZ revealed a good deal of vision about what both consumer and enterprise customers can expect out of the company in the coming quarters. OCZ highlighted a number of new initiatives; like the first SSD to use TLC NAND hitting the market early next year, their new Indilinx processors with support for up to 100,000 IOPS, the Intrepid 3 SSD and the NVM Express, OCZ's next generation PCIe SSD processor.

VirnetX Sues Apple Over iPhone 4S’s VPN Functionality
Finding itself at the mercy of yet another company, Apple has this week reportedly become the center of a lawsuit involving its just-released iPhone 4S. However, the legal proceedings were not instigated by the usual suspect – Samsung – but instead a firm called VirnetX.
If you think you may have heard that name before, you’re probably right, as VirnetX is also the company which sued technology giant Microsoft in the second half of last year – and won, seeing the firm receive a $200 Million settlement from the guys up in Redmond, Washington.
Now, the firm is reportedly at loggerheads again, this time with Apple over U.S. Patent No. 8,05,181. The patent, entitled “Method for Establishing Secure Communication Link Between Computers of Virtual Private Network,” was awarded to the Nevada-based firm earlier this month and covers “a technique disclosed for establishing a secure communication link between a first computer and a second computer over a computer network.”
More specifically, the patent was granted to VirnetX on November 1. That’s right, Tuesday – and VirnetX didn’t waste any time accusing Apple that its iPhone 4S, iPhone 4, iPad 2, iPod touch, and Mac systems infringe on its previously filed February ’07 patent.According to AppleInsider, the case is reportedly being headed up by McKool Smith’s Douglas A. Cawley. Seeking an injunction against Apple on all the devices aforementioned, Cawley noted that he believes the client, VirnetX, is ‘entitled to damages’. It will certainly be interesting to see the result.
