Sometimes true meanings of words are overlooked...
The project will entail the development of medicinal test crops grown primarily in Light Deprivation Greenhouses and using the popular Charlotte's Web strain to derive CBD extract for analysis, testing and medical application.
I would take this to mean that ERBB has permission to grow the Charlotte's Web strain, or it would be foolish to promote something to the public that is false, that could come back to bite them in the butt.

This mentions futuristic plans to set up grow methods in other places.

The potential problem is that unscrupulous folks could potentially register as market makers to take advantage of the exemptions. (Do you want to be a market maker? Go here for an application! It's not a rubber-stamp process, but it's not as hard as you might think.) Right now, "bona fide" market making is judged by the individual transaction rather than by the individual market maker, so no market maker gets a blanket exemption, but any market maker -- even the ones posting $0.001 bid/$10,000 ask spreads -- get a pass in the right circumstances. It's a situation that seems to hold potential for mischief.
Overseas intrigue?
And here is a final source of potential trouble I'll suggest. Say the broker placing the order to short a stock is in an offshore location where naked short selling is legal. This would seem to open up the same opportunities purportedly exploited to naked short the stock of companies that have issued floorless convertible debt.
Lawsuits have claimed that the DTCC loans out shares it never collects from participants. These, in turn, presumably show up as new "fails to settle" transactions, but from the point of view of the market, they appear to be new shares floating around -- in electronic form, that is, without stock certificates to back them up. These can then be relisted, the theory goes, as available for borrowing, and the process repeats itself, allowing the folks manipulating the system to essentially manufacture any number of phantom shares.

Realm of Caring Comes to California
By Fred Gardner There is a point at which a story achieves critical mass —it goes from being a matter of interest to a fraction of the public to one that everyone’s talking about, inescapable in the media. That point in the medical cannabis story was reached last August when Sanjay Gupta, MD, narrated an hour-long “Special Report” on CNN that provided dramatic examples of Cannabis exerting beneficial effects. Most memorable was the return to health of a five-year old in Colorado Springs, Charlotte Figi, afflicted with Dravet Syndrome, a severe form of epilepsy.
Charlotte’s parents told Gupta how her condition worsened as every conventional treatment failed. She was having hundreds of seizures a day and the doctors were considering inducing a coma to save her life. Her dad, a Special Forces soldier deployed to Afghanistan, researched epilepsy treatments on the web and learned about CBD. Desperate, the Figis bought $800 worth of CBD-rich Cannabis at a dispensary and a friend helped them extract the medicine for under-the-tongue application. Charlotte’s seizures went down to one a week and and she began recovering!
A Colorado grower named Joel Stanley and his brothers supplied the Figis with Cannabis tincture made from plants with a CBD-to-THC ratio greater than 20-to-1, and renamed their strain “Charlotte’s Web” —CW, for short. Other parents of kids with severe epilepsy began contacting the Stanley Bros. with urgent requests for CBD-rich medicine. The brothers created a non-profit called the Realm of Caring Foundation to facilitate distribution; Paige Figi works for RoC as a volunteer.
“To date there are 179 children and 27 adults on CW,” according to Heather Jackson, RoC’s executive director. “There are 345 patients in the Realm of Caring program,” she adds, “so about 1/3 use other strains for their symptoms and diagnoses like cancer, ALS, pain etc. The Realm of Caring does not charge for their services.”
Desperate parents have been moving to Colorado to expedite access to CBD-rich Cannabis for their kids. In many states, politicians and activist parents are pushing legislation to legalize CBD (while maintaining the prohibition of THC). The Stanley brothers have testified in support of CBD-only bills in Florida, Alabama, Kentucky, Nebraska, Utah, New York, California, Georgia, Oklahoma, Maryland, Vermont, Wisconsin, Pennsylvania, and Illinois.
Among those who contacted the Stanley brothers in 2013 was Ray Mirzabegian, the father of a Dravet syndrome patient named Emily, who was nine years old. After many trips to Colorado, Mirzabegian was provided with Charlotte Web seeds (said to have been stabilized by the Stanley brothers over the course of several years). He was also authorized to launch Realm of Caring California, a subsidiary of the foundation the Stanleys created. Mirzabegian is now growing out Charlotte’s Web plants as per the Stanleys’ specifications, and arranging to distribute the CBD-rich oil that will be extracted from them. On Feb. 23 in Milpitas he updated 120 parents of pediatric epilepsy patients on the state of his grow.
Mirzabegian’s talk followed a presentation by Bonnie Goldstein, MD, the director of Canna-Care Centers, reviewing what doctors and scientists know about Cannabis as medicine. Realm of Caring California had organized two previous seminars in southern California, where Goldstein and Mirzabegian are based.
Many in the Milpitas audience were on the waiting list for CBD-rich oil from the Charlotte’s Web plants that Mirzabegian is growing at three locations in Southern California. “No more than ninety-nine plants per facility,” he explained. “We are doing everything legally.” He gave up a career teaching opticians to grow medical cannabis for his daughter Emily, now 10, and others in urgent need. His brothers Alfred, a general contractor, and John, a hair-transplant technician, are also spending 14-15 hours a day growing plants organically for RoC California.
Ray Mirzabegian seemed, to your correspondent, completely sincere and likable. He is 40, grew up and lives in the Los Angeles area; speaks almost perfect English with an Armenian accent. Transcribing Mirzabegian’s talk from a tape, I hear the singsong of infants in strollers and the occasional moan of a teenager in a wheelchair. The audience was utterly rapt. Excerpts follow:
…Because of her uncontrolled seizures —despite numerous medications and a ton of other treatments that failed— about a year and a half ago after I watched the Stanley Brothers in a documentary ["American Weed" on the National Geographic Channel]. I traveled to Colorado several times… And I was able to obtain Charlotte’s Web for my daughter first and then for everybody else because it would not be fair to just do it for myself.
About a year ago I went into an agreement with Realm of Caring Foundation to start growing plants here and offering oil to patients in California who needed it. It took about three months to realize how severely California needed this medicine. The waiting list right now is about 400 plus patients. Mostly pediatric patients but also patients with other severe problems.
I haven’t really advertised it —just word of mouth and Facebook groups.
I’m working very hard to establish what is required legally and to do it 100 percent in a legal way and to learn how to do it right. I don’t come from a background of growing. I’m a professor. Was. Concluded my career about a month ago. I used to teach opticians in college for 20 years. But it took about a year or so to learn the science of growing this plant the right way —meaning to make sure that it’s organic, that it’s clean, that there’s no pesticide, molds, anything else. To make sure that it’s a quality product, because after all, I’m going to give it to my daughter…
So I traveled to Colorado and got trained with the help of the Realm of Caring Foundation and the Stanley Brothers University. We’re copying exactly every single thing that they’re doing so there’s absolutely no difference between the Charlotte’s Web that you’re getting in California than in Colorado.
They’re the Colorado brothers and we’re the California brothers —Alfred, a general contractor, and John, a hair transplant technician: they are your farmers (sustained applause). We’re putting 14 to 16 hours a day into this. Doing whatever it takes to make this happen. They put everything aside about a year ago. We put everything else on hold and we’re gonna go for it. There are now a lot of plants growing and soon to be harvested.

I wanted this oil because my daughter was having many, many seizures. She had tried 13 medications that did not work. The ketogenic diet [an anti-seizure diet low-in-carbs, high-in-fats] worked for about six months and then seizures slowly started coming back. About a year after the diet my wife and I sat down and said that she has absolutely no quality of life. She was depressed because she couldn’t eat anything at school or at home. We could have tweaked it more but we thought it’s not really working. So we decided to stop the ketogenic diet and sure enough Lauren’s seizures came back.
At a very well known epilepsy center in Southern California they casually pulled us aside and said “There’s really nothing else we can do for you guys, we suggest that you go home and enjoy your daughter as best you can.” So we went home very disappointed and upset. We saw about eight or nine neurologists after that until we found one AT UCLA who was willing to sit down and listen to us and communicate and have a conversation. Our neurologist is very supportive of the parent’s right to try something like CBD, especially since we’ve tried everything else. I talk to him frequently and he’s interested in the feedback about the patients, about my daughter.
He’s also supporting me in tapering the medications because they’re not working and all were getting is negative side effects. If the medication is helping, I can understand putting up with the side effects. But if there’s no seizure control… For instance, speech fluency: on Depakote it was like someone pushed the mute button on her. She’s speaking more and more ever since we started CBD and were able to take her off the medicine. (Applause)
I went to Colorado asking for this and came back empty handed because its illegal to transfer. I was home and my daughter was having a seizure and I was so upset and so angry because there is something that might help my daughter! I started looking throughout California dispensaries. I purchased bottles and bottles of stuff. I didn’t know that you could test it, so I just tried it on my daughter. Honestly, nothing worked. I was seeing Charlotte’s story on CNN and I went back to Colorado and I came back and said I’m going to start a waiting list and a Facebook group to show these guys that there’s a demand for this product. I emailed one of the Stanley brothers and he answered the next day. Then I went to Colorado. He said “We get about a thousand emails every week and we forward them to the foundation but I decided to answer yours, I don’t know why, and here you are.”
I brought back a limited quantity of seeds. So I had to grow and grow and grow and clone and clone and clone and clone because I had 400 patients waiting for it. I have a feeling that number is going grow after the second documentary on CNN with Dr. Sanjay Gupta in a few weeks.

Its a beautiful plant. Very different from everything else that I’ve seen. It’s a very fragile plant. It requires a lot of love and singing and taking care of.
That’s what we’re doing. Every single one of these plants has a patient’s name on it. So if you’re on the waiting list and I have your recommendation, your child’s name is on one of these plants… We want to do this whole thing legally so we’re creating a collective and resource center so I can have all of you as my patients and we’ll do it as legally as possible in California… California Laws are extremely tough and limited. I am allowed to grow 99 plants in a facility —and that’s all I’m doing, because I’m not planning on going to jail for years and years. But that makes it very tough to meet the demand and forces us to have several facilities to meet the demand.
The cost of doing everything is much higher in California, but whatever it is, who cares? We’re going to do this the right way. We’re going to offer this at wholesale prices. Not like everybody else —or most people. There are some good collectives in California who are trying to do some good things, and I support them. But there are also a lot of people who are trying to cash in on the CBD rush and they’re looking for desperate parents like us. They’re charging a whole bunch of money for God knows what they’re giving you. We’re not trying to do that. We’re trying to keep it as low cost as possible for everybody. I’m going to try everything I can to keep it lower that anybody else. I didn’t get into this because of the business factor. I got into this because of my daughter.
Emily is almost medication free now. Applause At times she’s been on four different meds and on those she’s had several seizures a week. She’s now eating everything on her own, socializing, running, jumping you name it. And since tapering off the last Benzo medication she’s on Clozapine and it’s just done so much damage. Even when we’re tapering this medication she’s averaging one seizure every 10 days.
I’m hopeful that once we’re completely off the meds, that the right dose of CBD, the right ratio, I hope she can have the success of Charlotte and Zaki? and everyone else who is seizure- and medication-free. There are a couple of things wrong with my daughter. One was the the grand epilepsy that was diagnosed, but the side effects of the medications were even worse. She was so much worse when she was on these medications. Obviously less seizures, but also less side effects of the medications.
I talk about this with my —her— neurologist. We send each other articles and research. We communicate. I finally found a good one who listens, who researches. And I suggest you do the same. And I suggest that you do not touch this medication unless you have that doctor who is supporting you. Because, man, these withdrawals can be crazy and they’re scary sometimes. But if you have the right doctor to guide you through it, you understand that it’s okay what you’re going through, and that it will pass. And you can call the doctor and ask, “Should I go to the hospital or not?” We haven’t been to any hospital for three years now. There are a lot of success stories out there. Not just from Realm of Caring but every company that’s offering marijuana as a medicine. It’s a one-on-one personal thing. Some people do okay, some people do great, some people need more time to find the right dose.
And that’s something that we all need to understand. We have to have discussions within our groups —What times of day? how many milliliters? Before or after meals?… All of that stuff. Try and try and document everything. One of the biggest things that helped her was at 4:30 in the morning we gave her half a milligram of CBD while she was sleeping. And that was such a big change in her. It almost completely stopped her seizures that happened in the early morning. These are the things you have to understand. You have to try it. You have to give it time. You have to document everything
If you have a good neurologist, if you have a good doctor like Doctor Goldstein who is always available for patients, if you have this team and this support system, give it time and it will work. It’s not that one magic pill… Sometimes it could even be worse. Because it affects medication levels. It affects the way the brain functions. So, don’t be afraid, just document everything and talk to the doctor and give it a real shot. Once you give it a real shot you can decide if it’s working or not.
There’s a lot of discussion going on about THCA and THC. Some will do great on it. Some will do great on CBD only. It’s so hard for me to tell all 400 people to just hang in there and wait. I wish there was something I could do to make these plants grow faster —and there is, but I’m not going to do it. Because I want to grow organically, no extra hormones or… (Applause.)
So, we’re almost there. If all goes well, I should have three harvests in 2014. And between those three harvests I’m hoping everybody will get their medicine. (Applause.) We’re almost there, hang in there. When it’s ready I’ll call you or I’ll email you.
We’re also traveling around talking to a lot of council members and authorities. We’re not just trying to grow this plant and sell it. The point is not business and to make money. If I wanted to sell it at a much higher rate then I’d make a ton of money in a year and I’d close shop and I’d be good to go. But I’m not going to do that. I don’t want to do that. I want to use every single one of our success stories and I want to present in front of counties, authorities, media, I want us to have a voice.
For about nine years I traveled all over the place looking for medicine—I went to France, I went to Germany to buy medicine, I tried every FDA approved medication. Most of you have done the same thing. Now that I’ve found something that helps my daughter, I need her to have a voice. I need to talk to them. I need everyone to know about it. We need to write. We need to tell the authorities. I don’t have to be afraid anymore.
About a year ago Child Services knocked on my door with two LAPD officers at 10:30 in the evening. That was one of the worst days of our lives. My wife was shaking. The school nurse thought we were neglecting because we were tapering medications. We don’t have to take stuff like this. We already have so much to deal with. Those are some of the reasons that I’m so vocal. Because I’m up to it.
That’s what Realm of Caring is doing. Those guys in Colorado are traveling all across the country talking to the counties and I’m doing that in California. Realm of Caring is gathering data, gathering data on people who are seeing results. How much ratio, when did they take it, what times —and I’m going to do that in California.
I want all California patients to gather data. All California patients who are going to be on the oil. It’s going to be kept private… One of the key things that’s missing is real patient data.
Or if you’re not seeing results, what and why? If you’re part of a group of Facebook or in the Realm of Caring group there are a lot of children who are doing so much better than they were before they were on this medicine. We’re talking about THC and CBD, but we’re talking about Cannabis as an option.
I want to clarify something, I’m not here to say that Charlotte’s Web is the only medicine that works. I’ve never said that. On the contrary, there are a lot of great plants out there. There are some companies that are doing good things and I’m supporting them. I’ve sent many patients to companies that are trying to do it the right way. If you find something that works, ACDC is a great strain. But make sure that it’s grown the right way and that it’s stable and clean. Charlotte’s Web and ACDC are both 20 to 1 (CBD to THC), and if that helps, wonderful… There are more companies coming up in 2014 and I’m happy about that. I wish more companies would come up and pay attention to our children. I and my brothers cannot take care of the entire state of California. So we will support each other and work alongside each other. I will be very happy if that happens.
Charlotte is doing great. she went from hundreds of seizures a week to almost no seizures and is medication-free. Zaki I just met in Colorado. He’s doing great. You wouldn’t know that he comes from a past of seizures and problems. He talks, communicates, runs. We were sitting there talking about football and some of the players and I thought if my daughter gets there… it was such an inspiration. Zaki has been seizure free for over a year, a year and three months I think. My daughter is happy and active and doing much better than she was on all those medications.
It’s a work in progress. I can’t wait till this is ready and I can give it to all these children and have all of your succeess stories That will be the best day of my life. And it’s coming soon.
We’re opening a resource center and collective in Los Angeles. It will be called Realm of Caring Health Center. It’s a collective because legally I have to form one to grow for you. I’m trying to build this place to be different. To be a health center. It’s going to offer medicine based on percentage. If they have a condition that requires 5 percent THC to 1 percent CBD. I also want to offer resources —education and support for families and parents who walk in. I want to create a decent, clean medical office where you can sit down and have a medical conversation without smelling marijuana. We’re building this place to be family friendly..

It is both...there is an average short position in USEI between 30% - 50%, on average, with it being 51% on one day this past week. That is pretty outrageous, and a lack of respect for the company to make any kind of substantive run in the PPS.

Being that we are talking about patents...
I recently found out that the CDC, and Federal Government, have patents granted on the development of many different strains of the ebola virus...
To my knowledge, you cannot patent a plant...unless it can be tied in with another solid product. Also, processes such as this can be patented, but they have to jump through much more stringent hoops.
Here is some info that may apply:
Patentability
The USPTO tests patent applications for novelty, utility, non-obviousness and description. A marketing strategy applying for protection as a process must also meet these guidelines. "Novelty" means that no protected aspect is already patented and that no one has published or publicly demonstrated the process more than a year prior to the application. "Utility" means that the process has an industrial application and the USPTO finds most anything to be useful, whereas "non-obviousness" means that the process cannot be a logical improvement or process that any person could concoct without specialized training. According to IP Watchdog, the description is key for processes.
Description
IP Watchdog states that, following the Bilski decision, a patent application for a process or strategy must clearly demonstrate through the description that the strategy constitutes a new invention. Furthermore, the description must show that this invention is "concrete and tangible." A patentable marketing strategy must go beyond concepts and constitute a novel presentation method or delivery process -- complete with a detailed technical description prepared by a patent attorney experienced in patent prosecution for processes.
Would it not be theirs if they filed a patent application with specifics of their claims? If this is true, I would think that these guys would not make claims without legal documentation, or rights to do so. Google the brothers names at the USPTO, it might pull up with an application that has been filed... I might be speaking out of line, as I am entering this discussion in the middle, and will have to retrace to get up to snuff...
Our partner company USEI, is more heavily shorted than ERBB...and they have rebounded back well. Shorted shares were over 51% the other day.
There is a good partnership there...for both companies. You might want to take a look.
Looks like someone is shorting through ETRF...as he has been on the ask for days at specific, critical times, to head fake with the shares, to drive the PPS down.
But, this can be said about most MM's, when they post bogus share numbers for sale, and just keep sitting there with the same figure, as hundreds of thousands of shares are being bought. NOW...this should be against the Law... IMHO

The Shorts are driving this company towards oblivion...they have added incentive - if the company closes their doors they will not have to cover...ALL PROFIT.
They are methodically, and meticulously, walking the PPS down...while many of us, including the ownership, ignorantly watch our money and future being legally stolen from us. Big money has to step in to jump start the company...management has to reduce the share structure, so that when good news, such as the patent acquisition rights, comes out the PPS will move accordingly.
The OS/float has to be reduced by the buying back of the shares, and a great time to do that should have been during this blood bath from the MM's and shorts. Forrest Gump could realize this, and AG management needs to see this, and take legal action to stop it. And, then, BAM...hello shorts...surprise...see you in dollar land. My suggestion to Shearin is to "spend the money, or get the money, to buy back a billion shares...and then watch this baby fly.
We all know so well the easy way out is R/S - the criminal way out... Increase present and future shareholder confidence...BUY THESE SHARES BACK, or take a partner that has deep pockets that can see the value of being honorable, and doing the right thing.
And, even with the confidence of those that have visited the company, met with the management, etc., there still is doubt, especially from the OTC arena that we are tippie toeing through.

I read this to mean that if anyone that tries to sell regulated products such as Marijuana, or other types of governmentally regulated products, or methods of dispersion, will infringement of the patent rights that ERBB just purchased from the holder of the patent. First of all, all the trading in the mid .0145 range should have established a very strong support base...AGAIN...hands off shorty and MM's... LOL

Everyone makes assumptions...some write "burn shorts burn", as, with great exuberance, one assumes that the shorts, who are organized, and well funded, with great research, are going to get burned...others are saying "will the PPS go up, will it go down, etc."
You are right, as I "assume" that each investor will do his own DD, research it out, and make up his own mind. Just as you have made some assumptions, yourself...as I have formulated some assumptions about certain posters, as well.
About my copy and paste, I assumed that others would appreciate the information that was enclosed, and that they are adults that can make decisions as to the validity of it.

Well, I am a fairly inexperienced investor...just learning like you and others.
My background is in Professional Baseball, and Research and Development in baseball and other related areas.
I do have several granted patents, so I am a bit familiar with the importance of patent protection.
I have been unable to alert others, as you well know.
About USEI...it is a sister company in related fields of interest. I am still trying to do some DD on USEI, but my initial response is that they compliment each other as ERBB can use USEI as they are making, marketing, and selling edibles. They also have done a deal to acquire 2 stores, both in the state of Washington, all of which would lend itself to fitting in with what ERBB wants to do with edibles, stores and doctors offices and dispensaries, etc.
The picture above is USEI’s Colorado kitchen to make edibles which include: cookies and cupcakes, etc.
Which will have this logo… This is in the future tense, which tells me that they are/were gearing up to make edibles in their own kitchen, which would mean that they would need some form of distributing and selling their cookies and cupcakes, which would be logical to own some stores. This also would be feasible for USEI to have far greater distribution potential, which is one major reason why cutting a deal with ERBB would open up major distribution doorways for them, capable of providing far-reaching financial benefits beyond what they presently have.
USEI already has a deal structured with a company wherein they get 40% of the product sales, so I do not know how this would help or interfere with a deal to distribute the ERBB vape pipes.
USEI has a machine to make extracts, that could be used for a variety of reasons. This could be applied in the recreational areas, and the medicinal areas, which also will fit into the business plan of ERBB as they will have a distribution network, and a desire to put them into the machines, etc.
USEI already has a patent biodesel patent ( U.S. patent # 0126790, so they will welcome proproetary protection from ERBB that certainly will bolster their bottom line. Patent protection is a huge thing, and can be used in all their marketing and promotional things as they seek to improve their visibility and market share.
If the following statement is true, then, this falls in line with the ERBB business plan… According to Anthony Miller, CEO, "We have extensive relationships with legal growers, dispensaries, product developers, marketers, patent holders and other professionals in this industry; and we believe that it is necessary that we develop these relationships and opportunities. The Medical Marijuana industry is growing at an extremely rapid rate and this emerging growth industry seems to have growth potential that will continue to grow for years to come. As other states legalize the use and sale of products and services for this industry, we plan to find our niche and opportunities. Management thinks this is just sound business for USEI. Our goal is strategically plan to make our Cannabis subsidiary as a very lucrative division of USEI and develop our own proprietary products and services."
And, if this is indeed the business plan for USEI, then the growing, the hydroponics, the Jurassic Water System of ERBB, the Zazzz machines around the world, will be needed to expand many phases of their business plan, and their growing business. So, ERBB has the growth components to energize USEI and bring in more revenue…and investors, which will increase PPS, etc…
USEI also is entering into the MJ industry, and the Hemp business, as well, which has so many different applications for business growth that it is phenominal for USEI…and for ERBB.
Anthony Miller, the CEO, has some baggage, it appears. This can be a concern until he proves himself.
About having your own kitchen and making your own edibles, there are too many legal regulations to adhere to, especially in an upstart MJ industry. Why not contract/vend out the manufacturing, packaging, shipping of USEI’s products to an existing bakery in business that already has jumped through the regulations hoops, and pay them to make the products for USEI. Less headaches, less employees to pay in salary and benefits, etc. Companies do this all the time. Just like they have working agreements with stores in Washington, so can they have contractual agreements with a bakery/bakaries to make their edible products.

SUMMARY OF THE INVENTION
The present invention is a vending machine system and its associated method of operation. In the vending machine system, customers are provided with identification cards. The identification cards can be driver's licenses, bankcards or a specialty vending card. On the identification card is statistical information regarding the age of the card owner. Also contained on the card is data corresponding to a biometric characteristic of the card owner.
Vending machines are provided that contain card readers and biometric characteristic verifiers. When a customer wants to use the vending machine, that customer inserts their identification card into the vending machine. That customer also subjects themselves to a biometric scan from the biometric characteristic verifier contained within the vending machine.
The vending machine reads both the statistical age information from the identification card and the biometric characteristic data. A systems processor in the vending machine compares the biometric characteristic data on the identification card with the biometric characteristic data just gathered by the biometric scan of the customer. If the data matches, it can be assumed that the owner of the identification card is using the identification card. If the identification card then indicates that the customer is old enough to purchase a regulated product, the vending machine is enabled and a regulated product can be sold from the vending machine.

It has a great deal to do with USEI...
As USEI has the store fronts, and probably will be acquiring more of them...and ERBB has proprietary patent rights, that they just negotiated from the original patent owner, of which was the cause for AG not being granted proprietary rights, previously, without infringing on this guys rights.
He has granted ERBB the rights to use his EXCLUSIVITY RIGHTS FOR THESE MACHINES, which can be huge for both companies. It protects others from using these types of machines.
I wouldn't doubt that AG might have been close to infringing on this patent, and they did the right thing and got rights to use the patents, etc... Good move on their part.
I have several patents...and I know the importance of this achievement, especially when USEI will have the edibles, and ERBB can sell them in their EXCLUSIVE, patent protected machines...all over the country and world. Think about it...

American Green Set to Acquire Rights to Important Intellectual Property for Its Marijuana Vending System
Tempe, AZ. – (08.07.2014) – American Green (OTC: ERBB) has made a move toward securing and expanding its business model regarding age-related purchases via any automated device. The company has entered into an agreement with Robert Tomassi, owner of intellectual property (IP) that pre-dates, and may supersede patents owned by competing companies operating in a similar market space. Ask looks thin, and could run, if there was more volume, and more money...that's if these butt wipe Market Manipulators and shorts can be shackled long enough to blow this thing open.
The MM's and shorts blew through those numbers so fast this morning that there was not enough time for volume accumulation at those stops... Put some buying pressure now and this thing could pop. It is on a lot of radar screens, and could bring in the needed cavalry to put some serious heat on the shorters...
Level 2 looks like it could blow open with some serious, strategic buying power... I am liking what I am seeing right now. Keep up the buying power, and do not allow the MM's and shorts to gain an upper hand...we have just seen, earlier, the wickedness of their ways...

On a higher note…no pun intended…HOW DO YOU THINK THAT SHORT SELLERS MAINTAIN SUCH A STRONG, CONTROLLING GRIP OVER OTC STOCKS AND THEIR PPS? How to minimize risk when shorting OTC stocks.
One of the problems with a lot of pump and dumps is that there are often not any shares to short when the stock is about to fall. However, there are often shares available to short days before, when the pump is just starting. For example, there were at least 5,000 shares per day of WXYZ available to short at Broker #1 for many days prior to its big drop day. However, from January 19th (the day before its big drop) to January 21st (the 2nd big drop day) there were no shares available to short at Broker #1.
So what can a short seller do? The simple answer is to box the shares (this is also referred to as simply boxing). Boxing originated as a tax technique designed to delay the realization of capital gains while eliminating the risk of holding a stock. So for example an investor who was long 1,000 shares of stock would then go short against the box, selling short an equal number of shares either in the same account (some brokers let you do this) or in another account, if he believed the stock was temporarily overvalued. This eliminated the risk of holding the stock and did not require realizing a huge taxable capital gain. This tax loophole was closed in 1997. Now the only reason to box shares is to lock up short shares.
What I do on many pumps (the ones I know I will want to short sell) is I short shares at broker #1 while going long an equal number of shares at Broker #2. Sometimes I will already be long in the stock as I do sometimes try to make money by buying pumps (but shorting is much easier). Other times I will scalp to open the boxed position (for example I might scalp short and then buy long in my other account to box, rather than covering).
By boxing the shares I accomplish two things: (1) I can now short whenever I want by selling my long shares, even long after no new shares are available to short, and (2) I can get better fills when I do decide to short an OTC stock because Broker #2 has more direct-routing options than does Broker #1.
So how did I implement this play for a pumped stock? I shorted 3000 shares at Broker #1 at an average price of $2.51 on 1/14 (that I later covered at $2.096 on 1/20 and 1/21). The same day, I bought 3000 shares in my Broker #2 account (I think I actually ended up buying for poor scalps multiple times, which explains why my average buy price is so much higher than my average short, and why Profit. ly has the position size at 4900 shares).
To get net short on 1/19 when the stock was looking weak and I thought it might drop, I sold my long shares at Broker #2, and I rebought them when the stock held up (again, I had partial fills and some scalping so Profit. ly shows more than 3000 shares). On 1/20, soon after the open, the stock looked weak and actually went red on the day. I shorted then by selling my long shares and I bought them back for a loss. When it went red again just a little bit later I believed it was time for the death drop and I sold my long shares a final time (2500 at $2.83 and 500 at $2.85).
To cover, later that day and the next day, I covered my short shares at Broker #1. I covered 2,000 shares on 1/20 at an average price of about $2.16; Broker #1 bought in 800 of my remaining shares at 2.05 the next morning, and I covered the last 200 shares into the 2nd down day morning panic at $1.64. Overall I netted $1913.21 from my trades on the stock. Even considering the total capital I needed to make these trades (6,000 shares * a maximum price of $2.89 = $17,340), my percentage return was nice (11.0%).
There are of course downsides to boxing. It uses up capital (and if you aren’t careful you can generate a margin call in one account even though you are not losing money overall), generally requires multiple brokerage accounts, generates more commissions, and requires more planning than just shorting. That being said, as long as the net result is a profit on a stock that would not have been otherwise shortable when you wanted to short it, the end result makes the hassle worthwhile. The only risk to boxing is forced buy-ins of short positions. This actually happened to a couple traders I know who had boxed shares of the stock in preparation for its big down day. One of those traders was forced by Broker #1 to cover his short shares right at the open on 1/20, just an hour before the stock dropped. However, being forced to cover part of a boxed position will only saddle a trader with the costs of commissions and slippage.
A note on the psychology of boxing: I have seen other traders refer to ‘making money’ on one side of a boxed position while ‘losing money’ on the other side. I do not think of it like that. If I am long the same number of shares I am short, I have no net position and no risk. I consider myself ‘flat’ and think about it as if I had no positions in the stock. I then consider myself to be shorting when I sell my long shares.
I said all that to say this...TAKE SOME PROFITS...play with house money...never underestimate the organization, experience, knowledge, and financing of the MM's who manipulate stock PPS on a regular basis. Learn from the bashers, the shorters, how they team up to fleece unsuspecting investors... All JMHO, of course, FWIW $1.11

A serious Bullish push on the ask is needed to break through that .018 resistance to keep the momentum flowing... Push this PPS through resistance to blue skies...
I would like to think that the management of AG is smart enough to have a couple of PRs that have some substance to fuel this PPS with rocket fuel to blast this thing to better heights...IMHO

There definitely is Market Maker Manipulation in OTC Stocks.......
For example, a trader is ready to open a long (buy) position. He or she goes to their level II display and notices that several big player MM’s all are on the inside bid with say 8 or 9 other participants, with large size.
The trader thinks "ok I've got support (many offers to buy), and the ax (NITE) (another term thrown around the internet…) on my side, this is a good time to BUY."
They receive their buy confirmation and a few seconds later the stock starts to fall. All the big boys have left the bid (buy) and are now on the ask (sell). The stock is dropping fast and the trader feels panic taking over. They wonder how this could happen with all the bid support they had upon entering their position. Well, they've just been had. Welcome to loser day trading.
Most of what you see in Level II is about "head faking" and hiding true intentions. In fact, it's the market makers job to cover their intentions (buying/selling) and to cause price movement in their favor for themselves and their clients. They use Level II for this purpose. That's their business. If a market maker has an order to buy 500,000 shares, they're not going to sit on the bid all day. The whole world would see this and bid the price up, knowing that the market maker would be a buyer.
Instead, they'll play the game. Go on the bid with large size to push the price up a little, maybe even up tick (move their bid up one level) to push the price a little higher. All the while they're using an ECN, for example INCA, to sell short the shares the unsuspecting trader is buying (thanks Mr. AX). Then they move to the sell (ask) side with large size to cause a mini panic.
In this case, the market maker or makers were showing a false bid on Level II. Instead of wanting to buy the stock they really wanted to sell the stock, which they were doing through INCA.
As the panic heightens and the stock drops, the market maker will buy back the shares they just sold you at a higher price pocketing the difference (this is called selling short).
You will not see them buying back the stock because they will be buying through an ECN. Very effective, and designed to profit off of traders that look for support and resistance on the Level II screen.
What does happen is a company who has Billions of share to dump, contracts a distribution market maker to dump and receive certain amounts of total funds for the dump, and the MM gets percentage bonuses for the amount dumped. They'll flash different amounts of share in the ask side. But if they flash it inside the bid side, just to manipulate the price, it's a federal crime. Distribution, clearing houses, MM's are watched all to closely to take chances, especially inside of penny stocks where delusion sends reports to the SEC on a constant basis.

More evidence of Market Maker Manipulation in the OTCBB. Background: A veteran of 20 years as a Market Maker would seem to qualify this commentator as creditable. He's in private trading now, but has some definite conclusions regarding Market Maker Manipulation (MMM) and what must be done about it. He cites incidents of suspected manipulation in many stocks, based on the numbers.
For example, "First, one must ask themselves why do Market Makers get to hide in the OTCBB market, not revealing their short positions. This appears to be the main issue behind all of the problems. MMs should be required to hold a very limited amount of a short position (say 10%) which is not held by a paying customer/client." "When Market Makers have an infrastructure in place that allows them to cheat, they will cheat. When they are allowed to -- behind closed doors -- have a HUGE short position and are never made to balance their position in the reasonable short term, they will never correct their positions. Full disclosure of short positions in all OTCBB stocks should be REQUIRED just like it is with the other markets: NYSE, NASDAQ and AMEX."
"It is my honest opinion that there has been ample evidence of late that Market Makers are manipulating OTCBB stocks. I believe that the law of supply and demand should apply. When more buying occurs, a stock should go up. When more selling occurs a stock should go down. This does not seem to be occurring." "I shall give two examples where I have personally been affected by MM Manipulation.
The first company PPS closed at 3.9 cents, up .002. During a specific period, the PPS was around .08 cents. Since that time there has been approximately 89 million shares bought and 10 million shares sold. According to the laws of supply and demand the price should go UP. One might expect the stock to be around .11 or .12 cents if not more!" "After all, for every share sold nearly 9 were bought! Today the stock is nearly 40% down due to unfair trading by MM’s."
The second company PPS was at about 6 cents, dropped to about 3 cents, and closed at 3.5 cents. "Recent transactions show that during a specific time there were 14 million shares bought and around 2 million shares sold. For every share sold, around 7 have been bought. The stock has fallen unfairly from .065 to .035." "I still own around 280,000 shares. I am divulging my positions in these stocks so as to be open and honest. Shouldn't the trading community have the same right from the Market Makers? Shouldn't MM’s be required by the SEC to fully disclose their positions, both long and short?"
Comment: The evidence is admittedly anecdotal, because unless some repentant MM decides to spill his guts, no one has access to proof of MMM (Market Maker Manipulation), and the MM’s certainly want to keep it that way. But as the anecdotal evidence builds and the pattern evolves, what are reasonable and objective investors to conclude?
Please require the OTCBB Market Makers to operate with the same integrity demanded in the other markets that you enforce. The lack of enforcement is allowing manipulation not tolerated by your agency, in other markets. This is a clear unfairness to the investors, and should be rectified swiftly. It is not right for our (my) government to know about this problem, and be so slow to act. Same conduct & guidelines/requirements for the Market Makers should be employed and enforced across the markets. This should, and could be done without delay.

2. Market Manipulation or doing their job?
a. Do Market Makers manipulate the market?
i. “Market Manipulation” is an emotive term, and conjures images of shady deals and exploitation. Market Makers are not elusive companies that appear then vanish overnight. Market Makers are duty bound to make a market and to meet the needs of those they are responsible to (See 1d.) to this end they may try to influence the market.
b. How Do Market Makers make their money?
i. Market Makers make money from buying shares at a lower price to which they sell them. This is the bid/offer spread. (See 4.) The more actively a share is traded the more money a Market Maker makes.
c. Surely a Market Maker raising/lowering the price on news/rumor without any buying or selling is manipulating the market?
i. No, not really. If the Market Maker was to keep the price steady on the release of news they would find themselves with lots of buys or sells which they had no choice but to fulfill at the screen price but before they could find matching orders (buys for sells, sells for buys) they would have to change the price and they would then loose money through market exposure. This is bad for them and for us. (See 3.)
d. Why do Market Makers raise prices on Monday morning for shares tipped in the Sunday press?
i. This is the same as question 2c, because the Market Maker needs to ensure that there are enough sellers to fulfill the needs of the buyers responding to the tips.
e. Suppose my screen shows all sells and the price is increasing, what is the Market Maker doing?
i. An explanation of this phenomenon is given in a company, which very briefly shot up to 73p before settling back comfortably to the 50p support level. The likeliest explanation is that the Market Maker had an Institutional order to fill and no stock to fill it with (this trade would not have shown up on peoples screen until somewhat later), under their obligations to create liquidity in the share the Market Maker is obliged to gather a stock holding, only possible if they can encourage people to sell, which can be achieved by raising the price. The order is likely to have been large enough to be significantly outside the NMS thus allowing the Market Maker to gather a fairly significant premium on the price (probably being some-where between 50p and 73p allowing the Market Maker to offset gains against losses and still profit). Once the order is filled and the market volumes return to their "normal" levels, so does the share price.
f. Do Market Makers ever lower prices to “panic” investors into selling, sometimes called “shaking the tree”?
i. Yes, moving the price up, encourages sells, moving it down also encourage sells, take another look at this specific company, in the first instance, the price was hiked way up despite the 50p support level, but at 50p few of the people who got in between 20p and 45p are going to sell (and look how many buyers there were still at 50p), the rise was meteoric, smart money just ignored it as it only lasted about 2 hours, but what was probably caught was huge investors who were in way before 20p and had forgotten about it, now they want out. The Market Makers order gets filled, the price settles back to a smart support level and volumes decrease, however the Market Makers gets another order to fill, maybe not so big, maybe not so prepared to pay the premium, but you also know that there are a lot of people out there waiting to see if it's going to shoot up past the 50p support level again or dip and if it dips they're going to sell now before it dips back past their 100% profit level.
g. Surely delaying the posting of trades is Market Manipulation?
i. This was allowed as part of the SETS trading system when institutional investors pointed out that with 100% transparency, any other institutional investor would be able to trade against that position which would put their client holdings in jeopardy. Further, with 100% transparency, if it could be seen that an institutional investor was (for whatever reason) adjusting a large holding in a particular company it could also scare private investors into selling or alternatively encourage them to invest without doing their own research. Both scenarios lead to either over- or under-selling and an inaccurate reflection of the company in the share price as a direct result.
h. Do Market Makers try to reduce volatility?
i. Sometimes, usually at the request of the client (see 1e), this is mostly done by increasing the bid/offer spread therefore discouraging trading especially by day traders and also by marketing the clients shares to institutions in the hope they will take up long term positions.
ii. By asking their client to reduce the number of news releases.
i. Do Market Makers encourage liquidity?
i. Yes, partly because they have a duty to their client to ensure an active marking in their clients shares, and partly because they have a duty to their shareholders, it is only through trading/liquidity that Market Makers make money.
j. How do Market Makers encourage liquidity?
i. Partly just by being there, by being the enabler to liquidity, they will always buy or sell shares if you want to.
ii. By narrowing spreads.
iii. By encouraging their client to produce news releases.
Listing of Some Retail Market Makers: Many of these MM’s have fallen by the wayside, as this information was provided some years ago…but you can get an idea how they work…how some have very special duties that they perform for their clients. For example, it is widely known that VFIN is used to short a stock, dump shares, and to drive the PPS down from the ASK side.

FANC: major S- 8 player: if there is an S- 8 on a Stock most likely he will be there on the ask until it dries up
HDSN: major CD Seller Handles a lot CD transactions.
VIEW: love when he’s on the bid
MAXM: one of the favorites: smart money more like a trader than market maker replaces GNLN for now.
CLYP: heavy seller if you see him on the bid it's unusual
SACM: love when he’s on the bid
ABLE: like it when he’s on the bid
ECN MARKET MAKERS ARCA (formally GNET): very active used by traders, market makers, any one can use ARCA you have to know what your are doing. If you have access to ARCA trading system you can use the ecn.
TRAC: owned by my track if you trade with my track you can use this to place your trade as a liquidity outlet same 4 data.
DATA: owned by my track same concept as GNET & TRAC

Buying has slowed considerably...which means that the high ask numbers on the level 2, if they are not sand bagging with them, will drive the PPS lower...especially with the small numbers on the bid side. It looks to be setting up to jockey back and forth...maybe there is some accumulation going on... It looks like it is setting up to give back some of its earlier gains...
More buyers should come in as they get more info about the partnership with ERB*...which is doing well today. There are more good things on the way with ERB*, which surely will boost USEI's position.
USEI is structured better than ERB*, with the OS/float being only half of what ERB* is.
Daytraders also have had some fun with it... Shorters too strong without buying volume to pressure them to chase the PPS upward... JMHO

We know he sits on the ask and destroys any kind of upward movement... Soooo, maybe he has orders to sit on the bid now, and not let the PPS retreat any lower than .003.
There must be enough buying pressure from the bulls to break through that .0033 resistance...and then, maybe more of the shorts will start getting those margin calls...

Short volume appears to be extremely high, if the numbers shown would continue through today... About 40% shorted shares.
About the disappearing 51% shorted shares...I have seen this happen before, with weeks missing, sometimes. It usually corrects itself.
USEI looks like a good investment now, especially with the heavy short, MM manipulation, and the new deal with ERB*.
But, only money, volume can cause a short squeeze that will push this PPS above its yearly high... IMHO

ERB* has the most highly recognized MJ company in the world, as they have been on all the major news networks... This company is an integral part, a solid partner, that can mesh very well with the "seed to sale" plan of ERB*.
If USEI flies, then ERB* goes along for the ride...and vice versa...

Much has been said about VFIN…and his role in controlling PPS, and then causing the PPS to drop.
VFIN sat on the .012 much of the day, and when the share price tried to break through that resistance, he just sat there, with his 10,000 share offer, knocking down any attempts of the bulls to break through this resistance.
This is frustrating for the bulls, who are trying to mount a rally and break through a PPS stronghold that has been created by MM’s such as VFIN, and the other 3 major players in ERBB (NITE, ETRF, ATDF), with an occasional other MM taking a turn.
Let’s examine the share activity of VFIN for the months from January through July of 2014:
NOTE: VFIN ONLY SHOWS UP ON THE ASK…NEVER ON THE BID…AND HE IS KNOWN TO WORK FOR SHORT ORGANIZATIONS, HEDGE FUNDS THAT SHORT, AND/OR ANY DUMPING OF SHARES BY CONVERTIBLE DEBENTURES, OR THE COMPANY MANAGEMENT. When his work is done…he is gone. He pretty much always throws up a 10,000 ask and just keeps sitting there as people keep buying with him on the ask…obviously not knowing that he is there to drive the PPS down for his clients. He sometimes shows larger numbers on the ask, but usually wants the bulls to keep hitting the ask, thinking that 10,000 number is real, and not a “head fake.”

One can never rule out the possibility of VFIN “naked shorting” this stock, which would add a different spin to the 433 million shares that VFIN had a hand in. Hmmm???
An observation also was that the more intelligent, knowledgeable, with the most extensive DD, that are the most believable, and frightening, pulled back, as well. Oh, they pop in when there is DD that is good, and they are assigned to challenge anything that is solid.
When looking at level 2 all day long, it is important to watch to see when VFIN shows up on the ask, when he leaves, and whether he stays on the ask, or just disappears completely from the ask.
Note: If, and when, the MM’s quit being Market Manipulators, and become Market Makers, again…and it will happen, as the big money is there for them and their clients, they probably will certainly shake the tree…ONE MORE TIME…as they know that there are a lot of frustrated shareholders, some of which, understandably, are a bit on edge, as they have invested quite a bit on American Green.
Someone mentioned they were going to buy 10 million shares in the morning, and that it was going to be millions of dollars. Actually, at current PPS it will only take about $120,000 dollars to buy 10 million shares.
I do not know how much PPS movement a 10 million share buy will cause, especially if an MM is sitting there taking our buy order, and selling shares that they do not have, or short selling the stock, themselves.
An example of what could occur in ERBB, I saw an investor, with deep pockets, one time, show us, as he was talking live to us, how he deliberately caused a stock, that was oversold, shorted, and manipulated, just like American Green, to break through and begin to run. He was talking to us, telling us to watch the level 2, and see a certain MM on the ask at, say 100,000 shares. He would buy the 100,000 shares, who would then move down off the ask, and then he went after the next MM in the order…until the resistance was broken through, and there was clear sailing…as the MM’s were ready to let the PPS run…as the shorts began to propel the PPS higher into a clear blue sky. I wish I had paid more attention, but that is basically how it was done.
NOTE: a team of buyers could, theoretically, become organized, and systematically take out the MM’s till the resistance was demolished…this is all based on the honesty of the MM’s with their bid and ask positions, minus any “head faking”, and other manipulation games that they play. Is this not what goes on daily in most of the stock promotion scenarios, wherein they band together, buy up the stock before others, promote it, then let the eventual bagholders push the PPS higher for them?
It would be foolish to understimate the forces that stockholders in American Green are up against…they are powerful, and well funded, and for us, and American Green, to understimate them is a huge financial mistake…as they intend nothing but to cause fear, division, and destruction to those holding shares. A known fact is that thousands of fledgling companies, such as American Green, are shorted out of business each year in this country. Companies that had enough going for them to become a profitable company that would make millionaires out of many…if we all would just be patient, and wise.
Hold all those millions of shares…lock them in at a very high PPS, so that the MM’s cannot get them and short them…take the naked shorting MM out of the process…buy wisely…stragegically…and everything else will fall into place…IF AMERICAN GREEN IS ON THE UP AND UP, AND WILL DO THEIR PART… LOL
Another thought…as VFIN sat at the .012 level all day, knocking down attempts of some bulls to break through the upper resistance, this .012 probably has become a formidable upper resistance that many of these millions of shares could be used to break through the barrier…provided that VFIN is not sitting back on the ask. In that case, one might be wasting their money, and strategy, in a bottomless pit.
Always be cognizant, in spite of what you hear, that there is a 25% - 45% short position on any given day…and, also note that certain bashers have mentioned their shorting the stock.
It also does not appear that the company is dumping shares, as this usually is done through large blocks of shares. For example, I personally watched 80 million shares being dumped, in 9 million share blocks, until the dumping was completed…and then that MM disappeared.
Behold, I awaken this moning and look at my level 2 and it says .013 – imagine that…it’s amazing what 10 million shares traded can do. But, there are several hills to climb before there is smooth sailing. Those sorry MM’s…just doing whatever they want…when they want… LOL
