I don't know the specifics, but there were emails not allowed to be entered as evidence. Ruled hearsay. Emails/ memos that involved treasury.
Someone else could help me with the exact documents.
We know Lamberth didn't allow our jury questionnaire because "not enough time".
We know he severely limited our damage models.
We know he restricted P's and our experts' talking points on true loss of value.
We know Demarco, once again, lied in court.
We know Lamberth also said falsely that FnF didn't have Golden years.
So, this is insane. Yes, very ridiculous.
Evidence (emails, memos) that should have been allowed, but weren't, coupled with Lamberth restricting topics and people from being discussed steered this thing.
And you have jurors who, Imo, don't understand what preponderance is.
I wouldn't be surprised if some jurors are at odds with each other. So, out of spite, a juror might vote against us.
Maybe jurors should vote in private, so to avoid a mob mentality/ peer pressure. ??
51%? That's it. And yet, here we are.
While we wait on this travesty to wrap up. And I know the case isn't over yet, but what's the timeline on Collins?
I know they have something scheduled next week, but any idea on when actual arguments would be made?

Not advice, but you only lose if you sell AND hopefully you are only BAGHOLDING what you can afford to lose or tie up by BAGHOLDING.
Preferred was higher so they fell and might fall more.
Commons are in the crapper, but didn't move, but might drop as well.
We only will know is when it's official. But a mistrial isn't a win, but it's NOT a loss either.
So if it drops because of mistrial or worse, I'll hold and buy more because I did my due diligence and am rock solid in my belief that I will prevail.
For Preferred and Common, a drop is a buying opportunity in my opinion. This investment is far from over and I will be here when it ends. So depending on someone's circumstances, they will make a decision that is right for them.
If bad news scared me, I wouldn't be in Now or ever.

BULLSHIT! How half did not think P's showed enough to move the needle to 51% or more likelihood that govt was wrong.
There was evidence. People are ignoring it based on emotion and bias. I'd love to hear what these jurors did not understand.
Demarco not consulting on NWS because profits or not, he was set on wind down. How that isn't a 51% + that it was arbitrary and capricious?
Travesty.

That's what I'm thinking. That, if not unanimous in our favor, but a majority, Lamberth pushes for it to be dealt with and it wraps up. That's my speculation anyway.

Preponderance is the easiest to achieve.
Reasonable doubt is the toughest.
I'm fairly certain I read that specifically for this case that it was a Preponderance. AND NOT beyond reasonable doubt.

I've guessed twice $1.6B+interest, but never made his running list. So I guessed a 3rd time.
So, I don't fully understand your response pertaining to my post, but I do understand your point about the fact we're even discussing #'s being a good sign. Because if we thought it was a loser, it wouldn't matter to speak of #'s big or small.

Look at CFPB ruling about unconstitutional funding.
