BPTR: Anthony Cataldo and fraud accusations
This complaint was supposedly submitted to the SEC (by our-street.com). I went through this in more detail and had picked it apart much better, but blogger messed it up and I couldn't publish it.
Anthony J. Cataldo was appointed Executive Chairman in May 2002. He is the person we believe is most responsible for planning and directing the illegal activities we allege in this complaint. Mr. Cataldo has held similar positions
in the following other public companies, namely 1st Miracle Entertainment, Senetek PLC and Management Technologies, Inc. It should be noted that 1st Miracle Entertainment was and may still be the subject of an investigation by the SEC for activities during the period Cataldo was in control of the company.
The worst allegation is probably this one:
On September 16, 2003, Calypte, Cataldo and Oyakawa published a statement [which has since been removed from their website] announcing that “Calypte Biomedical Corporation, the developer and marketer of the only two FDA approved HIV-1 antibody tests that can be used on urine samples, as well as an FDA approved serum HIV-1 antibody Western blot supplemental test announced today that it has received a letter from World Vision Africa, one of the largest NGOs (non-government organization) in Africa, outlining an intent to purchase $4 million of Calypte's urine based HIV/AIDS tests. In a letter dated September 16, 2003, Mr. Dida Guyo, Procurement Officer for World Vision's Africa Regional Office in Nairobi, Kenya, stated that World Vision Africa spends over $1 million quarterly on HIV tests and that World Vision Africa commits to change this quarterly purchase of HIV tests from the standard blood tests to Calypte Biomedical's urine based HIV/AIDS test.”
On October 16, 2003, World Vision published a statement announcing that “September 16 announcement from Calypte Biomedical Corporation reporting that World Vision intends to purchase $4 million worth of its urine-based HIV/AIDS test kits is incorrect. World Vision has no agreement and does not anticipate any agreement with Calypte for purchasing such kits in the future. World Vision has extensive programming to prevent HIV infection as well as care for those affected by AIDS in Africa, Asia and elsewhere. However, it generally relies upon government health agencies to perform HIV tests and does not purchase testing kits independently.”
Our-street.com received an email from John McCoy, the Media Relations Manager of World Vision International. In the email Mr. McCoy wrote “A letter was allegedly faxed from a World Vision procurement officer in Nairobi, indicating that World Vision had an interest in purchasing $4 million worth of Calypte's kits. Our purchasing officer denies sending the letter and, in fact, would have had no authority to sign such a letter of intent to purchase HIV testing kits from Calypte. He alleges that his signature was forged on WV stationary. We are continuing to investigate the matter. There was no consultation with us before Calypte sent out the Sept. 16 press release. If Calypte had bothered to talk with us, we would have told them that such a purchase was highly unlikely. Calypte soon conceded that, in fact, World Vision had no intent to purchase testing kits. In fact, World Vision does not routinely do HIV testing as part of its work. We asked for a correction. Calypte dragged its feet, asking that a clarification be part of another release on authorization of its kits in Kenya. Language that was presented to us to correct this error was unsatisfactory. Hence we issued our own release yesterday.
On October 28, 2003 Our-Street.com received another email from John McCoy, the Media Relations Manager of World Vision International. Mr. McCoy wrote “Below is our official comment on the alleged letter of intent. I should point out that, following our internal inquiry, the procurement officer continues to be employed by WV in Nairobi. A letter was allegedly faxed from a World Vision procurement officer in Nairobi, indicating that World Vision had an interest in purchasing $4 million worth of Calypte's kits. Our purchasing officer denies sending the letter and, in fact, would have had no authority to sign such a letter of intent to purchase HIV testing kits from Calypte. He alleges that his signature was forged on WV stationary, while Calypte's agents in Nairobi assert that the WV officer authorized them to issue the letter. We have no conclusive proof, but based on our review we believe that our employee's denial of involvement is accurate.

On October 2, 2003, Calypte, Cataldo and Oyakawa published a statement announcing that “Calypte Biomedical Corporation, the developer and marketer of the only two FDA approved HIV-1 antibody tests for use with urine samples, announced today that Marr Technologies Limited had increased its ownership in Calypte Biomedical through the open-market purchase of approximately 5.2 million shares of the company's common stock.
The [5.2 million] shares acquired on September 1, 2003 were the result of conversion to common stock of a convertible debenture dated September 1, 2003.

Grassley: Whistleblowers Say DHS Failed To Revoke Exec. Amnesty from Alleged Child Molesting Camp Counselor
Senate Judiciary Committee Chairman Chuck Grassley (R-IA) is pressing the Obama administration for answers on an illegal immigrant allegedly granted executive amnesty who’s now charged with child molestation and distributing child pornography.
According to Grassley, whistleblowers allege that U.S. Immigration and Customs Enforcement knew Edgar Covarrubias-Padilla — a camp counselor in California now charged with four felonies including child molestation — was part of child exploitation investigation as early as November 2014.
The whistleblowers further note that Covarrubias-Padilla applied for the executive amnesty Deferred Action for Childhood Arrivals (DACA) program in 2012 and received an approval through May 2015. He was arrested on May 7, 2015.
“These allegations are deeply troubling because, if true, they suggest that DHS was aware for months or years that Mr. Covarrubias-Padilla posed a public safety threat to the children he was monitoring, yet took no action to revoke his DACA authorization,” Grassley wrote in a letter to Homeland Security Secretary Jeh Johnson Wednesday.
Grassley further noted that there also appears to be a lack of communication between various arms within DHS.
“Of note, news sources have reported that the Santa Clara Sherriff’s Office initiated Mr. Covarrubias-Padilla’s arrest after the Department of Homeland Security (DHS) contacted them with concerns about Mr. Covarrubias-Padilla’s involvement in child exploitation and child pornography. These reports raise significant questions concerning the coordination of ICE and USCIS, in regards to DACA recipients,” Grassley wrote.
The allegations against DHS in the Covarrubias-Padilla are the latest in a number of concerning individuals granted executive amnesty — including a known gang member who later went on to kill four people in Charlotte, N.C.
In his letter to Johnson, Grassley highlights the recent missteps in the DACA program and requests more information about Covarrubias-Padilla case.

In February and March of 2015, I wrote to you about Emanuel Rangel-Hernandez—a recipient of the President’s Deferred Action for Childhood Arrivals (DACA) program who was charged with four counts of first-degree murder in Charlotte, North Carolina. Last month, I wrote to you concerning another DACA recipient, Jose Bojorquez, who was arrested on suspicion of second-degree murder. This month, I write to you again about another potential DACA recipient who has allegedly distributed and possessed hundreds of images of child pornography and who has used his position at a summer camp, employment he may have legally obtained only with employment authorization he achieved as a DACA recipient, to molest and victimize the children he was tasked with helping.
Recent press accounts have reported that Edgar Covarrubias-Padilla, a night counselor at a popular science camp in California was charged with sexually abusing a 10-year-old boy along with distribution and possession of child pornography.[1] Mr. Covarrubias-Padilla allegedly applied for and received deferred action under the DACA program. On Monday, Covarrubias was charged with four felonies, which included possession and distribution of more than 600 child porn images and a charge for lewd and lascivious act with a child under 14.[2]
The Santa Clara County Office of Education confirmed that Mr. Covarrubias-Padilla worked at two campsites over the past two years in various capacities that involved contact with children. According to news accounts, since this story broke last week, the Santa Clara Sheriff’s office has received over 100 calls and 50 emails from concerned parents.[3] Reportedly, at least some of these calls are from parents who believe that their children were among Mr. Covarrubias-Padilla’s victims.
Whistleblowers allege that Mr. Covarrubias-Padilla filed a DACA application for deferred action on October 8, 2012, and was approved through May of 2015. Mr. Covarrubias-Padilla also allegedly filed an application for employment authorization in October of 2012 that was approved with validity until May of 2015. The Committee has received reports that on November 17, 2014, U.S. Immigration and Customs Enforcement (ICE) placed a note in Mr. Covarrubias-Padilla’s record that indicated that he was part of an ongoing investigation for exploiting children and distributing child pornography. Mr. Covarrubias-Padilla has been employed at the camp for the last two years. These allegations are deeply troubling because, if true, they suggest that DHS was aware for months or years that Mr. Covarrubias-Padilla posed a public safety threat to the children he was monitoring, yet took no action to revoke his DACA authorization. Of note, news sources have reported that the Santa Clara Sherriff’s Office initiated Mr. Covarrubias-Padilla’s arrest after the Department of Homeland Security (DHS) contacted them with concerns about Mr. Covarrubias-Padilla’s involvement in child exploitation and child pornography.[4] These reports raise significant questions concerning the coordination of ICE and USCIS, in regards to DACA recipients.
These allegations are particularly alarming because they suggest that Mr. Covarrubias-Padilla would not have been placed in a position to abuse and exploit children had DHS properly vetted DACA recipients. To better understand the circumstances of this case, please provide responses to the following questions, numbering your answers in accordance with these questions:
1. Has Edgar Covarrubias-Padilla ever applied for DACA? If so, was his application approved? On what date? Please provide copies of his A-file.
2. Did Edgar Covarrubias-Padilla have a criminal record when he initially applied for DACA?
3. Has Edgar Covarrubias-Padilla’s employment authorization been terminated? If so, when? If not, why not?
4. Did ICE issue a Notice to Appear (NTA) for Edgar Covarrubias-Padilla? If so, when? If not, why not?
5. Did USCIS know or have reason to know that ICE was investigating Edgar Covarrubias-Padilla in connection to crimes involving either possession or distribution of child pornography or child exploitation, including molestation? If so, please provide details about how and when USCIS knew of any investigations concerning the exploitation of children.
6. If Edgar Covarrubias-Padilla was under investigation by ICE, please provide the procedures in place for when, and in what manner, ICE would have notified USCIS.
7. When did DHS alert the Santa Clara Sherriff’s Office about their suspicions relating to Edgar Covarrubias-Padilla? What component of DHS contacted the Sherriff’s Department? Did this component coordinate with USCIS?
8. Has USCIS taken any action regarding Edgar Covarrubias-Padilla’s DACA renewal? When did USCIS take this action?
9. If USCIS took action after May 7, 2015, what was the cause of the delay? Do these delays typically occur while processing DACA recipients? If so, why?
10. What measures are in place to alert USCIS of DACA grantees who commit criminal offenses?
11. Are DACA grantees continuously vetted against new or evolving derogatory information in the same way that nonimmigrants on temporary visas are under the Kingfisher program? If not, why not.
I request that the Department respond to this letter no later than May 29, 2015.
