You'd think with that attention to detail, someone would have fixed the cash flow stmt in JBII's 9/30 financials. It's like somebody stopped half way through and just plugged the bottom number. It doesn't come close to adding up. Maybe I'm nitpicking, but the most current financial statements is where I always begin my research. When a stock with a market cap in excess of 275 million can't even present a cash flow statement correctly, it's a flag.

wow jimmy, I almost understand your confusion. That statement alone makes it sound like the shares in street name aren't included in the outstanding. Of course, with all of the corroborating evidence to the contrary, most people realize that it is just a poorly structured sentence. The most obvious evidence being the T/A's stock ledger as of 12/31/04 clearly includes the shares held by Cede in the total ouststanding.

Drop in the the total sales, cost basis, and gain or lost on the proper section of schedule D on your 1040, put "various" in both date fields. Then attach the brokerage reports to your 1040. You can't e-file if you do it this way.

From what I've gathered, the basis for Hodges suit are affidavits from the plaintiffs that someone with the DTC told them of the settlement. Whether or not that's sufficient enough to fend off sanctions, we shall see. As long as the sanctions are less than $175K, all he loses is time.
The overall effect to his reputation will only be to strengthen the currently held opinions, one way or the other. Meanwhile, we remain entertained.
Hodges will have to show some factual evidence that creates a triable issue of fact that there was a "settlement." And, here, IMO, Hodges will fail miserably.
