To the Board: I have been asked to keep a running count of shareholders preferences in the matter of authorizing the 18MM share giveaway.
I have agreed to do that. I have not agreed to do anything further. The requests are based on the need to ascertain an idea of which way the wind is blowing before making the investments in getting a full fledged proxy fight going in this matter.
I will set up a seperate email account and will tally the numbers.
I'll post the email address when I get back in Houston ...
Scooby, if management were to make the statement you just made (or even ask someone to make it for them) there might very well be the darnedest legal action you can contemplate.
Bottom line: They are in charge and making decisions & you have 2 choices, ride with them or ride away.
Your statement is closely aligned with the perception of many shareholders ... ie ... that the attitude around the Wilcrest office may just be becoming a little too cavalier.
BTW, there is another alternative ... we shareholders actually own the company and management and all employees serve at our pleasure. Management cannot fire a shareholder ... shareholders can fire management ... unless they give them so many free shares of stock that management becomes the majority ... and there are still a plethora of minority shareholders rights.
Try thinking before you post.
Scooby, you do realize that you are speaking of a man who has become a multimillionaire thru CYGX, don't you. And the same applies to Lawrence. Don't try to sell that 'poor boy slaves to the corporation' crap.
Nobody says that they should not become even far, far richer, but not thru the old share dilution route. You have incessently posted that the share price is going to great heights ... maybe even $100 per share. If it does, then don't you feel that half a billion dollars is sufficent reward? Or is all of that just bluster and bluff?
Until we see some revenue, there have been enough of these stock issues.
I know it is a temptation for them to just keep issuing themselves certificates even if we have only made potential progress, but that is the reason we need to change the board of directors and get the foxes out of the henhouse.
Oh, and I'm going to keep disagreeing when I think something is wrong. Posts such as yours will push me into joining any shareholders revolt that may develop.
I'm not a premium member, so I can't use the private message function of this board. I'm curious if you will be willing to contact me via my email at ragingbull dot com. I'm hogger there too.
I wonder if your references to a real proxy fight are a little strong at this point ... maybe so - maybe no ... anyway, I'd appreciate it if you would contact me over the weekend.
Oh, I thought it was Natasha and we were in Sparks at the Silver Club ... weren't you a car attendant on my run ... rofl ...
Just out of curiosity, are you a shareholder or just another of the alter ego spectre of T.Wizard? For a newbie, you seem to be well informed in most areas ... maybe a little too informed.
If I am misjudging you, I'll offer my apologies in advance, but in three posts you seem to evoke a negative response on my Friend or Foe identifier.
Hey Rick, thanks for the monkey power ... I'm sure you put them in their Highway Patrol disguises ... therefore, the next time I get pulled over, I will feel comfortable in giving them the 'monkey-business.'
Just curious also if anyone has spoken to you about a protest to the board over the proposals for the next SHM or even about some kind of proxy battle?
Holy Schimoleans Holycow, WOW and DOUBLE WOW ... my Scapa Scotch doesn't do that for me ... come on and share .... LOLOL ... wouldn't it be great if even a scintilla of reality of that vision existed in life?
Seriously, I'm wondering if anyone else has been getting calls, emails or visits concerning the upcoming shareholders meeting and an atmosphere permeated by dissatisfaction concerning the upcoming shareholders meeting. Does anyone know for sure how much advance warning must be given ... and how that notification must be rendered???
I've had all of the above and some very valid questions have been raised.
BTW, I'm in deep financial doo=doo due to my addiction to Blue Bell French Vanilla ... seems I overspent in that department trying to satiate my addiction to the stuff and now my electricity has been disconnected due to nonpayment ... at the moment I have been reduced to using four captured squirrels to run circles in their specially constructed cage to turn the old hand crank generator to power my computer .... hopefully next week Doctor Rick will send me a few monkeys to handle the power production .... hay, maybe the Scapa is working after all ...
Excellent point Neo ... and part of this must be chalked up to the fact that our Board of Directors is very top heavy with management. That NEEDS to be changed. We can do this to a small degree this time and that will be a step in the right direction.
I hope nobody misconstrues my posts as attacking the technology or as another poster put it, what HAS been accomplished. I still believe in the technology and have no intention to even think about touching my large cetificates ... may do some peak and valley trading with my trading account, but that's all. Just tried 6K at the ask and it took less than a minuite to move it. Now let's wait for another dip ... if it comes.
Amen Brother Scooby, AMEN. I seriously hope you become a multimillionaire. And as much as it pains me to agree with you, you are 100% right when you say, )"if they get some licensing deals through and raise the value of our investment substantially they are worth every penny of it ..."
Now all we have to do is wait for those deals to be signed, sealed and delivered and THEN management can reap their just rewards.
Now that, Paulness, is being specific, isn't it. It just might also mean that Darth Vader has been cloned and we are going to market our own version of the Dark Side.
Let's not dwell in the land of dreams and 'what might be.' We might also have the cure for lazy workers ... but maybe we want to keep it a secret.
maybe the stock option plan means that they did do something already to make money and we all just don't know it yet once we do the plan for the options will be justified ,although the new way of making the DNA in my eyes is enough justification but I think that something big has happened and we just don't know yet.
Paulness, I do not need to buy in ... I have sufficient holdings in CYGX and intend to maintain that position. If you want to stay focused, then I submit that you should proivide some hard facts that justify this major dilution that will benefit on a select few.
There have simply not been enough SUCCESSES to justify giving management millions of dollars of additional compensation.
Thanks for the vote of confidence Tatankano, but the truth is that I am not trying to enter a power struggle. I am only hoping that a majority of the shareholders will stiffen up and vote against this or at least withhold their votes so the necessary quorum will not be met.
There is also the issue of returning board members. I still maitiain that we need more external control of the board. There is nothing personal in this, but just a strong belief that the foxes should not be in charge of watching over the henhouse.
I'd like to believe that ultimate power of the board of directors will be vested in competent folks who have no possibility of being swayed by self interest. Let's avoid even the slightest hint of the possibility of partiality.
Get real Paulness, you still believe that NESS will fly and that Hayseed was a good and honorable man who had direct discussions with God and that Sha will lead the company to great riches.
Realistic stock options are a great means of compensation, but we have left reality behind this time. Give them twice that number when they have provided some real success. And that means the introduction and marketing of a treatment that is generating vast revenues for the shareholders.
When we talk about management, we are not talking about a group of 'working stiffs' but are talking about folks who have become multimillionaires thru CYGX. That point was made during the ill-advised and ill-fated CYGX vs Waldroff trial.
IF they actually perform and get the products to market, THEN they should be rewarded. We should reward accomplishment instead of intention and potential. You do not get a gold medal for running the worlds fastest first 75 meters in a 100 meter dash. Win a race and then ask for reward.
Am I the only one that is mad as h&ll about this nonsense. Is it possible for us shareholders to just vote ourselves a few extra million shares? You can bet I will be at the meeting to once again vote against this dilution. I hope others will either withhold their proxies or give them to someone who will represent the shareholders instead of members of managements wealth.
It is past time to stop issuing shares based on anything other than RESULTS, and we are still waiting for those. When they come, we can give out even better rewards, but not until something is actually signed. sealed and delivered. And shouldn't the majority of the rewards go to the folks in the lab who have actually accomplished something and given us some sucesses instead of just promises.
THE BOARD OF DIRECTORS HAS UNANIMOUSLY APPROVED AND RECOMMENDS THAT SHAREHOLDERS VOTE FOR APPROVAL OF THE STOCK OPTION PLAN AND 18,000,000 SHARES INITIALLY RESERVED THEREUNDER
Arnold, I am ashamed of you. Can you offer even one small reason for continuing to dig up past projections that completely missed their mark? Why do you harp on timetables that had their legs cut off?
Don't you realize that management wants us shareholders to authorize another dozen plus million shares for distribution to themselves and if you keep up pointing out that they have failed to meet any of their deadlines, then the shareholders may just decide not to approve of another massive dilution.
And please don't tell me that you subscribe to antiquated principles that imply that someone must EARN their rewards. I do not want to hear that additional shares should be based on actual performance. If we use that guideline, then Yin and Harrylin and a couple of others in the 'backshop' will be the only ones entitled to compensation.
Please, refrain from posting such nonsense. Oh, and don't be asking any questions about where the herpes and other skin disease treatments are languishing. Don't want to see anything that would diminish the chances of Lawrences dream coming true ... I can still see him literally dancing around my living room.
Paul, one last comment on this ... Audiostocks is a site. The key word is 'site.' Audiostocks is a website, ie a site. It is not working. The individual interviews therein are not sites. If you will read my posts, or have someone read them to you, you will see that I have correctly referred to other sites and even listed some examples. I wish I could have included pictures so you could understand.
And don't even think about including me with thaliowizard.
Hey BigB, judging from the 10K+ purchases lately, do you think someone is doing a bit of gradual accumulation?
Paul you spent too much time on the nessie board. All of the other sites are working very well: TSRNsports, ABCnews, etc, etc. The only site that is not working is the Audiostocks site ... and it is a total trainwreck.
If you are going to try to discredit me, at least employ a little common sense and actually check other sites first. BTW, how much has CYGX invested in this venture?
Same results here ... no audio. Checked some of the other sites and they all work okay. Another great investment in PR????
Hey HC, that sounds like our favorite 'monkeys uncle' (GRRDVM) ... LOL
My neighbor went on the fruit diet. Nothing but fruit. Bananas, apples.... He hasn't lost any weight but you should see him climb a tree.
Yeah, BigB, the archives are free. Just google Houston Business Journal.
Hey BigB,
Do you (or anyone else) have a copy of the current Houston Business Journal with the article about plans to build a $3MM plant somewhere near the current offices? I had it read to me on the phone and was especially currious about the 18 month time frame mentioned by Frank.
Hogger
Good Job Captain, you really put one over on this old Admiral. It was completely hilarious and I never took a word of it seriously.
However, as I stood to leave the room, I must have tripped over an anvil, but the doctor says that the new screws he put in my ankle will last for years. Eventually, he says, the pain and swelling will either go away or at least become barely noticable. Nope, your post didn't upset me at all.
And the lawyer my wife hired isn't such a bad fellow. Even if he has taken ever poor husband to the cleaners, he has always patted them on the back as they left the courtroom. I can not understand why she is so upset. The cat was getting along in years ... gosh, she had had her since Reagan was in the Whitehouse. It was a very funny post for April Fools Day.
I did have a few harsh words with the insurance adjuster, but he was actually nicer than the Constables who came out to visit. Oh, I guess they weren't that bad ... the cuffs didn't completely cut off the circulation. Wonder who left last years calendar on the wall ... I would have sworn it was still March.
Anyway, you really did a good job with that post ... very funny.
That is correct. Haven't I made that clear in the past?
Hogger, you have a vested interest in both companies from what you have posted in the past? You are also a good friend of Dell Gibson, right?
When are we going to have lunch over at Yao's folks place? BTW - there have never been more than a couple of shareholders who ask questions and really only a couple who have dared to ask the "harder" questions at a SHM. Maybe the next one will be different.
Very well thought out post, IP ... it contains information that could have only have been gained by either being in the court room, reading a transcript or talking to someone who was in the court room. It sounds like the latter because of the interpretations and the weight given to certain segments of the testimony and evidence.
It is certainly easy to understand your slant and I'm sure a lot of other people would develop the same opinions given the information you apparently were given. However, there are other factors which play into the overall scheme of things that would also give validity other conclusions.
The CYGX/Waldroff license needs to be renegotiated ... that is very apparent. However, the existence of the Waldroff/AVGI license is equally in need of renegotiation. This is where the difficulty level shoots up exponentially. Can you say, "CLASH OF EGOS?" Waldroff will find himself caught between two forces that are more powerful, vengeful and illogical than a woman scorned or raging teenage hormones.
Several others have alluded to the most worrisome line in your post:
It is possible that CYGX has another potential licensee and wanted the field of use back to make a better deal.
IF that is the case, will we see the same strategy re-utilized again and again? I hope you're wrong about that. Volumes could be written concerning that manner of strategy.
Anyway, thanks for the thoughtful post of your conclusions.
Holycow, there is no doubt that the science is not perfected yet. But that is the reason financing is soooo important. Research does not come cheap. An amazingly great amount of champaigne research (and progress) has been accomplished on a beer budget. Had there been sufficient funds, we would have been far,far ahead of where we are now.
Dips are indeed like brothers-in-law ... they are a fact of life.
Well said Arnold,
After several emails, I think I, too, need to clarify a couple of points. I am still long and a certified believer in the technology. I am still convinced that some day Yin will walk across that stage in Stockholm. When I say that, I am totally candid about it.
If CYGX would just release a press release that was simple to understand and stated 'pertinent' information I think it would help greatly. We need PR's that tell us something about progress. A PR about a successful animal study would go a very long way. A PR about obtaining financing or a partnership would do the same ... maybe even better. The question is, "Is one forthcoming?" You make a good point about the lack or private placements. If there are indeed none, then either someone is out to lunch or there is something on the horizon that is expected soon.
Like you, I can't put a finger on it, but there have been rumblings and we may be approaching a jump in progress. It's time. We need more available cash so we can actually multi-task in the R&D department. They have done near-miracles in the past. After all these years of just-in-time financing it would be great to have a surplus on hand. It is obvious that the lack of long range planning (and the execution of that plan) have been and remain a thorn in our side. That said, some of the rumblings I'm hearing may indicate that we will soon have sufficient long term financing in place. In that case, I'll enjoy eating the roast crow.
Maybe that "Ides of March" crap got to me a little, too. Or maybe, just maybe the Idea of March are coming late this year. Remember 1927 when they came around May 5th. (LOL)
Don't anyone mistake my criticism of anyone in management as an indication that I am considering pulling the plug. If anything, we're stillconsidering adding a little bit more.
I did bring something to the table a couple of posts back, but darned if all the rose-colored-glasses-wearing cheerleaders didn't just ignore it as they hoped it would go away.
And my last post asked a very serious question. If it turns out that my latest information on that subject is correct, it will mean that:
1) I was outright lied to;
2) Management made a stupendous blunder;
3) Someone did not learn from their past mistakes.
You may not think that has any bearing on the future of our corporation, but I darned sure believe that to be the case. This could be a most serious matter that could have profound repercussions on our stock.
I'm hoping that someone (like you) can get to the bottom of those questions and put some current facts on the table.
Paulness, I know you mean well, but is there even the slightest chance that you will cease posting ancient material? You may think that it is contributing to the betterment of the corporation, but it asctually has just the opposite result. Is there some reason that is just off the edge of my radar? It is like some of the bashers continual posting of ancient information that has nothing to do with the surrent state of affairs.
If you want something constructive to do, see if you can find out if CYGX did business with anyone who had been banned by the SEC?
I heard that the Judge gave Waldroff/AVGI basically everything they asked for. Can anyone confirn this?
Suky, most of us prefer bloodletting, but face facts. It takes a long time for the coagulation to produce good blutwurst, but LO says you can immediately fry (or if you are a heathen, boil) those tasty leeches or maggots ... now where is that garlic butter?
I kinda prefer bloodletting to maggots. Works faster.
OT to Dr Rick: Greetings to my favorite monkey's uncle ... sorry that your signing experiment turned out to be just one big bust ... I suppose that the ACLU will now be using the poor paramour to enhance their campaign encouraging the practice of safe sex and the stock we purchased in that primate condum company will skyrocket.
We should all try to have more empathy and understanding for her lover who obviously wanted her so bad he would die for a little new key (uh, didn't Janice Joplin sing about that?).
We have started a defense fund after the revelations that you have been indicted. We are using the separation of church and state as the rallying cry ... I'll explain that as soon as we figure out how. We are also appealing for additional support from NOW based on the fact that your poor pregnant money has the right of choice.
Hope this brightens your day and that the offended gentleman is able to afford a reduction and counseling.
Hogger
hogger..........Jerry, I have good news and well..............
The last escaped Rhesus has returned in excellent health and there was a small celibration.
Seems 10 days in the lowlands of South Carolina "wilds" was a good vacation for the primate.
One thing.........she's pregnant !
I have nothing further to say on this subject except that to the special person............. she is HERPES-B positive.
She has become somewhat of a celebrity locally and I guess has a new close admirer (who is going to die)!
Remember the wire-news article you posted last week entitled "SHOW ME YOUR NIPPLES". The Gorilla's amist doing sign language.
Seems it moved me so much, I trained 1264 Rhesus to "sign" this message............"SHOW ME YOUR NIPPLES".
Unfortunately I have been indicted on 38 counts of sexual harassment by 37 lady co-workers and 1 gentlemen co-worker (?).
Such is my life in the South Carolina lowlands.
It's not a job, it's an adventure.
Best - Rick
Rick (Grrdvm) ... post this for the gang and remind them that a few renegade moneys isn't such a big problem after all .... ROFL ...
Chimps Escape, Attack Sanctuary Workers
Thursday, March 03, 2005
CALIENTE, Calif. — There's wild news out of the Kern County (search) today as some chimpanzees have seriously injured two workers after escaping from an animal shelter.
Authorities say the chimpanzees (search) escaped from their cages at a place called Animal Haven Ranch (search) in Caliente, located about 20 miles east of Bakersfield.
A spokeswoman for the Kern County sheriff's department says one of the workers had major injuries and had to be airlifted out of the compound.
At least one of the chimps has been shot and killed and the search continues for others that escaped.
The Kern County sheriff's department and local animal control workers are at the scene trying to track down the missing animals.
You are correct, doc, they were killed (not died) and analyzed (autopsied). The current PR is just too danged ambiguous to really give any meaningful information. It's just another poor example of a news release. You can read just about anything into it you desire ... and yes, it is probably good news so the PPS dropped. LOLOL
Just by way of an update, there is nothing to update insofar as the awarding of attorneys fees and other decisions to be made by Judge Davidson in the CYGX vs Waldroff and AVGI matter. Hopefully, he will hand down his decisions by next week, or sooner. Thus far he has proven himself to be a very conscientious and fair person, so whatever he declares will no doubt reflect his learned and objective decision.
Paulness, that is a common code used by MM's who are also deer hunters ... it is for two thirties, or thirty thirty (30-30) and is asking if anyone has a good deer rifle, caliber 30 -30 for sale cheap. You know they are serious when they use the code 105 or 155. If it is followed by code 207 it means that they want the gun to be self propelled .... rofl ....
Saw a code come in at 230 sold this could mean news at 2:30 or a big buy start .I wish I could get these MM codes down.
ROFL ... sounds like a conversation with a government official I had in China a couple of weeks ago ... They have already greatly increased their rice production thru bioengineering.
Lots of applications in agriculture too for this type of technology. Folks would not have to worry about eating bioengineered foods either.
CD, using the technology in the wild is going to be extremely challenging. Whatever delivery method ends up being the most effective will require at least a semi-controlled environment. That is one of the reasons that shrimp farming is so attractive. The idea of dumping sixteen gigaliters of goo in the ocean has all the potential of a Keystone Kops feature ... rofl.
Rusty, it has been a pretty long time since I checked on either. At that time both were partially complete. For instance, the Equine Intercellular Adhension Molecule had been identified, but many others remained unknown. An international project was making great progress, so I imagine many, many more have been identified. Research on the shrimp was also being carried out internationally. Some of those I communicated with were very optimistic that they were getting very close. Given the time that has passed, I would imagine that they are now known ... but that is just my DAGWAG.
