He did get the delay time right (and then some) although not for the reasons we all thought. The ptab is on shaky grounds and looks like they need to get their ducks in a row before they deal with us.
No, we won’t see ptab again. But we will appeal to the cafc if ptab doesn’t rule in our favor. And they will make the right call.
We are close to 3 months since the new lawsuit has been announced. How long does it take to get a court date or even a hearing. Also, I wonder if the Activision/Bungie fiasco have something to do with no date being announced yet. We got all claims back yes, But if the ptab comes back and says CE does apply, we will lose those claims again. Is this right.
Didn't Worlds hire a pr firm? Isn't there anything they can tell us? It doesn't have to be hype. Some sort of information on what point we are on in the new lawsuit. Or if they have an idea that the delay in the ptab is based on the polaris suit. We know they don't have an obligation to divulge at all. But Something, anything would be nice.
I would assume it's still business as usual with the Ptab. The problem seems to be when IPR's muddy the water. We are a part of that argument. Can anyone else come up with another explanation? It makes the most sense right now. Who knows, I could be wrong and our case gets a favorable judgement tomorrow. That would be nice. Glta.
If the ptab is ruled unconstitutional, there will be big money defendants with a lot to lose who like it just the way it is and may appeal to a higher court. I hope it plays out in our favor so Thom and his shareholders can finally get justice.
thanks old owl, I wasn’t sure if there had been an actual decision yet. I thought it was still under review. We all know how slow the process is. Is the next step the Supreme Court?
It seems we are waiting on a decision from another case which will determine whether the Judges at the ptab are constitutional or not. The case argues that since those Judges were not chosen by the President, their decisions may be rendered moot. Worlds is at the mercy of the system and I don't expect any movement for us until the other case gets resolved.
I agree. At some point Worlds lawyers would have to appeal to a higher court to get this resolved. What I would really love to know is, who in there right mind came up with the idea of “hey, this looks like something we should be able to take all the time in the world and never have to rule on”?

I haven’t been in this stock for very long. About 2 months before delisting. He/she very well may speak to Carter. I’m referring to all the flip flopping. Why are the claims even an issue if Bungie is time barred? (IPR should have been first)That's what we're asking. Why did the Cafc even introduce CE at all. If other future infringers want to take it that route then we are stuck with that. But this case should get all claims back for the time being since Bungie should not have been a participant.
Was it bungie that had the Worlds patents reviewed which resulted in getting claims tossed out?

If chanbond's lawyers inquired to cable labs about the patents, wouldn't it be their job to compare to see if they are indeed the same? Sorry, I have not done any homework on cable labs, but the way you speak about them makes them sound as a policing agency. Am I correct?
I don't believe the commission free trades apply to penny stocks. TD Ameritrade just charged me a commission on a penny 4 days ago. They just went commission free last month.

I agree with you.(still scratching my head) I just said CE was the issue because the Cafc bowed to Activision and made it a problem instead of fixing it right then and there. It is the only thing left that I can think of as to why we are waiting so long. It should be a moot point since Bungie shouldn't have been allowed to challenge the claims. Discovery was ruled upon already where it would not be opened up for either party. Bungie had the burden of proof that they were a RPI and no way to prove it.

Someone please feel free to step in if I get anything wrong here. If the Ptab decides to stick with their ruling it just means they have no idea how to get out of this mess they've created for themselves. Collateral Estoppel is the issue. If the Ptab rules that worlds is not estopped since Bungie should never have been involved because they were time barred, then Worlds will get to take ATVI and Bungie to court with all claims intact. Atvi is saying that some of those claims were already deemed invalid, so how can they be used against us? I think maybe the long wait is that the Ptab is trying to decide how this could effect future suits.(ours or others) Being some of Worlds claims had been deemed unpatentable during the Bungie fiasco, will the other litigants get a new crack at invalidating the claims or do the claims stand (validated) because of a so called technicality. it was the Ptab's mistake after all when they denied discovery. The Ptab needs to create rules for themselves on discovery and not rely on hearsay. I still don't have a clue as to why this would take that long. Does anyone else know of any other case going on that would affect the Ptab's decision on us.
I'm wondering how many other cases (past and present) could be affected if the ruling were to come back in our favor? How many other plaintiffs has the Ptab denied discovery to and their cases fell apart. If this has happened to others before us, does anyone know if they would then be allowed to re-open their suits, or are they just plain SOL?(sh#t out of luck) If yes, then that could be a major headache for the courts. Is the Ptab seriously trying to get this thing perfect? (It seems like such an easy decision) Or is the long wait simply a vendetta against Worlds for calling them out? One last thing, I have my doubts that settlement talks are going on. (Just my opinion) I really don't see what they would have to talk about until the Ptab rules.

Are you sure a work around is even possible? If they had one why haven't they implemented and filed their own patents? This lawsuit has been going on for minimum of 8 years now. Of course, it's not going to bankrupt ATVI, they're a $40 billion company, but it does put other infringers on notice. The loss of Destiny put a good size dent in the stock when ATVI announced they had relinquished it to Bungie. Why did they do that? Any ideas? WDDD is only a quarter stock. Throw a couple thousand down on it and use it as a hedge.

I like the Idea of filing this lawsuit. But I'd love to know the thoughts that went into the decision to file. We already had some claims that passed the ptab a long time ago. Thom sold some shares of MRMD which gave Worlds cash to help start this suit quite a while ago. I'm hoping a little birdie told him... it's a go.
