Why are the claims even an issue if Bungie is time barred? (IPR should have been first)That's what we're asking. Why did the Cafc even introduce CE at all. If other future infringers want to take it that route then we are stuck with that. But this case should get all claims back for the time being since Bungie should not have been a participant.
