What court and what action is generating this motion to compel?
DE Superior Court 09C-02-030
It was hooking GeckoSystems up with an abusive MM for an S-1 that was a continuation of the con. Burt Martin Arnold - I've posted the SEC & FINRA disciplinary record recently.
But no evidence Wallace had anything to do with this.
Wallace also collaborated with MacLeod on the ProDec scam.
Cite one verifiable fact that Wallace was involved. More nonsense.
Motion to compel Ms. Sims to answer discovery is scheduled for court tomorrow. She is a defendant in the RICO lawsuit. Will she expose Wallace as the ringleader in the racketeering activities against GOSY?
I agree with you. I haven't seen wheelchair videos from any other robot company. GOSY's wheelchair in the large shopping mall and grocery store are very impressive, IMO. If others had developed an auto-navigating wheelchair like GOSY they would post videos, and not short videos from a lab but videos from crowded public places like Gecko did.
What court and what action is generating this motion to compel?
Big Apple dropped the ball - MacLeod bought Wallace on at that point. Advising Spencer to end the relationship with Big Apple was sort of stating the obvious.

spencer went public before Wallace ever heard of him. Wallace was the one who advised him to end his relationship with Big Apple.
spencer has issued a PR saying he has signed a licensing deal that will generate profits. Is there a PR from the Japanese company making the announcement of the deal? If not, why not? This Japanese company issued a PR before spencer's trip saying it was looking forward to discussing the market with him. Wouldn't signing a deal be a much more significant event? Makes no sense to issue a PR announcing a meeting, but no PR about the result of that meeting when a deal was done.
The "deal" spencer implied he had with Fubright turned out not to have been signed. An admission spencer made only after facing a motion to compel. spencer faces another motion to compel August 4th seeking a copy of this new agreement. It will be interesting to see his lawyer's objections which must be filed prior to August 4th.
Yet Research and Markets continues to discuss the tech in their research reports. Personally, I found the performance of the robot in videos that were even older compelling. You have to know what else is out there, or rather what isn't out there, to appreciate SafePath's capabilities.
http://www.researchandmarkets.com/reports/3678099/global-mobile-robotics-market-2016-2020#pos-5
It's no secret that funding has been holding the company back - that is why they have been focusing on licensing SafePath rather than engage in death spiral financing.
The company went public to raise funds. The actions of MacLeod, Wallace, Little and others kept them from doing so. Spencer has taken the only reasonable course in seeking to license the tech to the Japanese.
I doubt new videos will generate much interest. There needs to be verifiable income.
The 8 year old video at this link,
http://www.geckosystems.com/markets/personal_assistance.php
would not move anyone to buy a single share of GOSY.
GOSY has got to delete/remove every one of the antique videos, and show what is being done today.
Start over R., start over.
We've been hearing for years how great the tech is. But if no one wants to buy it, it has no value.
spencer now claims he has signed a deal that will generate revenue in the low $100s each quarter. He has stated, for the second time, that the company is net profitable. (The first time turned out to be a lie).
Time will tell, but SHs are long past trusting his PR. Wouldn't it make sense if he signed a deal in Japan that there would be a PR from that company praising the tech and announcing the agreement? Anyone got a link for that?
Caregivers' health at risk due to stress - study from the American Psychological Association.
GeckoSystems has valuable technology that has been developed over a period of 18 years. It is CEO Martin Spencer's dream to make people's lives better through robotic technology.
Although his primary focus has been an eldercare robot that will keep an eye on an aging parents in a home care setting, the company's has also protyped a collision proof wheelchair.
Controlling a wheelchair is not a simple matter. No matter what the current system of control is (joystick, head motion, sip and puff) it has to be delicately adjusted for each user. Factors such as tremor and spacisity have to be compensated for. Speed must be limited for safety and speed limiters slow things down even when the enviroment is safe for a higher speed. Different running surfaces such as carpet vs tile also affect chair performance, door thresholds can be serious obstacles.
The GeckoSystems suite of sensors and artificial intelligence deals with these issues. The end result is more freedom and productivity and a better quality of life for the wheelchair user.
Marketing SafePath(tm) navigation is a BIG DEAL for GeckoSystems. Once the system is available on the international market it will be a BIG DEAL for the disabled.

Just like the wheelchair which has been studied to death by academia but never developed as a practical solution, eldercare robots have also been studied heavily and resulted in nothing marketable. Kompai is the perfect example of this.

As soon as Mr. Spencer learned that George McLeod was running a scam on GOSY, he fired McLeod according to court documents. Wallace and MacLeod have been working to destroy GOSY ever sense. Guess they didn't think about a RICO lawsuit being filed.
What RICO lawsuit? The one that was dismissed against Neil Wallace? the one that hasn't been served on his parents for over a year? The one that didn't name Macleod as a defendant? The one that spencer's lawyers quit? That one? Yeah--I'm sure Wallace is losing sleep over that.
As soon as Mr. Spencer learned that George McLeod was running a scam on GOSY, he fired McLeod according to court documents. Wallace and MacLeod have been working to destroy GOSY ever sense. Guess they didn't think about a RICO lawsuit being filed. Big oops, IMO.
gosy has offered robots for sale and lease as far back as 2007. Not one has been sold or leased. Is this a marketing problem or is there no demand for these specific robots?
Why GOSY is taking the correct approach with robotics by designing them for family enrichment rather than emotional surrogates.
The idea that the CareBot is an appliance in service of the family who wishes to attend to and take care of an elderly parent is crucial. In addition to the obvious dangers of a robot who can seek and destroy acting as an assasin or a carrier of a WMD, we have the emotional and ethical concerns identified below:
Again, that is not what I said....
Wow--Wallace was a Facebook friend of Speciale since 2012? Wasn't Wallace fired in 2007? It took him 5 years to acknowledge his friendship with Speciale? And being a Facebook friend is the same as being an actual friend, associate and business partner, correct? Any evidence that Wallace ever met Speciale? Ever talked to him? Or are all of Speciale's Facebook friends responsible for anything he does simply by virtue of being a Facebook friend?
Here's an easy question for you--has Wallace ever posted any message on Speciale's Facebook page? What nonsense.
Is every Facebook friend of Wallace's guilty of manipulating the DE courts? What complete nonsense.
Yes,but MacLeod brought both Big Apple and Wallace in, and Wallace had Speciale as a facebook friend in 2012, which was the last time I looked. I archived the page but it may no longer be the same.
Just like rog to blame everyone else for his failures.
but Tom Speciale was the friend of Wallace that worked with Big Apple and Fairhills.
Got a link showing that? I heard Speciale was a friend of spencer's and spencer introduced him to Wallace. spencer signed the Big Apple deal before Wallace even came on board. spencer had the relationship with Big Apple. And now spencer's lawyer is Jonathon Leinwand. Nuff said.
Wasn't he also involved with a PR service at one point? Think they probably ran the PR's for free so they could front run the stocks.
A toy ... with no navigation skills at all.
Another example of what can be done by actual roboticists.
So far ahead of GOSY.

Polatoff has some relationship with Vstock Transfer I hear.
Sorry, that was an error - too many actors in this farce. Polatoff was involved and I have to go back to my notes to see how, but Tom Speciale was the friend of Wallace that worked with Big Apple and Fairhills. I corrected it in a PM - forgot that it was a public post.
Do you have a link to anything showing the relationship between Big Apple and Polatof?
So you're saying you're proud of spencer for refusing to obey the court order and having an arrest warrant issued for him? Very foretelling.
I have no idea what Sims will do or not do. But spencer's claims that she conspired with the Wallaces to commit two felonies in violation of RICO is wacky. He doesn't even allege she received any benefit from the RICO scheme. Now do you understand why his lawyers quit?
Isn't there an arrest warrant issued for spencer in DE for not appearing when ordered?
So you are saying the Ms. Sims will not show. Very foretelling.
Although SHs could sue him civilly for his deliberate deceit
.
How did he benefit from this deceit?
We'll see what she knows when Spencer asks her.
There is no deposition on the 14th. spencer will not ask her any questions. Read the motion papers.
Are you saying now that she will fail to report to the court as ordered?
Isn't there an arrest warrant issued for spencer in DE for not appearing when ordered? That's gotta make the SHs proud.
We'll see what she knows when Spencer asks her. She may know the identity of the Illuminati.
Are you saying now that she will fail to report to the court as ordered?
This could be a new start, beginning with the deposition on the 14th.
There is no deposition on the 14th. And you think Sims has knowledge of the papers submitted in DE EIGHT years ago and participated in the conspiracy to allgedly forge Harold's name?
If the evidence was that strong, why did his lawyers quit? Still can't answer?
If you want to talk about fraud, there's a list with spencer's name on it.
What are the damages then?
Jail. His fraud is criminal, not civil. Although SHs could sue him civilly for his deliberate deceit.
Not sure that just hiring lawyers exactly proves that Neil has or had consent regarding the estate.
spencer has objected now.
His parents hired a lawyer to pursue the case. This proves they consented to filing and pursuing the case. And spencer's objecting now?????? Why didn't he object when he believed it could have ended the case and he would have kept his stock?
If you want to talk about fraud, there's a list with spencer's name on it.
What are the damages then?
Yes, we see how defensive he gets, LOL! Does Wallace have a LinkedIn page?
This could be a new start, beginning with the deposition on the 14th.
No, It means they didn't want to see Neil go to jail. You can't consent after an illegal deed is done and make it legal. If Harold had agreed before hand he would have signed a power of attorney, IMO.
Wrong. Harold's consent was not required in writing to make it legal. Please check out the definition of "ratification" if you dont believe consent can be given after the fact. Although you have no evidence. And if it was illegal, why didn't Gouge object? Was he incompetent?
What I find funny is the claim that Harold didn't want to proceed but agreed to so Neil wouldn't go to jail. Except only Harold had standing to complain and put Neil in jail. spencer had no standing to do so.
It's hilarious that some believe that conduct which occurred EIGHT years ago and was never objected to will now be the basis for a remedy for spencer. Not even his former lawyers believe that.
If you want to talk about fraud, there's a list with spencer's name on it. Let's start with elaine's sworn statement to the court that Mrs. Wallace was the legal owner and spencer's ownership had been canceled. And thereafter, spencer files a quarterly report stating he is the owner. (He then filed a subsequent one with a footnote). and how about his fraudulent claim of receiving $750,000 in revenue? The last thing spencer should want to talk about is fraud.
LOL, rog has lost every case and appeal and now his lawyers have quit.
He's got no tech, so he harasses the person who beat him in court at every turn. It's bad enough that he ran this company into the ground, but his jealousy over Wallace's success in the face of his failures has turned him into a raving madman.
It sounds like Neil gets very defensive when asked to verify or produce proof.
In the recent RICO court filing by Spencer the point of a POA (or lack of one) was made. It shows where a POA was requested of Wallace numerous times and one was never provided. I think a couple of letters are in the exhibits about that very issue.
You can't even unsubscribe them from a mailing list without a POA.
Looks like the Wallace's hired many lawyers in the past, and it does not look like the stuck around the whole time.
Not sure that just hiring lawyers exactly proves that Neil has or had consent regarding the estate.
spencer has objected now.
No, It means they didn't want to see Neil go to jail. You can't consent after an illegal deed is done and make it legal. If Harold had agreed before hand he would have signed a power of attorney, IMO.
So you are saying that just because Neil's lawyer proceeded with the claim then it was consented?
No. I'm saying because the Wallaces hired a lawyer and proceeded is proof they consented. Since they proceeded, it is clear they consented. How was spencer injured by the signatures if the Wallaces consented?
Why didn't Gouge object?
Why did spencer's lawyers quit the RICO case?
Still can't answer?
The forgery/fraud claim is nonsense. That's why Gouge never objected and the RICO lawyers quit. QED
So you are saying that just because Neil's lawyer proceeded with the claim then it was consented?
The fact that there were subsequent proceedings proves the Wallaces consented. They hired a lawyer to pursue their claim. Still won't answer my question? Not a surprise.
And the subsequent proceedings prove that it was.
So how were they proven? By notarized documentation?
Not sure why these types of things were not filed before but they seem to be now. I'm fine if you don't want to comment further on them.
Would they also be obligated to say if it was or not his?
Since Harold is no longer with us, the estate representative could be asked for an opinion. But the question is irrelevant. The only relevant legal question was whether it was signed with his consent. And the subsequent proceedings prove that it was.
Wouldn't Gouge have objected if there was anything improper? When I see the answer to this question, I'll consider further contributions to this dialogue. Otherwise, this no longer serves a useful purpose.
And after you explain why Gouge never objected, you can explain why spencer's lawyers quit his pretend RICO case.
I didn't mention Harrold but I'm glad we are on the same page.
his estate would have the right to object
Would they also be obligated to say if it was or not his?
Perhaps he will sue in the proper state. I have no idea, that is something you will have to ask spencer yourself.
Are you 100% sure on that? So a forged signature mailed of efiled would not be mail or wire fraud if the person that signed was dead?
Correct. If it was signed without the consent of the person and filed on his behalf against his wishes and he then died, his estate would have the right to object, assuming the statute of limitations hadn't run and of course assuming they did not want the letter or filing to be submitted. If they did, there is no forgery.
Again, if it was forgery, where was Gouge? And if the Wallaces did not agree, why did they hire a lawyer in DE to obtain the judgment and collect? It is clear the Wallaces agreed with everything in the submission--so there was no forgery and no harm to spencer. He would have been in the exact situation had the Wallaces signed it. That's why the forgery claim is nonsense. spencer suffered no injury because of the signature. Gouge understood this. Hence he never objected. Why not call him and let him explain this to you. I'm done. I will not comment anymore on the absurd claim of forgery.
spencer has zilch. Which is why his lawyers quit. If he had a case, he'd sue in the proper state.

Consumer Market Our focus is family care for the elderly, chronically ill, and children. What does it do? Let's you remotely see how they are doing using the onboard wireless webcam and ability to automatically follow Grandma or little Johnny. Should Grandma, or Johnny, not respond to our CareBot's™ inquiries, you, or other designated caregivers would be contacted by GeckoChat™ immediately by phone. Professional Healthcare Market Our focus is making nurses more efficient and productive with less work by them. What's it do? Enables nurses to video conference doctors in for more timely diagnosis of patients while carrying all the specialized supplies and equipment the IV or wound care nursing specialists might need. At night the MSR can deliver bed pans, medications, even take vital signs, etc. to those in need while the night shift nurses are busy with a crisis on their wing or floor. Commercial Security Market Our focus is dramatically improving surveillance in our post 9/11 world at lower cost and greater efficacy than human guards. For example, human guards would tire quickly hauling WMD detection systems. Our SecurityBot™ MSR's do not. Defense Industry Our MSR's can explore urban dwellings while looking for human inhabitants --automatically-- without any human invention or control. This can save lives by placing our troops back one step from an unforeseen ambush. | ||||||
